a wall which will allow the current hedge separating the properties to remain.

Planning has reviewed the issue regarding appropriate uses for the Carlsbad Corporate Plaza and
proposes to amend the Specific Plan to identify uses to be specifically allowed within the project
and those which may be approved subject to a Conditional Use Permit.
In the interim, a list of allowed uses has been developed which you may work with until such
time that the Specific Plan Amendment has been adopted by City Council and the Coastal
Commission.

of monitoring tenant changes with different parking requirements.

Mr. Hogan had been in to her office as instructed by
Police Officer Torrey Cluett.
( See attached letter)
Evidentally, someone has signed Mr. Hogan's signature to a
document illegally and now he, Mr. Hogan, is being harassed
by other homeowners.
Mr. Hogan has filed a police report. (99-2490)
I'm not sure what we can do but I felt someone should consider
this representation of Mr. Hogan if the document is being
used in someway of persuading anyone on the Planning Commission.

Dear Resident:
The City has conditioned the project adjacent to Alta Mira, Carlsbad Corporate Plaza, to
install either a block wall or a wooden fence along the adjoining property line.
This letter is a request for your input regarding which of the two is the most preferred.
Installation of a block wall may require removal of a significant portion, if not all of the
existing hedge. A wooden fence, on the other hand, can be installed in back of the
existing hedge without disturbing the hedge.
Please call me at 438-1161 extension 4448, any time day or night and leave a message
indicating if you have a preference for either the installation of a block wall or a wooden
fence.
The Planning Department will make a final decision regarding this matter the week of
May 24, 1999.

We are writing with respect to Altamira No. 1 and our north boundary hedge which ru~s alongsi~e
south boundary line of the Carfsbad Corporate Plaza.
The Board of Directors has inspected the bushes knocked down by the trucks of workmen, the bushes
removed, and the bushes which have been sliced through by your men to make way for the wall which is
to be erected. All are in a sorry state, so much so, the decision was that these bushes and roots should
be completely removed.
The bushes were planted over 25 years ago and would have been marking our boundary line for perhaps
another 25. The sad state they are in now is directly related to your construction activities at the
Corporate Plaza.
In a spirit of cooperation, we made no complaint during the time we were besieged with the trucks of the
many vendors, or the cars of the workman involved in this project. We worked daily around the traffic,
dirt, and muddy streets, not to mention the noise and disruption created by the construction of your
buildings.
We feel that the responsibility for complete removal of the decimated bushes rests with Plaza personnel,
and we are asking for neighborly cooperation and your full and speedy attention to this matter.

The purpose of this letter is to request that the City make the following determinations:
1. 38.5% or 2,310 square feet of the Eye Laser suite shall be allocated toward the
6,000 square feet permitted pursuant to Specific Plan 23(H) for use by "dentists,
doctors, chiropractors".
2. For the purposes of calculating parking requirements, the gross square footage of
the project is 75,660 square feet.
3. 312 parking spaces currently exist. 303 spaces are required for office, thereby
leaving 9 parking spaces for medical use.
2.310 SQUARE FEET OF THE EYE LASER SUITE IS MEDICAL.
The firm of Augustine Miller estimates that only 38.5% or 2,310 square feet of the Eye
Laser suite located on the second floor of the 6183 building should be classified as
medical because the balance of the suite is used as conventional office space. Enclosed is
the supporting documentation prepared by Augustine Miller.
THE PARKING DEMANDS OF THE EYE LASER SUITE ARE MINIMAL.
The parking demands created by the Eye Laser suite are comparable to office and not
traditional medical space. Enclosed is a letter dated July 18, 2002, from the
Administrator of the Eye Laser suite. The letter establishes that since the opening of the
facility, it has functioned within the following parameters:
(a) The practice has only 5 employees.
(b) No patients are seen on Tuesdays, every other Wednesday and after 9:00 AM on
Fridays.
( c) On the days when full patient schedules occur, the maximum daily patient load is
only approximately 30 -40.

THE GROSS SQUARE FOOTAGE OF THE PROJECT IS 75,660 SQUARE FEET.
The project has less square footage than planned. The gross project square footage on the
plans dated August 6, 1998, reflect 76,444 square feet. However, according to the
attached calculations prepared by the firm of Augustine Miller, the completed project
contains 75,660 square feet. This difference of 784 square feet reduces the number of
required parking spaces by three.
EXCESS PARKING EXISTS BASED UPON GROSS SQUARE FOOTAGE
Based upon a parking requirement for office use of 4 parking spaces per 1,000 square
feet, 303 parking spaces are required for the project. The total number of parking spaces
currently provided is 312. With 6,000 square feet of the project authorized for use by
"dentists, doctors and chiropractors" an additional 6 parking spaces are necessary to meet
the parking requirements for medical space. Therefore, the total number of parking
spaces required for the project is 309 (303 + 6). This leaves 3 extra spaces (312 -309).

We have reviewed your letter dated August 23, 2002 regarding a use classification for
the eye laser group in the building at 6183 Paseo Del Norte.
We are not able to make the determination that only a part of the suite is "medical" and
therefore requires less parking. Although there is evidence that the Nordan clinic may
not be an intensive use, it falls under the umbrella of "medical" since medical treatments·
are performed on the premises. Storage areas and office spaces are in the suite for the
purpose of supporting the medical treatments and must therefore also be considered
part of the overall medical use.
With verification of the building's size as built, you could process an amendment to the
Specific Plan to address allowed uses relative to available parking spaces.

NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a public hearing at
the City Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m., on Tuesday
May 18, 1999, to consider a request for approval of an amendment to Specific Plan 23 to establish
allowed uses and development standards for previously-approved office buildings at the southwest
comer of Paseo Del Norte and Camino Del Parque in the Planned Community Zone within Local
Facilities Management Zone 4 and more particularly described as:
Parcel 3 of Parcel Map No. 3415, in the City of Carlsbad, County
of San Diego, State of California, filed in the office of the County
Recorder of San Diego County, January 21, 1975 a file No. 75-014212
of official records.
Those persons wishing to speak on this proposal are cordially invited to attend the public hearing.
Copies of the staff report will be available on or after May 14, 1999. If you have any questions regarding
