by agreement between City of Carlsbad and LCWD. LCWD standards and
specifications will be complied with.

The decision of the California Supreme Court 1n the case of Friends
of Hammoth et al vs. Board of Supervisors of Mono County et al (Sac.
7924, "September 21, 1?72T has necessitated a review by the City of
your "Beach Colony" development. As you know, the court 1n the Mam-
moth case held that the Fnvlronmental Quality Act of 1970 applied to
private developmental projects. The effects of that decision are un-
clear at this time. The City 1s 1n the process of developlnq a series
of ordinances which will attempt to comely with the requirements of the
EQA and Friends of Mammoth.
It may be necessary for the City to suspend work on your development
pending an assessment of the effects to the environment resulting
therefrom. It also may be necessary to require that you furnish the
City certain Information regarding potential environmental effects.
The City then may find 1t necessary to prepare an Environmental Im-
pact Report and process 1t through the Planning Commission and City
Council. The project Itself may or may not be allowed to continue
depending upon the decisions resulting from such processing.
You should be aware that any work done on the Reach Colony project
after the date of receipt of this letter will be at your sole risk
and responsibility. However, at this time until the ordinances are
adopted and pending further guidance from the court, the legislators
and the Attorney General, 1t 1s not possible to give you more definite
Information.
It. 1s the policy of the City to request the execution of the enclosed
agreement for all ongoing projects 6f a more than trivial effect on

After evaluation of the "short form" environmental Impact assess-
ment, submitted to bhls office on November 8, 1972, by R1ck Engi-
neering, 1t has been determined that the project known as "Beach
Colony" could have significant environmental effects, and further
Information 1s needed 1n order for this department to prepare a
"long form" environmental Impact statement.
In addition to the Information required, as defined 1n Resolution
No. 3017, adopted by the Carlsbad City Council on November 8, 1972,
this office needs further clarification of some points made In the
aforementioned assessment form. They are:
1. Why you t^lnk the project will not significantly change
present land uses 1n the vicinity of the activity.
2. Why you think the project would not change the existing
features of the beach.
3. Why you think the project will not serve to encourage
future development of presently undeveloped surrounding
areas.
4. Why you think the existing site 1s "unaccesslble and
unattractive".
It 1s also our responsibility to Inform you that the project 1s
within the State Permit Zone as defined by the California Coastal
Zone Conservation Act of 1972.
Please submit the required Information as soon as possible so this
department may begin Its preparation of the preliminary environmental
Impact statement.

TO: PLANNING COMMISSION

SUBJECT: REQUEST FOR THE ADOPTION OF A SPECIAL PLAN AND A
TENTATIVE MAP FOR THE FIRST PHASE OF AN 81 UNIT
CONDOMINIUM.
APPLICANT: BEACH COLONLY C/0 L. C. GUTHRIE

INSPECTOR, PARKS AND RECREATION and
PLANNING
General Discussion
The applicant is requesting^the adoption of a specific plan
for 32 units, the first phase, o^f an 81 unit condominium; and
adoption of a tentative map on 4.20 acres lying west of the
old Coast Highway 101 and southerly of the south Carlsbad State
Campground.
The first phase is scheduled to be constructed on 2.3 acres
consisting of 32 condominium units, in a two story structure.
Parking facilities will be built beneath the structure and accom-
odate 111 parking spaces and additional 42 spaces for visitors
will be provided at street level to the east of the building.
The 153 spaces will also be a portion of the required parking
for the accompaning 49 units, to be built in the second phase.
Public access to the beach is provided by a 24 foot strip
of land connecting the public right of way and the beach. The
applicant additionally proposes to build a 6 foot walk and a
14 foot asphalt roadway within the 24 foot right of way.
Lots 2 and 4, 1.2 acres is additionally being offered for
dedication to the City.
Recommendation:
The staff recommends approval of the subject specific plan and
tentative map for the following reasons and subject to the
following conditions.

Reasons of Approval:
1. The proposed development will be an asset to the City of
Carlsbad and will help establish a character of development in
the south Carlsbad area.
2. The proposed development is in conformance with the City
of Carlsbad's General Plan and Housing element.
3. The proposed development meets the criteria of the City of
Carlsbad Ordinance No. 9272.
Conditions of Approval:
1. Detailed landscape and irrigation system plans of the first
phase of development shall be submitted to the Parks and Recre-
ation Department for approval prior to installation and prior
to the issuance of an occupancy permit.
2. Maintenance schedules delineating responsibi1ites for the
maintenance of said landscaping shall be incorporated and
approved by the Parks and Recreation Director as an item within
the property Swners' Association Documents.
3. That the project shall be subject to the payment of Parks
and lieu fees and that the developer,by dedicating Lots 2 and
4. fullfills his obligation to the public for providing beach
access.
4. Those documents concerning the maintenance of common areas
and building exteriors shall be submitted to the Planning Depart-
ment prior to issuance of an occupancy permit.
5. That Exhibit "A" shall be adopted as the specific plan, any
deviation therefrom shall be approved by the Planning Department.
6. That the architectural theme as shown in Exhibit "B" shall
be complied with: any deviation shall be subject to the approval
of the Planning Department.
7. That the location and type of all fire hydrants or other
fire fighting devices shall be subject to the approval of the
City of Carlsbad Fire Chief.
8. Any exterior wood materials used shall be treated with a
fire retardant material as specified by the uniform fire code or
{^approved by the City of Carlsbad Fire Chief.
9. Sewer service shall be provided by the Leucadia County Water
