Is there a real need in the community for more of the types of uses permitted by the Zoning requested than can be accommodated in areas already zoned for such uses? There is a real need for planned community developments to provide a variety of dwelling unit types, densities, and site arrangements with well intergrated community facilities and services. No land is available that is currently zoned for this purpose, and a substantial public demand exists for this type of development. 2, Is the property involved in proposed rec1 assification more suitable for the purpose permitted in the proposed zone than for the purpose permitted In present classification? The property involved is most suitable for a planned community development. Because of it's unique location on the waterfront this type of development will permit greater flexibility in design than would be possible through strict application of standard zoning and subdivision regulations. 3.' Would the uses permitte.. by the proposed zone be detrimental in any way to surrounding property? The requested planned community development will not be detrimental to surrounding property, but will in fact, be beneficial. The flexibility in design permitted by this approach provides larger open areas, resulting in a more attractivedevelopment.4. Results of this measurement are as follows: / BUILDING NUMBER - .HEIGHT TO GRADE 13 33'3" 15 33'9 ..18 34'6" . 19 . 34'9" Buildings 21-21A-22 and 22A were not measured since they are exactly as high as previously approved adjacent structures. Exterior grade elevations were established by the Engineering department using top of curb on Chinquapin as the reference point. Height elevation measurements were taken from the average height of the highest gable of the pitched roof. Our conclusion is that none of the buildings measured exceed 35* above grade. BOX 574 CARLSBAD, CALIFORNIA May 30, 1972 Carlsbad City Council Carlsbad, California Re: Carlsbad Lagoonn Papagayo Bay Gentlemen: The Carlsbad Planning Commission at their regular meeting date of May 9, 1972 held a public hearing on the Hunts Partnership precise plan which includes our property on the Hedionda Lagoon. We purchased our property in January 1928 with the plan on developing an orchard on the five acres of arable land which would bring a reasonably substantial net income for the maintainance of our home in this most delightful climatic and esthetic location on the bank overlooking the Agua Hedionda Lagoon. After the construction of the Freeway and the dredging of the lagoon, we envisaged the area on the north bank of the lagoon, between the Freeway amd the Santa Fe Right of Way, as being ideal for the development of some kind of complex such as an extensive spa, hotel or pleasure resort having access to the ocean through the tide-waters of the lagoon. During the fourtyfour years we have owned and operated our property, firat as an avocado grove and more recently as an experimental macadamia nut grove, we have watched Carlsbad develope from a small agricultural community of a few hundred people, through the struggling incorporated city to its present rapidly increasing population and expanding area. In the period of our ownership we have had many offers from potential buyers of our property, but none, until the Hunts Partnership have had any plan to utilize the property in conjunction with other adjoining properties for which this property is particularly adapted. Trask MEMBER CALIFORNIA AVOCADO SOCIETY CALIFORNIA MACADAMIA SOCIETY C arlsbad City Council Re: Papagayo Bay Carlsbad, California RECEIVED Mayor Dunne and Members of the City Council The Carlsbad City Planning Commission held a hearing on May 9, 1972 to hear a presentation by Mr. Larry Hunts of San Diego, wherein he offered a precise plan for the North Shore of the Middle Lagoon in Carlsbad. The first opposition speaker lead off calling Mr. Hunts proposal a " Dog and Pony Show ", I'll leave that to your judgement. Have you ever seen a better researched, more concise, finer developed plan to im- prove any area of Carlsbad? It is all within the guidelines of the Master Plan, Plann- ing Staff and Planning Commission, for the betterment and use of not only the residents of this project, but the residents of all Carlsbad, thereby conforming to the highest environmental benefit of all. The petition filed in opposition should be viewed in the light of how the signatures were obtained. Everyone signed before Mr. Hunts presentation, and some people by their own admission without knowing any of the facts. I believe the crux of the entire opposition is a fear of higher "Taxes". Many of the residents claimed they would be forced to sell their property. A completely realistic view, as any tax appraiser will confirm, is that any property in any way, water oriented will double in taxes every ten years. These people of Harbor Drive who think they are paying high taxes, but are in reality enjoying the priviledges of the high taxes we pay on our vacant property, should visit their tax appraiser and find out what is in store for them, either with or without Mr. Hunts project. We have been paying taxes on this vacant land for thirteen years. Some residents in the area have used this land as their childrens playground, as a dump for trash deposits and have torn down private property, no tresspassing signs which had been posted, and as a result we found it necessary to carry $1,000,000 liability insurance to protect ourselves. Our taxes during this period have risen over 12,000%, while the assessed valuation has risen 7,575%. Mr. Hunts development is the acme of all the proposals we have received on this property . A look at the opposite end of the spectrum may be of value. An extreme example is one "Quick Buck" operator who wanted to develope only the R-T property at the end of Harbor Drive with the maximum number of units, 150 to 200 two bedroom apartments 4 stories high, to import welfare recipients and fill the apartments entirely at Government expense. This is not as impossible as it sounds, however we rejected his plan and are sure you would also. I was amazed at the sometimes exaggerated arfcl illogical claims and conduct of the • Vopposition, conversely, the tact, diplomancy arid wisdom displayed by the Planning Commission during this hearing was exemplary. Planning in retrospect is very easy, but can any of you imagine the present houses of Harbor Drive being planned one half block from Balboa, Mission Bay or San Diego Harbor. It would be an economic catastrophy. Carlsbad will eventually have a Harbor. It has the only natural deep water entrance of any inlet between Newport and San Diego, Unfortunately the City of Carlsbad has neither the tax base nor the cash flow to buy the North Shore for the City. I believe that first class private developement, with guaranteed public access as so generously offered by Mr. Hunts and enforced by the City, would be the best and highest possible use of this beautiful location. The most often heard comment from knowledgeable people is "When can we move in". My wife and I hope to occupy one of these units at the earliest possible date. This will result in an offsetting ownership into the water area. This is not a desirable situation. To allow for this development, a legal exchange of property between the developer and San Diego Gas & Electric Company needs to occur* The development concept and method of property exchange has been discussed with the developer and we are in agreement in principle with the project. STAFF REPORT/MEM iNDUM May 9, 1972 TO: Planning Commission FROM: City Manager SUBJECT: Request for a reelassification in zone from R-l and R-T to P-C (Planned Community) and Adoption of a Specific Plan on property located south of Chinquapin, north of Agua Hedionda Lagoon, east of A.T. & S.F. rail- road and west of 1-5. APPLICANT: HUNTS PARTNERSHIP Report Submitted by: City Manager, Engineering , Fire Building Inspector, Parks and Recreation and Planning Departments Section I - General Discussion The proposed project is for the development of 418, two bed- room condominium units on a 23+ acre parcel of land at an approx- imate density of 18+ units per acre. The property is located in existing R-l and R-T zones and is adjoined to the north by other R-l properties along Chinquapin, Auga Hedionda Lagoon to the south 1-5 to the east, A.T. & S.F. railroad to the west. Off street parking will be provided as stipulated in City of Carlsbad park- ing ordinance. Water and sewer facilities along Chinquapin are adequate to handle the anticipated population increase. Ingress and egress will be facilitated by two openings along Chinquapin, one westerly of Harbor Drive and one easterly of Jefferson Street. External traffic flows will be generated from Jefferson Street via Tamarack Avenue and from the Chinquapin freeway overcrossing. Internal circulation will be facilitated through a network of horizontal two way curved streets, designed for the integra- tion of low speed automobile traffic and pedestrian walkways. There will be no cross streets. The proposed development appears to be compatible with, and promotes the recreational development and use of Agua Hedionda Lagoon. Renderings depict lagoon frontage as developed with boat anchorage and small beach fronts to accomodate both residents of the project and the general public. Section II - Recommendation The Staff recommends approval of the project for the follow- ing reasons and subject to the following conditions. Page Two May 9, 1972 Staff Report Section III - Reasons of Approval 1. The proposed project reflects the intent of the General Plan for development in this area. 2. The proposed project will not be a detriment to the surrounding properties. Section IV - Conditions 1. That all information required by City Ordinance 9060, Chapter 21.30 (Planned Community), be submitted for Staff review prior to final approval. Information to include: (a) a detailed landscape maintenance program (b) time schedule indicating phases of development and approximate completion dates for each phase(also to include information on utilization of Lagoon property.) 2. Applicant shall be subject to the City of Carlsbad Park Dedication Ordinance No. 9190. Fees shall be paid in lieu of dedication and the owner shall provide public access to the i! a goon for bicycles and pedestrians. 3. Landscape and sprinkler plans shall be submitted for review before construction and prior to occupancy. 4. Applicant shall file a Subdivision Map in accordance with the State Map Act. 5. Full street improvements shall be constructed over the southerly 32' of Chinquapin Avenue between 1-5 and the A.T. & S.F. Railroad. 6. Street rights of way, adjacent to the property as required for Street Improvements, shall be dedicated to the City free of all liens and encumbrances. 7. All with to th public improvements shall be constructed in accordance City of Carlsbad design criteria and shall be subject he approval of the City Engineer. The water distribution and sewer collection system shall be dedicated to the City together with the necessary easements free of liens and encumbrances. On-site fire hydrants and fire protection appurtenances shall be constructed in accordance with Fire Department requirements. 10. A grading and drainage plan shall be approved by the City Engineer prior to any grading. 11. The interior streets are proposed to be private, The following special conditions shall apply: a) Provisions for maintaining the streets, satisfactory to the City Engineer and City Attorney, shall be pro- vided prior to issuance of any building permits. b) The design of all streets shall be approved by the Public Works Department and all street construction shall be inspected by the Public Works Department and a standard inspection fee paid. c) All streets shall be designed for a structural section in accordance with City of Carlsbad Standard Design criteria. d) Provision for accomodating pedestrian traffic satis- factory to the Planning Director and City Engineer shall be provided. e) Lighting adequate for pedestrian and vehicular safety and sufficient to minimize police problems shall be provided. f) Where it is proposed to reduce street widths by elimination of curb-side parking, equivalent parking in addition to the normal off-street requirement shall be provided by other means. g) The City will assume no responsibility for enforce- ment of traffic control. 12. The intersection of the easterly entrance shall be located approximately 250' easterly of Jefferson Street, the exact location to be approved by the City Engineer. 13. That Exhibit "A" shall be adopted as a Specific Plan, any deviation shall be subject to the approval of the Planning Department. 14. Installation of Street Improvements westerly of Jefferson Street may be deferred until construction is begun on that portion of the development west of the existing subdivision JACIB.
