SUBJECT: Executive Committee Action/Buena Vista Condominium
Development
In accordance with the Office of Management and Budget's Circular A-95, the CPO
Executive Committee, at its March 31st meeting, reviewed the Environmental Impact
Statement (EIS) of the proposed condominium development located on the shores of the
Buena Vista Lagoon within the cities of Carlsbad and Oceanside.
Based upon a review of the EIS the Executive Committee has determined that there
are no unresolved regional issues regarding this proposed project and that further
review by CPO will not be necessary.
However, given the nature and setting of this project, and in the interest of making
this project as compatible as possible with the lagoon environment, the Executive
Committee has recommended that FHA take all possible steps to insure high quality design
and appropriate limitations on construction actively as a condifjpn of mortgage insurance
approval (Note consultant recommendations in Environmental Impact Statement). This
can be accomplished for instance by encouraging the proper selection of building shapes,
colors, textures and placements on both parcels to reduce negative visual impact.
Monitoring of construction activities would also serve to limit potentials for lagoon
pollution through siltation.

Finally, we would like to express our thanks to FHA for the opportunity to comment
on this project. The Environmental Impact Statement received is one of the most
comprehensive reports reviewed by CPO to date on a housing development within the
San Diego Region.

Gentlemen:
An Environmental Impact Statement dated January 28, 1972,
was submitted to the City of Carlsbad by the Bruce Farley Corporation
complying with requirements levied by A-95 Review Procedures estab-
lished in conjunction with Comprehensive Planning Organization
requi rements.
The Environmental Impact Statement was submitted and
reviewed by the City of Carlsbad Planning Department and Planning
Commission as part of submission of an application for a 25-unit
condominium project within this City. The City of Carlsbad at
present time does not have adopted interim guidelines that would
comply with the intent of the Environmental Quality Act of 1970 and
the decision rendered in conjunction with Friends of Mammoth vs.
Mono County. At the present time, the City is operating on a
policy dated Oct. 19, 1972, that requires a hold-harmless agreement
signed by the developer in lieu of established review and reporting
procedures that would satisfy the above act. On October 30, 1972,
the staff is to present to the City Council a draft of an interim
ordinance that would establish those guidelines interpreted to
meet the intent of the law.
Under the existing policy a building permit may be issued
if a hold-harmless is signed. When the established guidelines have
been adopted and the Environmental Impact Statement submitted by
the Bruce Farley Corporation is reviewed and an assessment made as
to its compliance with those guidelines, the hold-harmless agreement
would no longer apply.
