Dear Sir:
Sflth reference to our telephone conversation of this date,
regarding zoning for the proposed Bank of America facility in
this community, ve are pleased to enclose an Application for
Change of Zone and Adoption of a Specific Plan.
This department is in support of Commercial zoning for the
location under consideration, but it is also firm in the opinion
that the total proposed shopping center should be considered at
this time.
The City's primary concern is with coordinated land use,
architecture, landscapingf and traffic control. Therefore, it
would be advantageous to all concerned to meet Jointly with City
staff members and discuss the overall concept.
The proposed banking facility would certainly provide a
fine service to the citizens of Carlsbad, and we are looking
forward to cooperating with California's largest banking institu-
tion.

On November 17, 1970, the City Council of
Carlsbad passed an Agenda Bill No. 291 to consider
a request for change of zone and adoption of Specific
Plan for a temporary banking facility (Bank of America)
located at El Camino Real and Haymar Drive.
One of the conditions of the zone change was
that the temporary bank structure and its use shall be
used for a period of time not to exceed two years.
Continental Service Company as agents for
the Bank of America hereby request an extension of
this period of time for an additional two years commencing
upon the expiration of the existing ordinance.

Confirming our discussions of August 6th regarding the
establishment of a new Bank of America branch on the Bast aide
of El Castino Real near Highway 78 in our city, we wish to sub-
mit the following procedure for rezoning of the building site

Attention Mr. Robert M. Crowell
Pursuant to City Council Ordinance No. 9333, an ordinance of the
City Council adopting .a Specific Plan for your property, the
temporary bank permit on El Camino Real in the City of Carlsbad
will terminate on November 17, 1974.
Ordinance No. 9333 amended City of Carlsbad Ordinance No. 9258
which originally granted a Specific Plan for the temporary facility
under the asumption that a permanent bank facility would be built
within a reasonable amount of time. In as much as your original
approval was granted November 17, 1970, your temporary facility
will have been in existance for 4 years. At your September 1972
public hearing before the Planning Commission it was implied that
the existing amendment to Specific Plan Ordinance 9258 was nec-
essary to allow you time to prepare plans and construct your new
facility. To date plans have not been received.
I would recommend that you file an application with the City of
Carlsbad for a Conditional Use Permit which would be granted for
a temporary office building for a period of one year. During that
one year it will be required that your permanent facility be under
construction. If construction does not commence within one year
of the approval of the Conditional Use Permit the temporary bank
structure would be an illegal use.
In order to insure continued operation of the bank facility, your
application should be submitted as soon as possible so that it
can be processed prior to November 17, 1974.
Any questions you may have regarding this matter, please do not
hesitate to contact this office.

BANK STRUCTURE ON THE SOUTHEAST QUADRANT OF HAYMAR
DRIVE AND EL CAMINO REAL

BANK OF AMERICA, N.T. & S.A.
Report submitted by: City Manager, Fire, Engineering, Building,
Parks & Recreation and Planning Departments
General Discussion:
The applicant proposes to amend Ordinance No. 9258 Sec. 2, Part D,
to read as follows: "That the temporary bank structure and use
shall be allowed to operate until Nov. 17, 1974."
The site location of subject property is south of and adjacent to
an existing Standard Oil Service Station located on the Southeast
Quadrant of Haymar Drive and El Camino Real. The Specific Plan
in existence for this property limits the land use to parking
facilities and a temporary bank structure, until further specific
plans have been adopted by the City.
Recommendation:
The staff recommends approval of this application for the following
reasons and subject to the following conditions:
Reasons for Approval :
1. The proposed time extension would not adversely affect the
General Plan.
2. The time extension would not materially affect or change the
existing Specific Plan on the property.
3. The time extension would not be materially detrimental to the
public health or welfare.
Conditions of Approval:
^"2.. That all other conditons of the Specific Plan on this property
be adhered to.
