Facts resulting from the staff investigation are: 1. The development of subject property shall conform to all ordinances of the City of Carlsbad unless the specific plan Exhibit "A" and/or the following conditions are more restrictive: 2. All building locations, open space and parking areas shall be generally in conformance with the specific plan (Exhibit "A"). 3. All street improvements including water, sewer, underground power and telephone, street tree planting, street lights, storm drain and any other improvements deemed necessary by the City Engineer shall be installed in conformance with City Standards and indica- ted on an approved improvement plan prior to the issuance of a building permit. 4. All lands necessary for street widening shall be dedicated to the City of Carlsbad prior to approval of said improvement plan. 5. Proper drainage shall be maintained throughout the development so as to prevent ponding and/or storage of surface water. 6. A grading plan shall be submitted prior to the issuance of a building permit. 7. A ten foot (101) easement shall be granted on Laguna Drive and Knowles Avenue for <jptree^ purposes . 8. All open areas on Exhibit "A" shall be planted and maintained with shrubs, ground cover and 12 gallon minimum size trees, all planted in accordance with Ordinance No. 9174 and all served by a water irrigation system supplied with bubblers and sprinklers. 9. All plans for the landscaped areas and sprinkler systems shall be approved by the Planning Department. 10. Density and parking requirements shall not exceed those as indica- ted on the specific plan (Exhibit "A"). 11. A uniform style of six foot (61) high grape stake fence or masonry block wall shall divide the proposed R-3 zone and the R-l zone to the west. The sewer and water lines are not laid in the same trench in any part of this subdivision. 4. Proper drainage is maintained throughout the sub- division so as to prevent ponding and/or storage of surface water. I have reviewed your letter with Bud Plender, Assistant Planning Director, and we have come up with the following conclusions; The Specific Plan (SP-40) encompassing your property was imposed over eight separate properties totaling approximately 6.6 acres. There is no indication on the adopted exhibit that the properties would be developed separately. In fact, it appears that most of the property would have to be developed concurrently in order to function properly. Also, the conditions-of-approval in Ordinance No. 9221 relate to overall development. Because of the above, I believe you have the following options: 1) Develop all of the eight properties at once according to the adopted Specific Plan. 2) Apply for an amendment to the Specific Plan to allow phased development. 3) All eight property owners apply for a revocation of the Specific Plan and each of you develop under the R-3 development standards. The Specific Plan for this area was primarily adopted to assure necessary public improvements along Knowles and Laguna. The City now has a public improvements ordinance that assures improvements with building permits. Because of this, I would recommend that you attempt option #3.
