Report of Findings to the Commission
Notice of the above time and place of the hearing on the above
application was given as required by the Zoning Ordinance, and
a hearing on said application was scheduled for August 27, 1968,
by the Commission.
Facts resulting from the staff investigation are:
1. The development of subject property shall conform to all ordinances
of the City of Carlsbad unless the specific plan Exhibit "A" and/or
the following conditions are more restrictive:
2. All building locations, open space and parking areas shall be
generally in conformance with the specific plan (Exhibit "A").
3. All street improvements including water, sewer, underground power
and telephone, street tree planting, street lights, storm drain
and any other improvements deemed necessary by the City Engineer
shall be installed in conformance with City Standards and indica-
ted on an approved improvement plan prior to the issuance of a
building permit.
4. All lands necessary for street widening shall be dedicated to
the City of Carlsbad prior to approval of said improvement plan.
5. Proper drainage shall be maintained throughout the development
so as to prevent ponding and/or storage of surface water.
6. A grading plan shall be submitted prior to the issuance of a
building permit.
7. A ten foot (101) easement shall be granted on Laguna Drive and
Knowles Avenue for <jptree^ purposes .
8. All open areas on Exhibit "A" shall be planted and maintained
with shrubs, ground cover and 12 gallon minimum size trees, all
planted in accordance with Ordinance No. 9174 and all served
by a water irrigation system supplied with bubblers and sprinklers.
9. All plans for the landscaped areas and sprinkler systems shall be
approved by the Planning Department.
10. Density and parking requirements shall not exceed those as indica-
ted on the specific plan (Exhibit "A").
11. A uniform style of six foot (61) high grape stake fence or
masonry block wall shall divide the proposed R-3 zone and the
R-l zone to the west.

Gentlemen:
This is in regard to your letter dated August 15, 1968 regarding the
Brady Zone Change south of Knowles Avenue, Carlsbad.
Our field investigation has been completed and we find that gas and
electric facilities are available to serve the property. Gas and electric
service would be available from either Knowles Avenue or Laguna Avenue.
It is recommended that before any construction is started the owners contact
this office to determine electric padmount locations and gas meter locations
at the proposed building sites.
If we can be of further service, please contact me at our Oceanside office.

Dear Mr. Olinghouse:
Your request for our recommendations concerning the Brady Zone
Change, submitted by Forest J. Brady, et al has been received
and reviewed by this department.
This zoning change would be acceptable to the Department of
Public Health provided:
1. All domestic water supplied to this subdivision
comes from the Carlsbad City Water Company.
2. All buildings constructed in this subdivision are
connected to the Carlsbad Public Sewer System.
3. The sewer and water lines are not laid in the same
trench in any part of this subdivision.
4. Proper drainage is maintained throughout the sub-
division so as to prevent ponding and/or storage
of surface water.
Thank you for giving us the opportunity of making recommendations
concerning the proposed zoning change.

SUBJECT: Specific Plan - Brady Zone Change,
The Engineering Department has reviewed the subject Spec-
ific Plan. Inasmuch as the Plan is primarily a schematic
map, it is recommended that the applicant submit a Tenta-
tive Subdivision Map showing the proposed improvements in
public right of way, as well as the topography of the
area.
It is recommended that any re-zoning be subject to the
requirement of the Subdivision Ordinance of the City of
Carlsbad with specific requirements set forth in the
Resolution approving the Tentative Map submitted by the
applicant.

Facts resulting from the staff investigation are:
1. The proposed zone change contains approximately
eight (8) acres.
2. Subject property is level with no unusual topo-
graphic features. The areas adjacent to subject
property are developed with single family residences
3. There are several older homes upon the site.
4. If application is approved the streets adjacent
to subject zone change should be improved to City
Standards to handle the increase in vehicular
traffic created by an increase in density.
5. Density and parking requirements shall conform to
the proposed specific plan.

The zoning is R-3 with a specific plan adopted in 1968 ( SP-Uo
Brady )
Some of the questions which I need answers to are as follows:
I.Will my development plan be governed by the "Specific Plan" or
by R-3 zoning?
2. If theSpecific Plan applies; will I be allowed to use the tandem
parking as shown on the specific plan?
3. If the Specific Plan applies; what are my set back, side & rear
yard requirements.
U. If theSpiecific Plan has expired; can I proceed under the R-3
zoning requirements?

Dear Mr. Shapard:
I am very sorry for the long delay of responding to your letter
of February 3, 1977. I have reviewed your letter with Bud Plender,
Assistant Planning Director, and we have come up with the following
conclusions;
The Specific Plan (SP-40) encompassing your property was imposed
over eight separate properties totaling approximately 6.6 acres.
There is no indication on the adopted exhibit that the properties would
be developed separately. In fact, it appears that most of the property
would have to be developed concurrently in order to function properly.
Also, the conditions-of-approval in Ordinance No. 9221 relate to overall
development. Because of the above, I believe you have the following
options:
1) Develop all of the eight properties at once according
to the adopted Specific Plan.
2) Apply for an amendment to the Specific Plan to allow
phased development.
3) All eight property owners apply for a revocation of
the Specific Plan and each of you develop under the
R-3 development standards.
The Specific Plan for this area was primarily adopted to assure
necessary public improvements along Knowles and Laguna. The City now
has a public improvements ordinance that assures improvements with
building permits. Because of this, I would recommend that you attempt
option #3.
If you have any further questions, feel free to contact me at any
time.
