Most of this debris is in the forni of cigarette butts and packs. The planter was not installed by the City, therefore, staff believes it may have been placed by the owner, previous owner, or owners of the businesses located in the building. The subject planter needs to be utilized as intended and maintained with adequate planting, or removed. Regarding the trash around the planter, it not only creates visual blight, but the debris could enter the storm drain which flows directly into the ocean, then posing environmental hazards as well. I am requesting your immediate assistance in rectifying this situation. I appreciate your cooperation in resolving these matters. The lattice enclosure is not part of the outdoor dining permit approved for your location, and therefore is not permitted. The outdoor dining permit for your location was approved through an Administrative Redevelopment permit (SRP 97-01), which allowed a low (42") railing to be installed on the public sidewalk in order to Insure the tables and chairs within the outdoor dining area would not impede pedestrian traffic. However, all outdoor dining within the Village is intended to be seasonal. Your outdoor dining area is located on public property and was not intended to become a permanent addition to your restaurant. The addition of the lattice walls begins to permanently enclose the outdoor restaurant area and is considered an extension of the restaurant space. Enclosure of outdoor dining patio space triggers additional parking requirements and these additional parking requirements may prove difficult to be provided on-site. Therefore, staff recommends that you remove the lattice work immediately as it is a violation of your current permit and to apply for a permit that allows lattice work may prove difficult due to the additional parking requirements. It has been brought to our attention that there are a number of planters placed around the building at 2907 State Street that are empty or lacking an adequate amount of plant material. Staff believes that since the planters were not installed by the City, they were probably placed around the building by the owner, previous owner, or owners of businesses located in the building. These planters need to be utilized as intended and maintained with adequate amounts of suitable plants in them, or removed. Although the City will not be responsible for maintaining these privately owned planters, you may contact Greg Dauss of the City's landscape maintenance staff at 434-2954 to assist you in determining what types of plants would be easy to maintain and well suited for those locations. First, we have completed all of the required Internal reviews for the Sidewalk Cafe Permit Application you originally submitted on April 15, 1996. The Engineering Department has determined that, with the exception of the possible bumper encroachment Into the five foot clear sidewalk area, the revised plans (dated May 17, 1996) you submitted are acceptable for final processing. We have determined Internally that It will not be necessary to also process an Encroachment Permit In order to obtain the Sidewalk Cafe Permit. However, It will be necessary for you and the property owner to sign a Encroachment Agreement, record the agreement against the property, and provide the necessary insurance. The Encroachment Agreement will be required because you will be constructing a permanent structure within the City of Carisbad's Right-of-Way. If at some future date, a restaurant Is no longer located at the subject site, the City will require removal of the enclosure. The Encroachment Agreement will be forwarded to you separately for execution and further processing. Second, we still have the outstanding Issue to resolve regarding the fees to be applied to Sidewalk Cafes. Due to a previous action by the City Council taken In June, 1996, one of the fees previously quoted to you was eliminated. As you may remember, you were quoted a total fee amount of $34,393 for traffic Impact fees, sewer fees and water fees. The City Council recently took action to restructure the water fees. Therefore, the previously quoted water fee of $14,057 has been eliminated completely; this fee will no longer be applied unless a new water line Is being added to an existing or new building. The fees remaining are the sewer fee and the traffic Impact fee which previously amounted to $20,336, when your proposal Included a total of 44 outdoor seats. With the revised plans you submitted (dated May, 17, 1996), your outdoor seating capacity was 2965 Roosevelt St., Ste. For Information purposes, an Agenda Bill Is currently being processed for review by the City Council which would propose a further restructuring ofthe fees to be applied to outdoor tables and chairs. Although I do not have ail of the details related to this fee restructuring at this time, I am aware that consideration Is being given to allowing a certain number of tables and chairs outdoors with no related fee. Any number of tables and chairs over this given number would then be required to pay the fees In effect at the time of application. I will keep you updated on the status ofthis fee restructuring. It Is anticipated that this Issue will be considered by the City Council sometime within the next few weeks. As soon as the Agenda Bill is available for distribution to the public, a copy will be fonA/arded to you for your review. We are continuing to process your application while we are waiting for a decision on the fees. As soon as the decision on the fees has been made by the City Council, action will be taken to finalize your permit and prepare It for Issuance to you. As you are already aware the Engineering Department has completed their review of your application to ensure that there are no safety issues represented by the plan you have submitted to our office. The following is a summary of the comments and revisions requested to the site plan, as referenced on the attached redline copy of your plans: 1. The number of tables and chairs outside may not exceed the number of tables and chairs located inside your establishment. The site plan shows eleven outdoor tables and states that there will be four chairs per table. This would result in a total of forty four chairs rather than the forty one seats specified in the sunmiary table; 2. Vehicles parked in the diagonal parking spaces on State Street will more than likely overhang into the curb or sidewalk area. This will intrude into the minimum five feet of clear sidewalk area required for pedestrian use; 3. The fencing at the comer of State Street and Grand forces pedestrians to walk on to the handicap accessibility ramp, which increases the possibility of pedestrians tripping or even falling down; 4. As previously discussed with you, the new Village Master Plan and Design Manual requires fees for the establishment or continuation of Sidewalk Cafes. These fees are fairly substantial and are the same as those paid by restaurants who expand their seating areas on private property. You will be required to pay the following (one time) fees in order to receive your permit for a Sidewalk Cafe: a. Traffic Impact Fee ~ $9,758 ($34 per ADT @ 7 ADTs per 1 seat) b. Sewer Capacity Fee ~ $10,836 ($1,806 per EDU @ 1 EDU per 7 seats) 2965 Roosevelt St., Ste. Water Fee ~ $14,057 ($2,400 per EDU @ 1 EDU per 7 seats) The . above fees are based on the amount of seats and seating space represented by the Sidewalk Cafe. Per your site plan, Caldo Pomodoro is proposing a maximum of 41 outdoor seats; and, 5. The site plan specifies that the fence will be anchored to the ground within the right of way. Per City Ordinance NS-5 Section 11.16., 150, an above ground encroachment permit will be required. Approval of this permit must be granted by the City Council. In order for Caldo Pomodoro to receive the Sidewalk Cafe permit, the City must find that Caldo Pomodoro has complied with all criteria established relative to Sidewalk Cafes and that the use is not likely to result in health or safety problems nor is it likely to adversely impact adjacent uses. Based upon the design of the outdoor dining area as currently proposed by Caldo Pomodoro, the City is unable to support the approval of this Sidewalk Cafe permit. Staff is also unable to support the approval of an encroachment permit for the sidewalk cafe at this time. Additionally, the City has received repeated complaints regarding Caldo Pomodoro's existing outdoor dining area. The placement and number of chairs, tables, and umbrellas have continually interfered with pedestrian traffic and present a safety problem. In accordance with the City's Village Master Plan and Design Manual, sidewalk cafes or dining areas must maintain a clear area of at least five feet in width for pedestrian use. The City is reluctant to support Caldo Pomodoro's application for a Sidewalk Cafe permit until Caldo Pomodoro has demonstrated compliance with this requirement. It is requested that you revise the site plan for the sidewalk cafe as noted on the attached redline copy of your plans and resubmit such revisions to our office to process this permit as quickly as possible. The Engineering Department Is reviewing the application at this time to ensure that there are no safety Issues represented by the plan you have submitted to our office. Although I do not anticipate any problems, It is important that the Engineering Department complete Its review and provide comments before the permit can be Issued for your proposed Sidewalk Cafe. While the Engineering Department Is completing Its review of your application, I wanted to take the opportunity to share some Information with you regarding fees related to the Sidewalk Cafes. At this time, all eating or drinking establishments with Sidewalk Cafes In the Village will be expected to pay these fees in order to retain the right to have tables and chairs on the public sidewalk. Outdoor cafes on private property will be assessed the same fees. I will be on vacation from May 6 through 16, 1996. Therefore, I will not be able to complete processing of your permit until May 17, 1996. At that time, I should have final comments from Engineering and will be able to take final action on your permit. In the meantime, you should ensure that you are prepared to pay the fees outlined within this correspondence. A final fee amount will be presented to you upon my return. Your request represents the first Sidewalk Cafe to be processed for a permit since approval of the new Village Master Plan and Design Manual. The application with the exhibits submitted to the Housing and Redevelopment Department on April 15, 1996 are being returned to you at this time for revisions. Also, the application was not signed as required by the standards for sidewalk cafes and the fee for processing the application was not Included with the submittal. It Is requested that you revise the plans for the sidewalk cafe as noted on the redline copy of your plans (attached) and then resubmit the application with appropriate signatures and the $150 fee. A check for the fee should be made out to the "City of Carisbad". Also, you need to provide a Certificate of Insurance in the amount of $1 million to my office before the permit for the Sidewalk Cafe will be issued. The following represents a summary of the revisions requested to the site plan submitted with your application: 1. As we discussed previously, the number of tables and chairs outside may not exceed the number of tables and chairs located Inside your establishment. Per your plans, you have 12 tables & 42 seats located Inside the establishment. Therefore, you may have no more that 11 tables and 41 seats within the Sidewalk Cafe area. You will need to revise your plans to reflect this standard. 2. The Redevelopment Agency will not approve the extension of the enclosed Sidewalk Cafe Area beyond five (5) feet from the westeriy edge of the gate on the North elevation (Grand Avenue side of enclosure). Based on your site plan, the elimination of this enclosure area will result in the elimination of three (3) tables and approximately 10 to 12 chairs. 2965 Roosevelt St., Ste. The Redevelopment Agency will not permit the "pop out" of the Sidewalk Cafe area on the east elevation (State Street front of building) which allows for five (5) tables rather than three (3) tables. This area must be enclosed so that It Is equal to the alternate side (south side of doors/entrance) In size and shape. 4. Please indicate directly on the site plans how you Intend to secure the wrought iron fencing. For example, will you be bolting the fencing to the sidewalk or to the building only? We did review the photographs of the tables and chairs as well as the proposed fencing type/style that you submitted with your application. The furniture and fencing styles and materials are acceptable to the Carisbad Redevelopment Agency. Please resubmit these photographs with your completed application and revised plans. On a final note, 1 wanted to remind you that upon final approval of your Sidewalk Cafe permit you will be required to strictly adhere to the approved site plan and related permit. You will not be allowed to extend the enclosure area or add tables and chairs without the prior written approval of the Carisbad Redevelopment Agency. You also will not be allowed to place additional tables outside the enclosed area. In addition, 1 wanted to let you know that you will be responsible for relocating the planter noted on your site plan. The Agency would also like for you to agree to maintain the subject planter as part of your project. Business owners are responsible for watering and maintaining the planters In front of their businesses. Unfortunately, few business owners are aware of this requirement. As part of your project approval, you will be free to plant any flowers of your choice within the planter and then be responsible for watering them, weeding/trimming and/or replanting when necessary. As soon as you complete the application and revisions to the site plan, please resubmit the entire package so that we might be able to continue processing the permit as quickly as possible. A review of your preliminary plan by the City has resulted in a determination that it appears you will be able to meet the standards set forth within the new Village Master Plan & Design Manual for sidewalk cafes. The City of Carlsbad is currently preparing an application form for processing permits related to sidewalk cafes. This form should be ready for your use within the next couple of weeks. In the meantime, you need to prepare detailed plans which will provide precise dimensions for the sidewalk area to be used by your restaurant. These plans must show the locations of all planters, trees, or street furniture in the area and immediately adjacent to it. You will also need to provide detailed elevations showing the type of tables and chairs, the locations of these tables and chairs, and the design of the enclosure in relationship to the existing building. These plans should be prepared by a professional architect or similar person. As soon as the Sidewalk Cafe Application is ready, it will be mailed to you. It is important to note that you will ultimately be responsible to provide a Certificate of Insurance in the amount of $1 million to the City of Carlsbad before a permit will be issued to you. This Certificate of Insurance must name the City of Carlsbaci as additionally insured. If you have any questions regarding this correspondence, please contact my office at 434-2935. We have reviewed the sidewalk cafe guide lines that were supplied to us by your department, and feel that we should fit within the guide lines, with out any problems. As you may be aware we have been in business at this same address at 2911 State st. going on 5 years. We feel that our proposed enclosed out door side walk cafe area is a natural for our location. It is our opinion, and we hope you agree, that it will not only enhance our particular location but become an asset for the entire neighborhood, enticing tourism into the village. Customers will be able to relax with their lunch or diner outdoors while enjoying the village square at State & Grand. Please review the site plan that we have included.
