I agree to indemnify, hold harmless, and defend the City of Carisbad and the Carisbad Redevelopment Agency or its officers or employees from all claims, damage or liability to persons or property arising from or caused by the installation ofthe subject sidewaik/freestanding sign on the public sidewalk pursuant to this permit unless the damage or liability was caused by the sole active negligence of the City or its officers or employees. I have submitted a Certificate of Insurance to the City of Carisbad in the amount of $1 million which lists the City of Carisbad and the Carisbad Redevelopment Agency as "additional insured". This Certificate shall remain in effect for as long as the sidewaik/freestanding sign is placed within the public right-of-way. This agreement is a condition ofthe issuance ofthis permit for the subject sidewaik/freestanding sign to be placed on the public right-of-way. I understand that an approved sidewaik/freestanding sign permit shall remain in effect for as long as sidewaik/freestanding signs are permitted within the Village Redevelopment Area and the permittee remains in compliance with the subject approved permit. I also understand that the Housing and Redevelopment Commission may conduct an annual review ofthe applicable sign regulations for sidewaik/freestanding signs and reserves the right to modify or eliminate the regulations which currently allow for these signs. Gtiiddines These guidelines are to assist the sign designer and compliment the tnandatory ordinance standards. They are rntended to encourage a high level of design quaiity while aiso providmg flexibility to encourage creative design, • 1. The sign design should be simple and easy to read. Use a bnef message. Tbe fewer the words, the more effecuve the stgn. A simple sign wuh a bnef message is faster to read, looks cleaner, and is more effecuve. Usmg overly mtncate type facet or mixmg typefaces oo ooe sign also makes it ayort difficult to read quickly and reduces the sign's ability to communicate. • 2. Use a durable matenal such as MDO (Medium Density Overlay) plywood or similar wood-like oiatenal. Signs must have a sumed or pamted surface fuush. • 3. The background color for ail signs should be white. • 4. Tbe text should be in 3 colors oniy (too many colors compete with content for the viewen attention). Fluoresceot or Day-Glo colors are not accepuble. • S. If a umque busmess logo is proposed, it's color shall not count as ooe of the three text colors. (Item 4 above). • 6.
