I agree to indemnify, hold harmless, and defend the City of Carlsbad and the Carlsbad Redevelopment Agency or its officers or employees from all claims, damage or liability to persons or property arising from or caused by the installation ofthe subject sidewaik/freestanding sign on the public sidewalk pursuant to this permit unless the damage or liability was caused by the sole active negligence of the City or its officers or employees. I have submitted a Certificate of Insurance to the City of Carlsbad in the amount of $1 million which lists the City of Carlsbad and the Carlsbad Redevelopment Agency as "additional insured". This Certificate shall remain in effect for as long as the sidewaik/freestanding sign is placed within the public right-of-way. This agreement is a condition ofthe issuance of this permit for the subject sidewaik/freestanding sign to be placed on the public right-of-way. I understand that an approved sidewaik/freestanding sign permit shall remain in effect for as long as sidewaik/freestanding signs are permitted within the Village Redevelopment Area and the permittee remains in compliance with the subject approved permit. I also understand that the Housing and Redevelopment Commission may conduct an annual review of the applicable sign regulations for sidewaik/freestanding signs and reserves the right to modify or eliminate the regulations which currently allow for these signs. For complete regulations please refer to Section 21.41 of the Zoning Ordinance. A sign pennit must be obtained from the City for these signs. Ordinance Stondards (mandatorv) • .Maximum of one sign per busmess which must be located m front of the buildmg to which it relates. • Maximum area is ten square feet per face. Maximum of two faces per sign. • Maximum width of three feet and a maximum height of five feet. • Signs must be either square or rectangular. • Signs must be of a durable material, and shall be kept, clean, neatly pamted. and m good repair. • 'A' frame signs must be ten feet apart, mmimum. • Signs shall not block pedestnan or vehicle visibility or obstruct access to public streets, dnveways. parkmg spaces, fire doors, fire escapes, handicapped access or any public nght-of-way and shall not obscure or mtertere wuh any traffic sign, public safety sign or notice. • Signs shall not be permanently affixed to any object, structure or the ground. • The signs are not allowed on public and pnvate property abuttmg pnme arterial and major artenal streets and scemc comdors except m the redevelopment area. • "A' frame signs are prohibited after January 1, 1995. Guiddinf^ These guidelines are to assist the sign designer and cotnpliment the mandatory ordinance standards. They are rntended to encourage a high level of design quality while also providmg flexibility to encourage creative design. * I. The sign design should be simple and easy to read. Use a brief message. The fewer the words, the more effective the sign. A simple sign with a bnef message is faster to read, looks cleaner, and is more effecuve. Usmg overly mtncate type faces or mixing typefaces on one sign also makes it more difficult to read quickly and reduces the sign's ability to commumcate. 2. Use a durable matenal sucb as MDO (Medium Density Overlay) plywood or siimlar wood-like matenal. Signs must have a stamed or pamted surfiace fimsh. 3. The background color for all signs should be white. 4. Tbe text should be m 3 colors only (too many colors compete with content for the viewers attention). Fluorescent or Day-Glo colors are not accepuble. 5. If a unique business logo is proposed, it's color shall not count as one of the three text colon. (Item 4 above). 6. Changeable text areas should coinply with the above criteria (1-5) and should occupy no more than 50% of the sign face. Paper or non-rigid changeable areas are not acceptable.
