Please read these requirements carefully and explain how the proposed project meets each of these facts. Use additional sheets if necessary. I. Explain what special circumstances are applicable to the subject property, including size, shape, topography, location or surroundings, whereby the strict application of the zoning ordinance deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification: The subject property is one of four corners (SE corner) on the intersection of Palomar Airport Road (PAR) and El Camino Real (ECR). This intersection establishes the four quadrants that divide the city. The corner property is distinctly unique in the city in that: (1) its location and proximity to the Palomar Airport runway prevents a wide range of land uses and aside from restricted warehouse uses, a self storage facility is the only use allowed by the underlying master plan compliant with airport land use plans. No other property in the city is so severely limited in its potential range of land uses given Palomar Airport, with some exceptions such as the NE corner of PARIECR which is crash zone/open space per airport land use plans. The limitation on land uses makes signage important for the long-term viability of the use. (2) Because of the land use limitations and location on important city intersection, the self-storage architecture was required to be on par with Class office architecture. Because the project appears to be an office complex, it is virtually invisible to the self-storage consumer without the appropriate signage. (3) The original Conditional Use Permit approval allowed for approximately half of the otherwise allowed signage onsite (and restricted certain elevations from any signage at all). While rectified via subsequent amendment to the CUP by the applicant, the damage of under-signage is still an impact that a second monument sign would help to mitigate. (4) Site access is not possible from PAR or ECR roadways; access to the subject site is via Campbell Place and circuitous route to rear of site through the Bressi Ranch business park; of the two corner properties at PARIECR intersection that allow public use or access (this property and the SW corner), only this property does not enjoy direct access off of PAR or ECR. This provides further justification for a second monument sign onsite especially when considering business viability factors that rely on adequate signage. (5) The subject property's most direct competitor located one block west on PAR has a 133 square foot wall sign and a monument -both with phone numbers. Consumers that are able to decipher our existing signage call information (411) and always wind up talking with the competition, namely Carlsbad Self Storage. In summary, these five factors (airport/land use restriction to self storage; city required office architecture effectively 'hides' self storage use; initial limitation on allowed signage allowance concurrent with opening of business, and; unique in that no access off of PARJECR) combine to create a unique situation that cannot be duplicated anywhere else citywide. • • 2. Explain why the granting of the variance does not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which the subject property is located and is subject to any conditions necessary to assure compliance with this finding: No other property citywide has the location, access or use restrictions that this property has. A precedent will not, and cannot, be created by granting this property a second monument sign. Additionally, the subject property's most direct competitor enjoys a 133 square foot single wall sign in addition to a monument. They have an unfair advantage as a result. 3. Explain why the granting of the variance does not authorize a use or activity which is not otherwise expressly authorized by the zone regulation governing the subject property: The granting of a second monument sign will not affect the intensity or nature of the self- storage use conducted onsite; it will provide fairness as far as adequate signage is concerned. Monument signs are common for commercial businesses and such land uses also have the benefit of appropriate architecture and access. Given the compromised situation of architecture and access, a second monument sign onsite will not represent the granting of a variance not otherwise authorized. The Variance process allows for situations like this to achieve fairness when assessed in a citywide business context. 4. Explain why the granting of the variance is consistent with the general purpose and intent of the General Plan and any applicable specific or Master Plans: The request for a second monument sign is consistent with the General Plan in that a precedent is not being set for this or other zoning districts citywide. Furthermore, when considering the various factors that comprise the uniqueness of this site, the General Plan concepts of fairness and business vitality are promoted in a very real and financially impacted sense. The request for a second monument sign maintains pubic safety, which is the objective of the applicable airport land use plan and related land use restrictions on adjacent properties. This request also honors the objectives of attractive development with superior landscaping and architecture for the business park area of Carlsbad, and scenic corridor qualities of El Camino Real. In addition, no adverse impacts or violations would result with the underlying Bressi Ranch Master Plan or Palomar Airport land use plan by granting the requested Variance for a second monument sign onsite.
