Explain what special circumstances are applicable to the subject property, including size, shape, topography, location or surroundings, whereby the strict application of the zoning ordinance deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification: The subject site sits on a severely sloping hill that requires extensive retaining wall installations to allow buildings, roadways and pedestrian walkways to be built on it. As such, due to the slope cuts, the buildings on the site actually sit farther back than would a site that sits on a flat grade. An example of a shorter setback is the shopping center across the street, Bressi Village, on the Gateway Road side. Because most of the buildings on the north parcels of the Bressi Village shopping center can maintain a relatively short distance to the Gateway Road, pedestrians and motor traffic could easily see signage that has a relatively short sight distance, approximately 25-34 feet, from the street. With our severely sloped site, the buildings on Gateway Road side will be approximately 30-60 feet depending on the location. To further complicate the issue, the two major tenants, Sprouts and CVS, sit on the far north side of the site, causing sight distances to be greater than 650 feet from proposed Gateway Road entry way and storefront. The modified sign program is necessary for our project to ensure that proper visibility and identification is provided for tenants as well as visitors. The modifications contained in this sign program for Sprouts and CVS would ensure that tenants set deep inside the shopping center would have signage that would help visitors easily identify store locations. The signage would simply be too small if built per the currently allowed signage ordinance without any variance. The total distance from storefront to main entryway at Gateway Road is approximately 670 feet. Even with the increase in sign area and letter height, the signage will not be disproportionate to the building size and frontage and will not be aesthetically detrimental to the project. Signage area is also a concern. The modified sign program would provide a way for tenants with multifaceted buildings that face both streets and interior parking lots and/or driveways to have a way of having signage on multiple sides of the building to ensure positive identification by visitors whether seen from exterior of the shopping center or from within the shopping center. Current limit on signage area and signage letter height would limit the size and number of signage for tenants, whose logos are of irregular shape or need multiple signs due to the orientation of the buildings. By splitting up the allowable square footage of signs, each store would have a small sign that may be illegible from distances and be disproportionate to the building size and height, causing the storefronts to appear awkward. Due to the sight distance differences between Bressi Village and the subject property, same size signage on Gateway Road side of Bressi Village, may appear too small and ill-fitting with building size and architecture. By allowing the multifaceted buildings to have enough flexibility in letter height and signage area, each tenant will be able to provide signage that is visible to both visitors within the shopping center as well as pedestrians and motorists who are passing by the shopping center. While the center across the C street has less of a setback from the street sidewalk allowing easier visibility of street facing signage to pedestrians and motorists, our site condition puts the pedestrians and motorists at a minimum of twice or three times the setback at Bressi Village. For example, at the south east comer of Gateway Road and our main entry way, the distance from sidewalk to our monument signage on the retaining wall is approximately 61 feet. By adding a project identity signage at the corner of El Fuerte Street and Gateway Road with no tenant identification, we would ensure that our shopping center is identifiable to motorists and pedestrians without having to visit the other monument signage placed on the entry driveways. We wanted to make sure that this sign was done as tastefully as possible and thus eliminated any tenant identification. By allowing a larger size signage for tenants set deep within the shopping center such as Sprouts and CVS, it would ensure that visitors entering from either Gateway Road or El Fuerte Street would be able to quickly identify these shops' locations and provide an easy way to find their way around the shopping center. By making it easy for patrons to quickly identify locations of each shop through thoughtfully designed and strategically placed signage 2. Explain why the granting of the variance does not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which the subject property is located and is subject to any conditions necessary to assure compliance with this finding: Granting of variance for signage ordinance does not grant special privileges that are inconsistent with the limitations upon other properties in the vicinity and zone in which the subject property is located. The subject property plans to follow all other signage ordinance codes and local zoning codes strict! y including types of signage and uses allowed per city ordinances. 3. Explain why the granting of the variance does not authorize a use of activity which is not otherwise expressly authorized by the zoning regulation governing the subject property: The allowable uses on the subject site has been outlined in the resolution documents and the subject site will adhere strictly to the allowed uses. 4. Explain why the granting of the variance is consistent with the general purpose and intent of the general plan and any applicable specific master plans: Granting of variance is consistent with the general purpose and intent of the amended general plan ~ to allow the occupants to provide a shopping center that encourages walkability, engaging to the visitors and end users through visual and physical features, and provides a place that local residents and residents of Carlsbad could feel proud to have as a neighborhood center. .. • 5.
