2. THIS variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone but which is denied to the property in
question because maximization of the green zone bf the facility, while
encouraging energy savings through car pooling (see atchment No. 5, hereto),
allows the expanded Hughes plant to be a positive factor in the local
Calsbad environment.
3. THE gran.ting of this variance will not be materially detrimental
to the public welfare or injurios to the property or improvements
in the same vicinity and zone in which the subject property-,is located
because: this variance will increase the landscaping and green zone of the
parcel positively affecting the esthetic and ecological impact on neighboring
property without reducing lot usability; it establishes parking stall stand-
ard consistent with contemporary auto usage trends; and it encourages energy
savings in small car use provisioning.
4. THE granting of this variance will not adversely affect the
comprehensive general plan because ± does not chahge the' arcteitinn

The California State Government Code S 565906 states that a variance
from the terms of the zoning ordinance shall be granted only when,
because of special circumstances applicable to the property, including

by other property in the vicinity and under identical zoning classification.
A variance shallnot be granted for a parcel of property which
authorizes a use or activity which is not otherwise expressly authorized

MEMORANDUM

SUBJECT: VARIANCE 240 ( HUGHES AIRCRAFT )
Due to recent court decisions regarding the required findings
necessary for the granting of a variance, the City Attorney
has suggested that the Planning Commission review both the
Municipal Code Section and the California Government Code
Section related to variance criterion.
The "exceptional circumstances" referred to in the Municipal Code
are more specifically defined in the Government Code as those
"applicable to the property, including size, shape, topography,
location or surroundings..."
In considering the Hughes variance request, the Commission must
determine whether these criterion have been met. Staff, in
re-evaluating the Hughes request, is of the opinion that the more
appropriate solution to reducing the required parking for P-M
uses is to amend the P-M Ordinance. The one space for every 250 SF
gross floor area standard has proven to be inordinately excessive
for planned industrial type uses. Therefore, Staff is suggesting
that the Planning Commission resolve to hold a public hearing on
July 9, 1974 to consider revising the parking standards for the
P-M Zone.

Carlsbad Municipal Code
21.44.210 OFF-STREET PARKING IN P-N ZONE: Every parking area in the P-N
Zone shall be governed by the following provisions in addition
to those covered in Section 21.44.160:
(1) Off-street parking shall be provided at the ratio of
one space for each 400 square feet of building area,
or one for each 1.0 employee on the maximum working
shift, whichever is greater;
(2) No parking shall be allowed in a front, side or rear.
yard adjoining a street, or within ten feet of an
interior side or rear property line;
(3) The Commission may, by resolution,, allow up to 25%
of the-total required parking spaces to be reduced
in size to accomodate compact cars provided that:
A) Compact car spaces are located in separate
parking aisles from standard sized spaces;
B) Aisles for compact car spaces are clearly
marked with permanent pole signs denoting
"COMPACT CARS ONLY";
C) Compact car spaces shall be located in close
proximity to the facility which they serve so as
to encourage their maximum usage;
D) Compact car spaces must be a minimum width of 7.5
feet and a minimum length of 15 feet;

I. REQUEST: The applicant is requesting a variance from the
provisions of the Municipal Code Sections 21 .44.160 (l)and
21.44.210 in order to:
(1) Reduce the total number of required parking spaces
from 886 to 753 to correspond to actual usage rates;
(2) To reduce the size of 217 of the required parking
stalls to 75' x 15' so that compact cars can be
accommodated without excessive paving.
II. RECOMMENDATIONS: Staff recommends that V-240 be approved.
Justification is based on:
(1) The variance is necessary for the preservation and
enjoyment of a substantial property right possessed by
other property but denied to the property in question
because actual and projected usage of the parking
area is considerably less than the 1 space per 250
sq. ft. gross floor area requirement for the P.M. Zone.
(2) Exceptional circumstances relating to the ratio between
employees/vehicles gross floor area apply to this
property, but are not generally applicable to other
properties in the same vicinity.
(3) The variance will be beneficial to the-public welfare
by encouraging car pooling, smaller car usage, and
increased landscaping.
(4) The variance will not adversely effect the General Plan
because it does not change the characterization or
zoning of the property involved.
Recommended Conditions of Approval:
This variance is granted for the land described in the
application and any attachments thereto and as shown
on the plot plan labeled Exhibit A. The location of all
buildings, parking areas and landscaping shall be
.
substantially the same as indicated on the plot plan.
(2) All requirements of any law, ordinance or regulation of
the State of California, City of Carlsbad, and any other
Governmental Agencies shall be complied with.
(3) A detailed landscape and sprinkler plan prepared by a
landscape architect, shall be submitted to the Planning
Director for consideration and approval
(4) All landscape areas in parking lots shall be enclosed
by a raised concrete curb or low wall. All planters
adjacent to street right-of-way shall be constructed
with weep holes per specifications of the City Engineer.
(5) The applicant shall provide the Planning Director with
a written analysis of parking usage 6 months after
completion of each phase -. Should these subsequent
surveys indicate that parking is inadequate, the applicant
may be required to adjust parking provisions accordingly.
(6) The applicant shall grade and permanently landscape the
total area noted as "phase A+B+C (Required Per Ordinance)"
on Exhibit A. Should additional parking be required, the
applicant shall provide the necessary spaces in this area.
(7) The applicant shall provide evidence to the Planning
Director of a continued program encouraging car pooling.

Application for a Variance
VARIANCE REQUESTED
Owners leasee, Hughes Aircraft Company, has commenced expansion of its
Industrial Products Division's recently completed building on the pro-
perty which is the subject of this variance. The expansion is being
coordinated with the cognizant departments of the City of Carlsbad and in
accordance with the conditions of Resolution 836, dated 27 February 1973,
of the City of Carlsbad Planning Commission.
Resolution 836 approved the Hughes Specific Site Plan, dated August 31,
1972. This expansion will complete the building designated "Industrial
Products Division", Building "A", to approximately match the footprint
indicated on the site plan.
The expansion will be in two phases, phase B and phase C (the newly completed
structure is phase A). During phase B, the footprint will be completed and a
total shell structure provided, but, only a portion of the interior will be
finished and used, resulting in a phase A and phase B interior usable area
totalling 157,38 square feet. The later completion of the phase C interior
portion will give a total usable building area of 224,458 square feet. These
figures include 2,960 square feet for the existing utility building.
Section 21.44.210 of the code requires that provisions be made for 888 parking
stalls for phase A, B and C. The site will be graded to accommodate this
number. However, the impact of the world-wide energy crisis has changed the
transportation habits of people in an effort to save energy and to deal with
the associated economic hardships. Attachment No. .3 presents data to show
what has happened to the vehicle mix at the new facility in Carlsbad. Approx-
imately 30% and more of the cars in the lot are now compact cars. Also people
per car ratios are 1.35 or greater. Section 21.44.210 of the Code would require
parking stalls which result in a ratio of 1.06 employees per car. Section
21.44-160 of the Code requires parking stalls dimensioned at 170 square feet

for standard cars only.
Systems Capital Corporation and Hughes Aircraft Company request that the
Planning Commission grant a variance against Section 22.44.210 of the Code
permitting the following numbers of parking stalls based on 1.25 employees
per vehicle.

dimensioning of parking stalls for compact cars. The following number of
spaces are proposed based on a mix of 29 compact and 71% standard cars.

Note that the Code only requires 8 .5 X 20 feet for a standard parking stall.
If the variance is approved, Hughes will landscape the additional graded area
that would have been required to provide 888 parking stalls. If expansion to
8 parking stalls is ever needed or directed, it can be accomplished at
minimum impact to the site. The additional landscaping will enhance the es-
thetic value of the facility and provide an ecological improvement over the
parking lot asphalt.
Hughes Staff Personnel will periodically monitor parking lot loads for adequacy
of available capacity (Attachment No. 4 provides some projected data).

for all interested employees. Once registered,
employees may use the cards to arrange for pools
with other employees.
Ride pool registration cards for Carlsbad
are available from Linda Pemberton, in the
Carlsbad Lobby. In Oceanside, cards are avail-
able from Gabrielle, at the switchboard.
Posters on the bulletin boards will give
ride pool information. Please see that all em-
ployees are aware of the ride pool registration.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING THE
AMENDMENT OF THE CARLSBAD MUNICIPAL CODE BY
REVISING SECTION 21.44.210 AS IT PERTAINS TO
PARKING STANDARDS FOR USES IN THE P-M (PLANNED
INDUSTRIAL) ZONE, ACCORDING TO THE PROVISIONS OF
TITLE 21 OF THE CARLSBAD MUNICIPAL CODE.
CASE NO: ZCA-63
WHEREAS, a Resolution of Intention, was passed to hold one
publi.c hearing to consider the amendment of the Carlsbad Municipal
Code by Amending Section 21.44.210 entitled Off Street Parking in
P-M Zone; and
WHEREAS, the purpose was to modernize and update the existing
Zoning Code of the City of Carlsbad; and
tHEREAS, notice of hearing to amend the Zoning Code, pursuant
to the provisions of Title 21 of the Carlsbad Municipal Code
entitled "Zoning", was published in the Carlsbad Journal, a news-
paper of general circulation published in said City of Carlsbad,
and the Affidavit of Publication is on file in the records of the
Planning Commission; and
WHEREAS, the purpose was to consider the change, amendment and.
supplement in said regulations; That of amending Section 21 .44.210
of the Municipal Code. Said wording to read:
OFF-STREET PARKING IN P-fl ZONE: Every-parking area in the
P-fl Zone shall be governed by the following provisions in
addition to those-covered in Section 21.44.160: .
(1)' Off-street parking shall be provided at the ratio of
one space for each 400 square feet of building area;'
(2) No parking shall be allowed in a front, side or rear'
yard adjoining a 'street, or within ten feet of an
interior side or rear property line;
(3) The Commission may,. by resolution, allow up to 25%
of the total required parking spaces to be reduced
in size to accomodate compact cars provided that:
a) Compact car spaces are located in separate
parking aisles from standard sized spaces;
b) Aisles for compact car spaces are clearly
marked with permanent pole signs denoting
"COMPACT CARS ONLY";

:i. c) Compact car spaces shall be located in close
proximity to the facility which they serve so
2 as to encourage their maximum usage;

d) Compact car spaces must be a minimum width of
7.5 feet and a minimum length of 15 feet;

WHEREAS, a public hearing was duly and properly held at the
6 time and place specified in said notice, on July 9, 1974; and
7
WHEREAS, in the opinion of the Planning Commission, the above
8 mentioned changes in the Zoning Code should be hereinafter includ-
9 ed in the Carlsbad Zoning Code.
10 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
1.1 the City of Carlsbad, California, and it does hereby find that the
12 public necessity, convenience and general welfare require the chang
13 in the Zoning Code and that the same will be for the benefit and
14, general welfare of the inhabitants of said City, and the Planning
Commission does hereby recommend to the City Council that it take
16 such steps as may be necessary to change by ordinance or amendment
17 to the existing Carlsbad Zoning Code the amendment or addition to
18 Section 21-44.210 pertaining to Parking Standards for uses in the
19 P-M (Planned Industrial) Zone.

PASSED, APPROVED AND ADOPTED at a regular meeting of the City
21 of Carlsbad Planning Commission held on July 9, 1974, by the
22: following vote, to wit:
