BACKGROUND Location'and Description of Property The subject property consists of a 25'x140' (3500 square foot) lot located on the west side of Ocean Street, approximately 150 feet south of Cypress Avenue. The proposed single-family dwelling follows the topography of the site and thus will be constructed on two levels, stepping down approximately 9' toward the west. The western most portion of the lot slopes down to the beach and will be left undeveloped. There is an existing single-family dwelling on the property. Exisirig Zoning Subject Property: R-3 North: R-3 South: R-3 East: R-3 West: Beach Existing Land Use Subject Property: Single-family residence (SFR) North: SFR South: SFR East: Vacant West: Beach General Plan Information a) Land Use: The Land Use Element of the City's current general plan designates the subject property for high density residential development. The project is consistent with this designation. b) Public Facilities Sewr Service: The City Engineer has established that the subject property is currently served by one residential sewer hookup. This is adequate to serve the property. . S Schools: The project is located within the Carlsbad Unified School District. This district has indicated that school facilities will be available concurrent with need for this development. Gas and Electric Service: SDG&E provides gas and electirc service to the property. Water Service: The City of Carlsbad is responsible for supplying water to the site. On-site and Adjacent Public Improvements: All necessary 5ñ-site and adjacent public improvements can be required as per the City's public improvement ordinance, or as condition of approval. 'Other Public Facilities: All other public facilities inecessary to serve this project will not be available concurrent with need. The Planning Commission may, by inclusion of an appropriate condition, require that the project contribute to the costs of such facilities according to City Council Policy No. 17. Since the development would pay for its appropriate share of the public facilities it would require, the Planning Commission could be assured that the requirements of the public facilities element of the General Plan would be satisfied. c) 'Other General Plan Elements: The project is consistent with all other elements of the City's General Plan. Environmental Iinpac't Information The proposed variance is exempt from the Carlsbad Environmental Protection Ordinance. Specifically, Section 19.04.090(C) (4) exempts minor side yard and setback variances not resulting in the creation of any new parcel or in any change in land use or density. History 'and Related Cases V-2'33 (Bryant; Planning Commission Resolution No. 1093). On September 10, 1974, the Planning Commission approved a front yard setback variance for a garage extension on a 25 1 x140' lot located on the west side of Ocean Street south of Beech (2731 Ocean Street). The variance allowed a reduction from the required 20 feet front yard setback to a zero ft. setbacks Although staff was recommending denial, the Planning Commission approved the variance finding that the lot's width and size precludes the owner's use of the property in a manner similar to others. Staff based their recommendation or denial on the fact for the years from 1956 to 1967, no front yard variances less than 5' were approved. -2- . S V-267, (Meadows; Planning Commission Resolution No. 1318) On January 26, 1977, the Planning Commission approved a variance for reduced setbacks allowing the encroachment of parking into the front and side yards. Specifically, the parking for a proposed four unit building, located on a 60 foot wide lot on the west side of Ocean Street (3093 Ocean), was permitted to encroach to within 4 feet of the front yard setback and zero feet of the side yard setback. Findings of approval stated that: extraordinary circumstances exist due to a limited amount of usable area for parking and that a number of similar variances have been granted for projects along Ocean Street. V-276, (Zipser; Planning Commission Resolution No. 1438) The Planning Commission approved (on March 22, 1978), a variance which reduced the required side yard setback from 7.5 feet (10% of the lot width) to 5 feet in order to allow the construction of two garages. The property is located on the west side of Ocean Street, north of Pacific Avenue. The Planning Commission approved the project based on findings that other similar variances had been granted, that the property had limited area for vehicular parking, and that the remaining setbacks would provide adequate emergency access. V-285, (Craig; Planning Commission Resolution No. 1476) This variance was approved by the Planning Commission on October 11, 1978. It affected the property at 3093 Ocean Street, which is the same site on which V-267 (Meadows) was approved. However, the applicant found that the plans approved under V-267 did not correctly reflect the property line along Ocean Street, thus the applicant had to revise the plans (reducing the number of units from four to three) and reapply for essentially the same variance (reduced front and side yard setbacks for parking). V-290, (Zipser, Approved by the City Council November 6, 1979) The City Council approved a request for a variance from the parking and storage space requirement of the Condominium Ordinance. This variance was necessary in order to allow the conversion of an existing tri-plex (constructed in conjunction with V-296) to condominium units. The principal reason the applicant requested the parking variance was due to the fact that the Engineering Department required a 5 foot dedication for street widening along Ocean Street. It should be noted that the Engineering Department also required a 6 foot dedication from the property directly across the street from the site. II. Major Planning Considerations 1) Are there exceptional or extraordinary circumstances applicable to the property which give cause to the variance? -3- U 2) Is the variance necessary for the presentation of a substantial property right? 3) Would the variance adversely affect surrounding property by creating hazardous conditions or impeding emergency access? 4) Would the variance affect the future improvements along Ocean Avenue? III. DISCUSSION The proposed project involves a request for a variance from the front and side yard setback requirements in the R-3 zone. The subject property is a 25 foot wide, bluff-top lot located on the west side of Ocean Avenue. Specifically, the request is to reduce the front yard setback from 20 feet to 2.5 feet, and the sideyard setback, from 5 feet to 3 feet. The variance is desired in order to allow the construction of a three level (30 feet) 3,459 square foot single-family residence. The applicant has indicated that the Coastal Commission will not allow the proposed residence to extend any further west than the western most portion of any adjacent residences (string-line method). An existing residence on the site would be removed. The applicant has stated that the existing residence does not observe a front yard setback, and has sideyard setbacks of only 3 feet. Along Ocean Avenue, the lots range in width from 25 to 75 feet. As indicated in the History Section, variances have been granted for both front and side yard setbacks, primarily due to the limited buildable area on these lots. However, also :as previously mentioned, the Engineering Department has required a dedication of land from properties along Ocean Avenue for street widening purposes. In the case of the subject proposal, the Fire Department has reviewed the plans and finds the variances acceptable. Specifically, the property is within a Fire Zone II which requires special building permits in order to lessen fire threat from one property to another. This is primarily due to the narrow lots and, in many cases, reduced side yards. The Fire Department feels that the proposed variances would not create any potential safety problems, and that adequate emergency access to the structure will be provided. However, the Engineering Department is recommending that the applicant be required to dedicate a 5 foot wide strip of land along Ocean Street for the eventual widening of this street. Presently, the existing right-of-way along this portion of Ocean Street is 40 feet, which is substantially less than the design standard of 60. The Engineering Department feels that a minimum right-of-way of 50 feet is acceptable. Therefore, staff is recommending against -4- . the front yard variance and, as a condition of approval of the side yard variance, recommending that the applicant be required to make a 5 foot dedication along Ocean Street. The Engineering Department has indicated that the future widening of Ocean Street would in most probability, result in an actual street width of 32 or 40 feet. This would create a buffer between the curb and new property line of either 9 or 5 feet. In either case, staff feels that the proposed residence could be allowed to build up to the new property line and yet still have an adequate buffer between the street and residence for safety purposes. At the same time, this buffer would be small enough to dissuade vehicular parking in front of the garage which might encroach into the street. Staff is therefore recommending that, in addition to the requested side yard variance, the Commission approve a variance reducing the required 20 ft. front yard setback to zero feet, as measured from the new property line created upon the 5 foot dedication. IV. Recrnnlendation Staff recommends that the Planning Commission DENY the applicant's request for a variance permitting a 2.5 foot front yard setback, and—APPROVE the request for a variance reducing the side yard setbacks to 3 feet. In addition, staff recommends that the Planning Commission APPROVE a reduction in the required front yard and setback to zero ft, as measured from the new propertly line created upon the dedication of a 5 foot wide strip of land along Ocean Street. Findings 1) There are exceptional or extraordinary circumstances applicable to the subject property that do not apply generally to the other property in the same vicinity since the lot is of a substandard width, which along with the required 5 foot dedication, reduces the buildable area and necessitates the front and side yard variances. 2) The variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, but which is denied to the property in question since other property in the immediate area have additional lot area available for building or, have either been granted set variances or have been previously developed with residences which do not meet current R-3 setback requirements. 3) The granting of the variances will not be materially detrimental to the public welfare or injurious to the property on improvements in the vicinity in which the property is located since: -5- a) The area has been established as a Fire Zone II which necessitates special building practices in order to reduce fire potential; b) The variances would not interfere with emergency access or the circulation of light and air to the property; c) An adequate buffer between the street and residence will be provided in order to reduce any potential traffic safety problems. 4) The granting of this variance will not adversely affect the City's Comprehensive General Plan since: a) The project is consistent with the underlying landuse designation. b) At this time, the Planning Commission is not prepared to find that all other public facilities necessary to serve the project will be available concurrent with need. The Planning Commission has, by inclusion of an appropriate condition, required that the project contribute to the costs of such facilities. Since the development will pay its proportionate share of the public facilities which it will require, the Planning Commission is satisfied that the requirements of the public facilities element of the general plan have been satisfied. c) The project is consistent with all other elements of the City's General Plan. 5) The project will not result in any significant adverse environmental impacts since it is categorically exempt from the Carlsbad Environmental Protection Ordinance as per Section 19.04.090(c)4.
