Please read these requirements carefully and explain how the proposed project meets each of these facts. Use additional sheets if necessary. a) Explain why there are exceptional or extraordinary circum- stances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the same vicinity and zone: Owners were recuired to dedicate 12 ft. to city for future street widening b) Explain why such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question: Available parking often governs the design and size of an office building. Several office buildings have recently been designed with a variance in side yard setback for parking. These buildings are attractive and have enhanced the development of the city without creating an adverse affect on the immediate community. These completed buildings are: (1) Minnich Yocum Office Bldg., (2) Pio Pico Bldg., (3) Bryan Square c) Explain why the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located: The parking arrangement as proposed has been designed for maximum aesthetics. Virtually all parking spaces will not be visible from the street. Parking has been designed to be hidden by the building and landscaped earth berms on street frontages. The general public and adjacent property owners will not be able to visually determine what the parking side yard setback is. d) Explain why the granting of such variance will not adversely affect the comprehensive general plan: It does not change the utilization of the property from the comprehensive general plan and it allows for virtually all parking to be unnoticed from passing traffic. I PLANNING COMMISSION RESOLUTION NO. 1711 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A VARIANCE OF SECTIONS 21.18.050(5) & (10), TO REDUCE THE SIDEYARD SETBACK FROM 9' TO 5' TO ALLOW THE ENCROACHMENT OF PARKING GENERALLY LOCATED ON THE SOUTHEAST CORNER OF PlO PICO DRIVE AND CHESTNUT AVENUE. APPLICANT: FREEHOF CASE NO: V--313 WHEREAS, a verified application for certain property, to I wit: Portion of Lots 12 and 13 in Block "C" of the Resubdivision of a portion of Alles Avocado,Acres, Map No. 2027. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application' constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 8th day of.
