IMPORTANT CHANGES TO
THE PLANNING, ZONING, AND DEVELOPMENT STATUTES
Nine major changes and a host of other modifications to state land use laws resulted
from the 190 Legislative Session. Governor Brown signed 24 land use planning and
development bills into law in 1980, nearly twice as many as were approved the previous
year. Because several of these bills will work profound changes in the activities of
planners, elected officials, developers, and concerned citizens, you should read the full
text closely. While the staff of the Office of Planning and Research is available to
explain these changes, you should consult your city attorney, county counsel, or private
lawyer for specific legal advite In OPRrs -pinion, the nine major changes are:
o New legislative policy on the scope of local general plans.
o Creation of a clear standard of judicial review of general plans.
o New requirements for the content of local housing elements.
o Clear prohibition of regulatory discrimination against affordable housing.
o - New requirements •on zoning for residential zones.
o New tenant notice requirerrnts or rental conversions.
ó New notice and analysis requirements for mnobiiehome park conversions.
o Reduction of the statute of limitations for challenging subdivision approvals from
180 to 90 days.
Planrin (
The Legislature made several changes to the scope and content required of local general
plans. Regional transportation improvement plans may now ask for more funding than
is available (Section 65082). The Legislature said that the scope of general .plans should
fit local conditions and circumstances (Sections 65300.7 and 65302.1). It also determined
that the adoption and amendment of general plans are legislative acts and the courts
should review them in that regard (Section 65301.5). The Legislature ended the debate
over the advisory or mandatory nature of the housing element guidelines by incoroorating
their substance into the statute and authoriz.ng new guidelines which will clearly be
advisory. All cities and dounties will be subject to these new standards after October 1 ?
1981 (Sections 65302(c) and 655S0-6559). General plan deadline extensions now begin
from their approval date' and are not ubjcct to envftonmenta.i review requirements
(Section 65302.6). If a general plan limits the yearly amount of housing, a city council
or county board of supervisors must justify any regional housing limitations tSection
65302.8). The limitation on the number of gi.nerai pLan Eirnendments does. riot apr!y to
amendments for affordab'e housing projcts (ction 65361).

Zoning
The Legislature's changes to the zoning statutes were intended to promote opportunities
for affordable housing, including mobilehome. The Legislature required cities and counties
to zone for residential uses to match their housing elements, refrain from imposing
unreasonable standards on housing, and consolidate their review of development permits
on request (Sections 65800 and 65913-65913.4). In most cases, mobilehomes cannot be
excluded from lots zoned for single-family dwellings (Section 65852.3). The Legislature
clarified prezoning procedures (Section 65859) and eliminated the two-week waiting period
betwecn a general plan amendment and the conforniing rezoning (Section 65862). Notice
provisions after a rezoning were simplified (Section 56863.5). Local officials may now
grant variances for parking requirements under two conditions (Section 65906.5).
Development
Most of the 1980 changes are related t6 other modifications in the planning, zoning, and
subdivision laws. The Legislature generally prohibited local ordinances which discriminate
against affordable housing (Section 65008). It also required additional notice before
mobiiehome parks can be converted to condominium ownership (Section 65863.7).' With
resj5ëct to school impact fees, the Legislature permitted their imposition in certain cases,
even if state school aid was used (Section 65979). The Legislature also clarified the
definition of "interim facilities" which can be financed by these fees (section 65980).
Subdivision Map Act . . -. . .
Besides making major changes affecting rnt& cbnversions and the statute of limitations,
the Legislature tinkered with several specific requirements. Citie and. counties must -
ref rzun from imposing unreasonable standards on affordable housing in their subdivision
ordinances (Section 66411). The Map Act does not apply to separation of interest for
assessment purposes in community apartments, stock cooperatives, or limited equity
cooperatives Section 66412), nor to financing or leasing of new commercial or industrial
buildings on a single parcel (Section 66412.1). The Legislature validated ertàin lot splits
created before March 1972 (Section 66412.6). Parcels which were merged by operation
of an earlier law are now, considered unmerged, although cities and counties may still
merge contiguous parcels in some situations Section 66424.2). The Legislature created
new notice oroyisions for conversions of rental oroerties to condominiums, community
apartments, or stock cooperatives (Sections 66427.1, 66I.3, 66452.3, 6642., 6622,
66452.9). Similarly, mobilehome park tenants must receive additional notice befor their
parks are converted to new uses (Section 66427.4).
Th Legislature prohibited the routine waivers of time deadlines for processing subdivisions
and prescribed conditions for hiring private firms to process applications when public
employees are overloaded (Section 66451.1). In certain circumstances, local officials
must increase public notice of pending subdivisions (Section 66451.4). The time limit
for certain planning commissions to act on tentative maps was reduced for 50 to 30 days
(Section 66452.1). The time limit to hold a hearing on a tentative map was reduced for
some cities and counties from 50 to 30 days (Sect-Jon 66452.2). The Legislature clarified
the filing date for final maps (Sections 66457 and 66458). A new law revised the
procedures for county recorders acceptance or rejection of final maos (Section 66477.2).
The method of rescinding rejections of offers to dedicate certain subdivision improvements
was clarified (Section 6677.2). And finally, the Legislature reduced the statute of
limitatons for challenging subdivision approvals from 180 days to 90 days.
