HomeMy WebLinkAboutV 378; NTN Communications; Variance (V) (3)M COM All U N CATION S, I NC. 2121 Palomar Airport Road, Suite 305 Carlsbad, California 92008 (619) 438-7400 July 3, 1986 Mr. Marty Orenyak City of Carlsbad Building Department 1200 Elm Avenue Carlsbad, CA 92008 Dear Mr. Orenyak: There is attached to this letter a Land Use Planning Application requesting a variance relative to the placement of five satellite antennas on the 3 story office building located at 2121 Palomar Airport Road, Carlsbad, California. This application has been prepared with the assistance of the owner of the property, Graham International, Inc. A letter from the President of that company is also enclosed. Before addressing the application itself, there is one most important matter where your special assistance is earnestly requested. Our company's sole source of revenue and, indeed, our continued existence is dependent upon having these antennas in place and operational prior to the onset of the National Football League schedule. The nature of our business and the use to which these antennas will be put is more fully explained in the body of our application. We very much hope that you can cause this application to be placed on the agenda for the next regularly scheduled Planning Commission meeting which we understand is scheduled for July. If we fail to have approval during July, there will be insufficient time to complete construction and testing which will result in a default of our obligations to customers who have purchased services from our company. We thank you in advance for your assistance in this regard. With respect to the application itself, we have done all within our power to make a complete submission although some of the information seemed superfluous given the nature of this variance request. We have submitted a recent Alta Survey which we believe provides the information requested in Item B, Site Plan. We have, however, submitted only one such survey document rather than the 15 copies called for in the Application form. We will go to the expense of creating additional copies if this requirement cannot be waived 2. In lieu of building elevations and floor plans (Variance Item D) Y we have submitted a 7 page proposal document which provides information more relevant to the nature of the variance we request. The third page of that proposal includes a drawing of the roof of Graham Business Plaza Building I and evidences the proposed movement of the existing screen perimeter so as to shield the dishes from view. The fourth page shows the proposed antenna locations. The fifth page constitutes an elevation demonstrating, at their maximum angle, that less than three feet of antenna will be visible above the screen, As also noted on this page, the antenna will be painted gray or silver to blend into the existing facade of the Graham Business Plaza. The last two pages of the proposal show detail as to the manner in which antenna mount and roof will interface. Again, only one copy of this document is submitted. If 15 copies are required, we will cause them to be duplicated and provided to the City. 3. We request that you waive the requirement that a Public Facility Agreement be executed and submitted. We understand that such an agreement has previously been submitted by Graham International, Inc. relative to the construction of the fourth building in their office complex. We further suggest that the Public Facilities fee, while appropriate as an assessment against the developer of a new structure, may not be necessary given the nature of our request. 4. Variance Item 0, the colored site plan and elevation plan, has not been submitted, as, again, it did not seem appropriate given the nature of our request. If we are in error and you will alert us to this fact, we will do our best to secure such documents from Graham International, Inc. -. Mr. Marty Orenyak July 3, 1986 Page Three To the best of our ability, all other items required have been submitted including a list of all owners and occupants within a 600 foot radius of the structure on which the antennas will be mounted. Again, I must emphasize the critical importance of this construction to our company. We are prepared to visit with you, any staff members or other interested parties in an effort to expedite this matter and would appreciate the courtesy of hearing from you or your deputy in the event any additional information is required and also the courtesy of alerting us as to whether it will be possible to honor our request that we be placed on the July Planning Commission agenda. Because we understand the tenant's business and the critical importance of the satellite antenna to that business, we join in NTN's request that consideration of this application be expedited. We are ir! full support of what NTN wants to do and are convinced that there will be no adverse impact on the other tenants of the Graham Business Plaza or the public at large including contiguous landowners.
