DRnE
The grading activity that recently occurred on the above referenced property is not in accordance
with the approved plan or permit. This is in violation of the City of Carlsbad Grading Ordinance.
In accordance with Section 11.06.230 subsection (b) the City Engineer has elected to file a notice
of grading violation against the property with the County Recorders office (copy attached). This
notice shall remain in effect until such time as the City Engineer determines that the violation no
longer exists.
You are advised to contact myself or a member of my staff as to the remedy for your particular
case. Failure to remedy the violation may result in the declaration of your property to be a public
nuisance pursuant to City code and result in a proceeding for abatement and/or misdemeanor
violation.

The City Engineer has determined that the parcel of real property described below is in
violation of the Carlsbad Municipal Code Chapter 11.06 Excavation and Grading.
