HomeMy WebLinkAboutV 98-01; Nessim Residence; Variance (V) (3)I I October 28, 1997 Mr. Gary Nessim 2987 Highland Dr Carlsbad CA 92008 SUBJECT: PROPOSED IMPROVEMENTS TO 2987 HIGHLAND DRIVE Dear Gary: The City has completed its research of the facts surrounding your proposed development of a three story Victorian-style home at the northwest corner of Highland Drive and Carlsbad Village Drive. Attached is a history of events leading up to the current situation. Based upon this history, there are two approaches to acquiring a building permit. Your first option would be to redesign the proposed single family home to meet the maximum building height and number of stories required by your underlying zoning. Since the zoning of the property is R-l-15,000, the maximum building height is 30 feet to the peak of the roof and the maximum number of stories is two. The redesigned plans could then be approved by the Planning Department during building permit review. Should you wish to process your project through the public hearing process, you may apply for a variance for increased building height. The variance would be heard by the Planning Commission, however staff would not be able to support a variance for increased building height on an unconstrained lot. Should the Planning Commission not approve your variance, their decision could be appealed to the City Council. Thank you for your inquiry regarding the future development of your single family home.
