Dear Gary:
Thank you for the floor plans and building elevations for your most recent proposal to
remodel the existing three-story structure at the northwest comer of Highland Drive and
Carlsbad Village Drive. The submitted plans have been reviewed with respect to the R-
1, Single Family Residential Zone building height requirements.
The maximum building height allowed in an R-1 zone is 30 feet for pitched roofs and 24
feet for flat roofs (less than 3:12 roof pitch). The maximum number of stories is two,
regardless of roof pitch. The Zoning Ordinance defines a story as the space between
the surface of any floor and the surface of the floor next above it. If there is no floor
above it, then the space between such floor and the ceiling next above it shall be
considered a story. Because of this definition, roof decks cannot be covered without
creating a story.
According to your most recent plans, received November 21, 1997, there is a new roof
deck and study area proposed to be added to the existing, non-conforming third floor.
Since both the study and roof deck are covered by a ceiling, they are classified as a
story. This would create a new three-story portion of the building, which is not allowed
in the R-I, Single Family Residential zone.
As previously stated, the Planning Department will continue to review preliminary plans
of your single family home for consistency with the Zoning Ordinance in order to assist
you in meeting the building height requirements. Please feel free to contact me at (760)
