SECTION I. RECOMMENDATION Staff recommends that ZC-195 be approved for the following reasons: 1) General Plan Consistency: The proposed zone change is consistent with the General Plan because the Land Use Element designates the Travel Service category for this area. The change will have no adverse effect on any ele~ent of the G~neral Plan. 2) Environment: The proposed zone change is consistent with the Carlsbad Environmental Protection Ordinance of 1972 because a Negative Declaration has been issued for the following reasons: a) The zone change is mandated by section 65860 of the government code. b) The zone change will not affect the existing environment. 3) Public Facilities: The proposed zone change is consistent with applicable City public facility policies and ordinances because the subject change will not result in any impacts on public facility availability. SECTION II. BACKGROUND· 1. Location and Description of Property: The subject parcels are located on or near the east side of Carlsbad Boulevard between Elm and Walnut. The area is bisected py Oak Avenue and Pine Avenue and is bounded by Lincoln and Garfield Streets on,the East. The zone change area contains 10 parcels, is basically flat, and contains a number of commercial structures (See Exhibit A & B). 2) Existing Zoning: Subject Property: North: South: East: · West: C-2 & R-3 C-2 & R-3 R-3 R-3 R-.3 -1-I 3) Related Cases: The City has been using rezoning to acheive general plan consistency since adoption of the Land Use Element in 1974 (ZC-155, 156, 160, 161, 162, 167, 168, 191 and 194). 4) Environmental Impact Information: A Negative Declaration was ~ssued because the zone change was mandated by Section 65860 of the government code and will have no effect on the existing environment. 5) General Plan Information: ·The proposed zone change would bring zoning of this area into consistency with the General Plan. Most of the area which currently conforms to existing zoning would be conforming in the proposed zone. Non-conforming uses would remain as non-conforming. 6) Travel Service Commercial: The General Plan Land Use Element contains a Travel Service category, a relatively specific land use, intended to serve tourist and the traveling public. Uses would include travel services such as motels, hotels and restaurants. 7) Commercial Tourist Zone: This zone was adopted early in 1977 to 1mplement the Travel Service category of the general plan's Land Use Element. The purpose of this zone is to provide for the development and use of certain types of commercial businesses near transportation centers, recreation areas or in close proximity to highways and freeways used by interregional traffic. Uses allowed in the CT Zone are as follows: 1. Hotels, motels, and restaurants 2. Accessory uses include: Apparel stores, bakeries, beauty or barber shops, dry cleaners, florists, health clubs, novelty stores, stationery stores and travel agencies. 3. By CUP: Service stations bU3 ~rminals, produce stores, commercial recreation facilities, fast food restaurants. 8) Major Planning Considerations: Will the proposed zone change negatively affect the subject~Qr surrounding properties. Several problems exist in the area between Oak and Pine. The first problem lies in the fact that parcels 7, 19 anti the east half of 1:::: > r-~ c: -i > ' 1~ inl 25 (all R-3) contain uses that are the same as on adjacent lots fronting on Carlsbad Blvd., in the C-2 zone. Parcels 7 and 18 contain the same motel running through two legal parcels, one zoned C-2 and one zoned R-3. On parcels 19 and 20, there are a series of low-rent apartments for seniors that run through two parcels, one R-3 and the other c-2. Parcel 19 has no access of its own and is not recognized by the City Engineer as a legal lot and is considered part of parcel 20. The use in this lot is nonconforming in the proposed zone. Parcel 25 contains a similar problem in that it is one parcel and one motel, but half of it is zoned C-.2 and half R-3. Staff feels that both sections "A" and "B" should be rezoned to CTQ. The Z-Overlay Zone should be applied because it is possible in the future that separate development could occur which fronted off Lincoln or Pine. In all probability new commercial development would be oriented to Carlsbad Blvd., but to insure this, the Q Overlay will require S.D.P. approval by the Planning Commission. Land use in these parcels is somewhat corrplex as shown above. Even though there are current! y 8 uses in this area that would be non-conforming in the CT-Zone the majority of .the land area is corrprised of rrotel and other uses corrpatible with the CT Zone. The area labeled Section "B" is currently zoned R-3, but the uses in this section are a con- tinuation of uses in the adjacent C-2 Zone (the rrotel on parcel 18 continues into parcel 7 and the low rent apart:Irents for Senior Citizens on parcel 20 is continued into parcel 19) • The general plan's Travel Service designation would indicate that this area could also be included in the 'Iburist Service Land Use. TENTATIVE RECOMMENDATION: It is recormended that Sections "A" and "B" be rezoned from C-2 to Conmercial 'Iburist (CT) to achieve consistency with the General Plan. BACKGROUND ZC-194 1 195 & 196 are City initiated zone change resulting fran the City Council's recent adoption of ZCA-83 1 a zane code arrendrrent creating the Ccmnercial 'lburist (Cl'). The new zone is intended to provide consistency between the Zoning Ordinance and the Land Use Elerrent of the General Plan which designates a number of locations in the City as Travel Service. These areas will provide for certain types of carrrercial businesses to service transportation centers 1 recreation areas or travellers on highways and freeways used by interregional traffic. The General Plan designates 16 acreas as Travel Service. Staff is requesting that only three of these areas be considered for rezoning at this time. The areas not considered are either in the County 1 less than 3 acres 1 zoned P-c 1 or presently have specific plans which should be reviewed and possibly deleted before rezoning. It is more effective if applicant meets directly with staff; however, written or telephone communication is acceptable. It is the responsibility of the applicant to make the initial contact for such meeting. 2) Submittal: Application will be accepted only if the applica- tion, plans and other pertinent materials are complete. Generally, the date application will be heard will be deter~ mined by the submittal date as indicated within the approved Planning Commission calendar. 3) Planning Commission Calendar: The Planning Commission adopts an-annual calendar that indicates application closing dates, staff review dates, staff report completion dates, and Plan- ning Commission hearing dates. You may acquire this calendar at the Planning Commission Department. 4) Staff Review:· On the date as indicated on the Planning Commission Calendar, City Staff conducts a review meeting on all items on the Planning Commission agenda. The applicant is invited to attend and to explain the project and respond to staff preliminary recommendations. Upon completion of this review, Staff will pre- pare final staff recommendations to be sumbitted to the Planning Commission. The fin~l report with recommendations will be available at the Planning Department five days prior to the Planning Commission hearing (Friday afternoon prior to the Planning Commission meeting date). 5) Hearing: The Planning Commissio~ meets every 2nd and 4th Wednesday of the month at 7:30 p.m. or as indicated on the Planning Commission calendar. Depending on the type of appli- cation, the Planning Commission will either make a finding and forward to City .Council or make final action. 6) Appeals: Final action by Planning Commission may be appealed to the City ·council,· provided such appeal is filed within ten (10) days after the Planning Commission action. The applicant should review with staff the procedure on the various types of applications.· 7) Final Decision: The City will notifY the applicant and property owner of the final decision.
