Zone Change ZC-197 From "OS" to "M"
I have reviewed the County of San Diego's requested zone change and feel several
additional points should be brought to your attention. The zone change request
is for the entire 58 acres contained within the General Plan Amendment now being
processed changing the "OS" (Open Space) to "G" (Government). The current development
proposal however is to use only 21 acres in the southerly part of the parcel for a
refuse shredder. The remaining 37 acres to the north are not committed at this point
and essentially could be used for any industrial use permit in the "M" (Industrial)
zone if approved. A concern of mine of such an action on the part of the City is that
substantial effort has gone into mitigating any effects the proposed shredder would
have on residential areas proposed east of the site. These efforts include noise
standards, screening of the site, landscaping and hours of operation among others.
It is my opinion that these controls should also be applied to the property north
of the proposed shredder. If the property is zoned "M" at this time there would be
no available mechanism in the City Codes to guarantee mitigation of possible effects
the development would have on the residential areas to the east or north.
Several possible solutions to this are available. One action would be not to zone
the property north of the shredder at this time but hold it until an actual
development is suggested and the City is assured that proper mitigation measures
will be applied. Another method would be to zone the project to the P-M zone
(Planned Industrial) which contains within it some development stand~rds. However,
some of the concerns of exposure ofl this area to the residential ar.eas would
still be apparent. A third possibility would be to zone the 37 acres at this
time to "I-1-Q" which would require Planning Commission review of any proposed
development in the area. This would essentially guarantee that the concerns
expressed in the environmental impact report would be properly addressed. It
is also entirely appropriate that the property have the "Q" overlay zone since it is.
within a special treatment area of the General Plan which is one of the designated
applications for the overlay zone.
If the City Council concurs with my concerns on the 37 acres north of the proposed
shredder, it would seem that any of the following actions would be appropriate:
Do not change the current "OS" zone on the 37 acres north of the proposed
shredder at this time.
Change the 37 acres to the ''P-M" zone rather than the "M" zone.
Place a "Q" overlay zone on the 37 acres which will allow Planning Commission
review of any proposed development.
It should be additionally noted that the Planning Commission has clearly indicated that
it is their intent that the City Council make the final determination on the shredder.
They recognize the County's time restraint for the proposed facility and indicated
that the Planning Commission has thoroughly reviewed the matter and has set a list
of conditions that would have been imposed had it been approved. The Planning
Commission will concur with the determination of the City Council.

ACCEPTING APPLICATION FOR COUNTY SOLID
WASTE TRANSFER STATION.
The County Department of Sanitation is preparing applications
for General Plan Amendment, Zone Change and Conditional Use
Permit for a solid waste transfer station. The site of this
station is east of El Camino Real and north of Palomar Airport
Road immediately behind the Carlsbad Municipal Water District
Office. Under paragraph seven of Ordinance 7048, the City
Council may grant exceptions for projects for other agencies
if the project is necessary and in t?e public interest.
The land use and zone changes will allow the transfer station
and future governmental uses such as the City yard. All uses
presently proposed and those anticipated are necessary and in
the public interest.
Recommendation
I recommend that the City Council find that .these applications
from the county are necessary and are in the public interest,
and therefore may be processed.

SUBJECT: Palomar Solid Waste Transfer Station -
Impact on Carlsbad Sewer Facilities
Permit and plan amendment applications are·being prepared for
the Palomar Solid Waste Transfer Station, a County public works
facility. This station will provide for the milling, resource
recovery, compacting; and transfer of municipal solid waste to
County-operated landfills. The operation of the station and
employees will generate approximately 1000 gallons per day of
sewage.
It is our understanding that a sewer moratorium is in effect
in the City of Carlsbad. Until sewer capacity is available,
transfer station sewage will be handled by a septic system.
Because our proposed plant will not impact your sewer system,
I recommend that you authorize acceptance of our permit and
amendment applications.

SECTION I: RECOMMENDATIONS
Zone Change 197: Staff recommends approval of ZC-197 based on the
following findings:
1. The proposed Zone Change is consistent with the General Plan
because:
a. The change would bring the zoning on the property into
conformance with the General Plan Amendment which the
Planning Commission recently recommended for approval.
2. The subject application has complied with the Carlsbad
Environmental Protection Ordinance of 1972 because:
a. An EIR has been prepared by the County and has been
certified by the Board of Supervisors.
b. The Planning Commission has, as a Responsible Agency
under CEQA, considered the certified EIR for the project.
3. The proposed Zone Change is consistent with the applicable
City Public Facilities Policies and Ordinances because:
a. The project complies with the sewer allocation ordinance
which allows capacity for government facilities. The
county is also considering alternative disposal methods.
b. Staff has received assurances from all other affected
agencies that public facilities will be available to
serve the property.

SECTION I I: BACKGROUND
Location and Description of Property:
The site is a 230 acre lot located on the easterly side of El Camino
Real between Sunny Creek Road and Palomar Airport Road. The majority
of the site is in canyon and clear zone for the airport and will
remain zoned 0-S. A 58 acre portion in the southwesterly portion is
relatively flat and is the portion to be rezoned to M. All of the
property is vacant, but the adjacent property to the west, is
developed with industrial buildings and is zoned M.

Past History and Related Cases:
The Planning Commission approved a General Plan Amendment for the
project on August 24, 1977. The City Council will hear this amend-
ment on September 20, 1977. Staff will report City Council action
at the Planning Commission meeting on subject action. A companion
item to this zone change is CUP 140 for a solid waste transfer
station.
Environmental Impact Information:
The County has prepared and certified an EIR for the project. The
County is the 11 Lead Agency 11 for the shredder project (i.e., the
agency responsible for carrying out the project). The City is a
11 Responsible Agency 11 under State law, and must therefore consider
the information contained within the Lead Agency's EIR prior to
taking any action on the project. All mitigation measures which are
Carlsbad's responsibilityrhave been recommended as conditions of
approval to the Conditional Use Permit for the shredder.
General Plan Information:
At the time when the City approved the amended Land Use Element of the
General Plan (October 1974), the County had no intended use for the
subject property. The site is, in fact, a portion of a larger 230
acre parcel which was purchased by the County to provide an instrument
landing system for Palomar Airport. Consequently, the City designated
the airport approach area (58 acres) as G (Governmental Facility) and
designated the remainder of the site (172 acres) as Open Space on the
Land Use Map. The Planning Commission is considering the request that
58 acres of the open space area be designated G to allow for construction
of the solid waste shredder and transfer station and a possible
municipal corporation yard (central location for City police, water,
utilities and maintenance services.}
The property is within the Special Treatment designation for the
Palomar Airport influence area. This special treatment designation
indicates that, in addition to the underlying land use designation,
special consideration should be given to the property due to the noise
and safety impacts of Palomar Airport. The proposed shredder is
compatible with the airport influence. According to the County, CPO
(acting as the Airport Land Use Commission) has reviewed the project
and has found that it conforms to the Palomar Airport Land Use Plan.
The Open Space and Conservation Element of the General Plan shows the
canyon east of the subject site as a part of the City-wide open space
linkage. This area is proposed to remain in open space.
The Parks and Recreation Element indicates a trail system through
the area. A condition of approval of the Conditional Use Permit has
~een suggested to insure the construction of this tract.

The Circulation Element indicates a major E-W street through the
northerly portion of the 230 acre site. A condition of approval of
the Conditional Use Permit requires the dedication of an easement for
future road.
PUBLIC FACILITIES:
This application was accepted because the sewer moratorium ordinance
7048 provides for the acceptance of government facilities. However,
there are no assurances that public sewer facilities will be available
to serve any future uses proposed for the site. Water and other
utilities are available to the site.
The County ordinarily proposed that sewage generated by the use (on
site restrooms only) was to be accommodated by a septic tank system.
Percolation tests conducted by the County have shown that a septic
system is not feasible, however.
The County has presented the alternative of utilizing: 1) chemical
toilets and a sump system for the washdown of equipment and recycling
of water; 2) the cleaning of machinery by seepers and vacuum devices
rather than by a water wash-down method, or 3) other such methods,
such as evapotranspiration, that will avoid discharge of waste water.
MAJOR PLANNING CONSIDERATION:
Is the proposed zone change consistent with the General Plan?
DISCUSSION
The General Plan has been amended to "G" Government for this site.
There is no zone specifically consistent with the "G" category. The
General Plan indicates that government uses can go into any zone where
the use is appropriate. In this industrial area, the appropriate
zone is M and the County proposes an industrial type use. The abutting
property to the north is presently zoned M. The rezone and the pro-
posed uses all appear compatible with the area.

Responding to your request of August 22, 1977, we have the following comments
regarding the subject proceedings:
1. The County of San Diego has been involved for a number of months with the
Water District in the development of the public water system that will serve
the subject property for the construction of the Solid Waste Transfer Station
as well as the proposed City of Carlsbad Corporation Yard. Currently the
Water District is in the final stages of approval of the complete engineering
drawings for the public water system so that there will be a complete loop
from the Beckman Industrial Facility coming southerly to a connection with our
district main line south of the District headquarters.
2. Accordingly, at such time all of the proposed construction is completed, the
Water District will provide public water service to the entire parcel of land.
In addition, however, there may be further requirements for water service as
new uses are made of the county-owned property.
We trust that these comments are of value in your overall appraisal of the subject

the Carlsbad General Plan and a Zone Change plan submitted to the
City of Carlsbad. Also enclosed are pages 26 and 49 from the 1974
Comprehensive Land Use Plan -Palomar Airport with the location of
the transfer station site shown. A draft Environmental Impact Report
(EIR) has been sent by the County Environmental Analysis Division (EAD).
I recommend that you find this project compatible \'lith the land use
plan for Palomar Airport. The Palomar Solid Waste Transfer Station,
a proposed County Public Works Facility, will occupy a 2l~acre site
at the south end of the 58 acres to be rezoned from Open Space to
Manufacturing. This station will provide for the milling, resource
recovery, compacting and transfer of municipal solid waste to County
operated landfills.
The remainder of the 58 acres is a relatively flat area, suitable for
construction of governmental facilities.

Such a Zone Change is warranted because the construction of
the solid waste transfer station will significantly alter the
topography and operat1on requires heavy traffic on toe site.
Such a Zone Change will be in the interest of furtherance
of Public welfare because the project will provide solid waste
processing and transfer at a convenient location for North County
res1dents and enhance present and future resource recovery efforts.
Benet1ts of conven1ence, energy savings, and longer landfill lives will be
realized.
The permitted uses in this proposed reclassification will
not be detrimental .in any way to surrounding properties
because traffic, visual, noise, odor, debris and other adverse impacts
will be mitigated to allowable levels. Normal operation will be consistent
w1th manufacturing uses on adjacent properties. Adjacent Open Space will
be protected from severe impact.
Tn~ property in this application is more suitable for the
proposed zone than the existing zone because topography of
the site is· appropriate for light industrial uses, consistent with
· adjoining zoning and impacts are minimal compared to the operatjons of
Palomar Ajrport.

PROCEDURES
1) Application to Planning Commission: In an effort to aid the
applicant, the Planning Department requests that it b~ given
an opportunity to evaluate and discuss the application in its
various stages of development prior to ~ubmittal. It is more
effective if applicant meets directly with staff; however,
written or telephone communication is acceptable. It is the
responsibility of the a~plicant to make the initial contact
for such meeting.

Submittal: Application will be accepted only if the applica-
tion, plans and other pertinent materials are complete.
Generally, the date application will be heard will be deter-
mtned oy the submittal date as indicated within the approved
~lanning Commission calendar.
Planning Commission Calendar: The Planning Commission adopts
an annual calendar that indicates application closing dates,
staff review dates, staff report completion dates, and PJan-
ning Commission hearing dates. You may acquire this calendar
at the Planning Department.
Staff Review: On the date as indicated on the Planning Commission
Calendar, City Staff conducts a review meeting on all items on
the Planning Commission agenda. The applicant is invited to
attend and to explain the project and respond to staff preliminary
recommendations. Upon completion of this review, Staff will pre-
pare final staff recommendations to be submitted to the Planning
Commission. The final report with recommendations will be
available at the Planning Department five days prior to the
Planning Commission hearing (Friday afternoon prior to the
Planning Commission meeting date).
Hearing: The Planning Commission meets every 2nd and 4th
Wednesday of the month at 7:30 p.m. or as indicated on the
Planning Commission calendar. Depending on the type of appli-
cation, the Planning Commission will either make a finding
and forwarcj to City _Council or make final action.
Appeals: Final action by Planning Commission may be appealed
to the City Counci"l, provided such appeal is filed within ten
(10) days after the Planning Commission action. The applicant
should review with staff the procedure on the various types of
applications.
Final Decision: The City will notify the applicant and property
owner of the final decision.
