These time limits can only be extended by the mutual concurrence of the applicant and the City. By accepting applications for Tentative Maps concurrently with applications for other approvals which are prerequisites to the map; i.e., Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc., the fifty (50) day time limits and the thirty (30) day time limits are often exceeded. '"" ,f ' ' •• Subject: Agua Hedionda Meeting on Wednesday, June 29, 1984 Mike Hoelrmlller & Charlie Grinn did a very good job of presenting cones which would fit into the existing Agua Hedionda Land Dae Flan. Only 6 residents came to protest and were very negative about any and all ronea and or suggestions. Ed Dominguez, the mouth, led the talking with his usual objections, namely traffic and his rights. It appears. that any building- would interfere with his^deas of his personal rights. Also, he showed us on the map where he lives and his residence is app- roximately 1 and % blocks past the intersection of Adams & Hoover Streets, driving East. Mr. Christensen and I presented new facts regarding traffic on Adams. Each one of you has been given a traffic count done by the Traffic department of Carlsbad on 4-18-84 which ahowed approximately 1200 autos (East & West) during a 24 hour period. Also you have been given a copy of the accidents on Adams since 1979. Now, Chinquapin & Harrison inter- section have been widened which will eliminate the problem brought up by Buddy Lewis regarding boat towing. Tamarack is under construction now to be completed through to El Camino Real. This will eliminate some traffic on Adams. Preliminary plans have been approved for Elm Street to be completed through to El Camino Real. When completed, this will also provide an alternate route. Whenever Cannon Road is completed and the Park is available for use, Then boaters will have access to the lagoon and eliminate or ease Adams Street traffic alao. Steve Tisdale says that 5,000 autos per day have to use Adams street before the City will widen the street. Mr. Chick requested a traffic impact *|ydy. I checked into this, however, zoning has to be established in order/anticipate what kinds of traffic could use Adams street. Also, it would cost $$,000 to $6,000 which I do not have. Mike Hoelzmiller also stated that there would have to be over 5,000 cars per day before the street would be widened. Mr. Chuck Pamm. Callfornia Coastal Commission representative stated that the Coastal Committee will consider any future proposals to change the approved Plan however, a plan must be immediately viable, not something several years down the road. Also, it must be proven that the present plan is hazardous to Adams Street Residents. Mr. Banche asked repeatedly what zoning would be acceptable to the resi- dents and received only one answer from Dominquez, possibly low density residential. Mr. Parker has a beautiful artist's rendition of his plan, however, he did not present it because of the n<egative attitude of the 6 residents. How can you go back to the Coastal Commission and say that the whole neighborhood opposes rezoning of our 2 parcels when only 6 showed op? In their petition to the Council on May 1, 1984 residents asked for a IT coning, Why can't this be used as an alternate zone. We would accept this. We were disappointed that no City Council members could attend the meeting. I. RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolution No. 2273, recommending APPROVAL of ZC-303, based on the findings and subject to the conditions contained therein. It is also recommended that the Planning Commission ADOPT Resolution of Intention No. 168. II. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting approval of a zone change from R-l- 15,000 to C-T, Commercial Tourist, for 2.02 acres of property, located as described above. The subject property is within the boundaries of the Agua Hedionda Land Use Plan area. As the Commission may recall, a general plan amendment was approved last year revising several land use designations to conform with the Plan. The area west of Hoover Street, south of Adams Street and Harrison Avenue, was designated RC, Recreation Commercial. Previously, only a portion of this area, the land adjacent to 1-5, was indicated for Recreation Commercial development. The balance of the property was specified for RLM, Residential Low- Medium Density, 0-4 du's/ac. Zoning of the commercially designated properties is currently R-T, Residential Tourist. The properties previously designated residential are zoned R-l- 15,000. The applicant is requesting to bring zoning, for the two subject parcels, into conformance with the Agua Hedionda Land Use Plan and the revised land use designation. Inconsistencies would still exist in this area, however, between the General Plan and zoning. Several parcels, which are not a part of this application, are also zoned R-l-15,000. Additionally, the balance of the property between Hoover Street and 1-5 is currently zoned R-T, not C-T as proposed by the applicant. As will be discussed later in this report, staff believes that the C-T zone is the most appropriate zone to implement the RC land use designation. Staff is including with this package, therefore, a Resolution of Intention to rezone all of the properties south of Adams Street and Harrison Avenue, between Hoover Street and 1-5 to C-T, Commercial Tourist. The proposed rezoning may be processed through two separate actions. The Planning Commission may recommend approval of the applicant's request with Resolution No. 2273 and announce its intention to hold a public hearing to consider rezoning the remaining properties with Resolution of Intention No. 168, or the Planning Commission may continue this hearing so that the whole zone change could be heard simultaneously. The subject parcels/ adjacent to Hoover Street, are currently vacant. Neighboring properties, proposed by the City for rezoning, are occupied by a small marina, water sports rental facility and a residence. III. ANALYSIS Planning Issues 1) Is that proposed zone change consistent with the Land Use Element of the General Plan? 2) Is the proposed zone the most appropriate for the site? 3) Would uses permitted by the proposed zone be compatible with surrounding land uses? Discussion Staff believes that the C-T, Commercial Tourist zone, is the most appropriate zone to implement the Recreation Commercial land use designation of the General Plan and the intent of the Agua Hedionda Land Use Plan. The RC category provides for commercial uses that are primarily recreational in nature. These uses include activities such as boat launching facilities, motels and restaurants. These uses are consistent with those permitted in the C-T zone. The primary difference between the Residential Tourist and Commercial Tourist zones is that the R-T zone permits residential uses while the C-T zone permits only commercial uses, Staff believes that the C-T zone, permitting hotels/motels and restaurants by right, and commercial recreational facilities by conditional use permit, most accurately implements the General Plan and Agua Hedionda Land Use Plan. Staff, therefore, believes that the proposed C-T zone is the most appropriate for the site. The Engineering Department does have concern regarding traffic generated by uses permitted by the RC, underlying land use designation, and the C-T zone. Staff will, however, require a traffic analysis, prior to development, for any future project proposed. This would allow staff the opportunity to review proposed uses and have a basis to condition the project to mitigate potential impacts. -2- Pursuant to the provisions of the Agua Hedionda Land Use Plan, any new development in the plan area is subject to the provisions of the Scenic Preservation Overlay zone. The S-P Overlay Zone requires approval of a Special Use Permit. The Special Use Permit process provides for Planning Commission review including site design, building relationships, special setbacks and landscaping. Staff believes that the provisions of the Agua Hedionda land use plan and the Special Use Permit process will provide for adequate future review and compatibility of land uses. However, in anticipation of the City obtaining coastal permit authority in this area, staff would recommend that the Q- Overlay Zone be placed on the property which would eventually supercede the Special Use Permit. Overall, staff believes that the proposed C-T zone is consistent with the General Plan and the Agua Hedionda Land Use Plan; is the most appropriate zone for the property and that the special use permit process will allow adequate review to ensure high quality development and compatibility of land uses. Staff, therefore, recommends that the Planning Commission recommend approval of ZC-303 and adopt the Resolution of Intention to hold a public hearing to consider rezoning of the entire area south of Adams Street and Harrison Street, between Hoover Street and I- 5. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that the environmental impacts of this project have been already considered in conjunction with another project and previously certified environmental documents and, therefore, issued a Notice of Prior Environmental Compliance on March 28, 1984.
