Description/Explanation: The city's Development Impact Fee Deferral program contains a provision that limits the program to a two year time frame, which sunsets on March 1, 2015. The purpose of the proposed Zone Code Amendment is to eliminate the two year time frame limitation and make the program permanent. The ZCA proposes to amend Sections 21.85.195 and 21.90.195 of the zoning ordinance (Title 21). The project also includes a Municipal Code Amendment to make similar changes to Titles 13,15,18, and 20. Other minor changes are proposed to the program. This ordinance allowed for the deferral of the specified fees to final inspection from the building division as opposed to paying them at building permit issuance or final map recordation. The ordinance became effective March 1, 2013 for a period of two years and will expire on March 1, 2015. Through 2014, we have issued 289 qualifying residential building permits and 47 qualifying commercial/industrial building permits. Ofthe 336 qualifying building permits issued, we have deferred fees on 13 residential building permits and 15 commercial/industrial building permits. The total amount of the fees deferred is $2,250,720, and the average length of time for the deferral has been 158 days. Implementation of the program was initially impeded by the city's antiquated permitting system, but staff has been able to create a systematic approach for administration, documentation and collection ofthe deferred fees. The implementation ofthe Integrated Community Development System (ICDS) will streamline the administration of the fee deferral program, should it be extended. Without action by the council. Ordinance No. CS-200 will expire and any new submittals received after March 2, 2015 will not have the option to defer any fees. The situation will return to all impact fees being due at map recordation or building permit issuance. For action to be taken to extend the program without interruption, staff would need direction by mid-January to allow time to prepare the ordinance and agenda bill and schedule it for action by Planning Commission and City Council.
