Background On July 24, 2018, City Councjl accepted bids and approved award of the Project to PAL General Engineering, Inc. (PAL) in an amount not to exceed $2,177,318. The Project included pavement overlay on La Costa Avenue between El Camino Real and Camino de los Coches, and a small residential area that includes Viejo Castilla Way, Navarra Drive and Pirineos Way (see Attachment A). Discussion Rubberized asphalt concrete consists of asphalt, aggregate and a rubber/oil binder. After award of the contract, it was discovered that the rubber/oil binder specified in the contract was no longer commercially available in California because the primary refinery discontinued making the material. The product is available in Texas but the refinery is unable to sell to California due to patent issues. Moving forward, a polymer-modified asphalt concrete will be specified which will have similar characteristics compared to rubberized asphalt. Due to this recent change in material availability, staff will amend the contract specifications to allow for use of a polymer-modified asphalt concrete, or equivalent, and resolicit the contract. Approximately $100,000 of construction work was completed in the contract with PAL, which will be closed out prior to termination of their contract.
