The following is information for City Council regarding building, permitting and unified school districts. Background The Division of the State Architect's (DSA) regulates the permits, building plan check, and inspections for public schools K-12, con:imunity colleges and essential service buildings within the State of California. The DSA acts as the building department for public schools in California. The City of Carlsbad does not have any authority for building plan check, permit issuance or inspection services for school capital improvement projects. Discussion Although the city has no authority over the proposed project on the school property, staff completed some research to provide additional information on the proposed solar project for the City Council. In a report to the Carlsbad Unified School District Board of Trustees Meeting on Feb. 27, 2019, public feedback was provided to the Board on the 2018 Facility Master Plan Phase 1 Projects: Magnolia Elementary Modernization. The following feedback was reported specific to the proposed solar panel installation: • Neighborhood Petition (50 signatories) -do not install solar carports in front of the school. • Key takeaways -Keep solar in the back of the campus • Next steps -evaluate solar generation capability per Investment Grade Audit Attached is information from Carlsbad Unified School District on the proposed modernization project at Magnolia School, which includes the installation of solar as well as a number of additional improvements. The feedback report does indicate that plans will be revised to reflect staff and community input. Further information regarding plans or permits for solar panels or the other proposed improvements at Magnolia Elementary School can be obtained from the Carlsbad Unified School District directly. "Preconstruction Services Agreement for the Project between the Carlsbad Unified School District and Contractor." 2. The following Agreements are approved in substantially the draft form now existing: a. "Site Lease between the Carlsbad Unified School District and Contractor," incorporated herein by reference. b. "Sublease Agreement between the Carlsbad Unified School District and Contractor" incorporated herein by reference. c. "Construction Services Agreement for the Project between the Carlsbad Unified School District and Contractor" incorporated herein by reference. 3. Pursuant to Education Code section 35161, authority is expressly delegated to the Superintendent or his/her designee to finalize and execute said Agreements in subs~tially the draft form now existing for a Preliminary Guaranteed Maximum Price of $14.2 million, subject to such additions thereto or modifications thereto as the Superintendent may deem in the best interest of the District following review by and consultation with legal counsel to the District. 4.
