Carlsbad Memo ID# 2019151 This memorandum provides an update on the emergency repair of a concrete channel drainage facility adjacent to Kelly Drive. The information below describes the most recent actions on the emergency repair work. In addition, a brief summary is provided defining required follow-up actions and future monitoring tasks. Background . Kelly Channei'extends from El Camino Real to Park Drive (approximately 2,100 feet) and has undergone three emergency repairs since 2010. Each repair has occurred in different locations along the facility, all of which required enrollment in the United States Army Corps of Engineers (USACE) Regional General Permit. On Dec. 5, 2019, staff circulated a Council Memorandum to provide information regarding the damage Kelly channel had experienced from storm events occurring between Nov. 20 and 21, 2019. On Dec. 9, 2019, the USACE issued a Regional General Permit No. 63 (RGP 63} for Repair and Protection Activities inEmergency Situations (Permit) to the city authorizing the repair plan that was proposed with the Nov. 27, 2019 permit application. On Dec. 10, 2019, a Clean Water Act Section 401 Water Quality Certification was received from the San Diego Regional Water Quality Control Board (San Diego Water Board). A Coastal Zone Consistency Determination was issued by the city's Planning Department on the same day. · On Nov. 27, 2019, staff also submitted an emergency notification to the California Department of Fish and Wildlife (CDFW). CDFW has 30 days to respond to the notification through ·issuance of a retroactive permit. However, if no correspondence is received from CDFW,. then the.work is covered under operational law and no further action is required with CDFW. The agency ruled the 2018 Kelly Channel Emergency Repair Project as operation law, and the same ruling is expected with this year's repair. On Dec. 16, 2019, a minor public works contract was fully executed with Planes, Boats and Automobiles, Limited (PBA) in an amount not to exceed $59,590. Staff issued a Notice to Proceed on the same day. Professional Services Agreements were also formalized with LSA Public Works Branch Faraday Center 1635 Faraday Avenue · 1 Carlsbad, CA 92008 I 760-602-2730 Honorable Mayor Hall and Members of the City Council - Dec.24,2019 Page 2 Consultants to conduct biological and archeological resource monitoring per the conditions of the Permit. The most recent repairs to the channel were completed between Dec. 13, 2019 and Dec. 19, 2019. On Dec. 13, 2019, Stormwater Best Management Practices (BMPs) were installed and the dewatering of the void in the concrete-lined channel occurred on Dec 16, 2019. Dewatering and additional site preparations occurred leading up to Dec. 18, 2019 and prior to the concrete slurry placement. Approximately48 cubic yards of concrete slurry was used to fill the void and stabilize the concrete channel lining. Biological and archeological monitors were onsite throughout the repair activities to confirm conformance with the Permit. On Dec. 19, 2019, repair activities including site clean-up were completed. Next Steps Per the conditions of the Permit, a written report of activities is required to be submitted to the USACE and San Diego Water Board by Feb 1, 2020. The city will be released of all Permit obligations upon acceptance of the report and a Notice of Termination will then be issued to · the city. Compensatory mitigation is not required as the repair was limited to the concrete lining and did not result in habitat adverse impacts. A Capital Improvement Program (CIP) project to reconstruct the channel in its entirety was included in the fiscal year 2019-20 CIP budget. Extensive technical studies to support the design and environmental approvals are expected to prolong procurement of the project. As a result, emergency or localized repairs may be required in the interim c;lue to future storm events.
