Where two or more candidates for the same office are to be elected, stamp a cross (+) after the names of all the candidates for that office for whom you desire to vote, not to exceed, however, the number of candidates who are to be elected. To vote for a person not on the ballot, write the name of such person under the title of the office in the blank space left for that purpose. To vote on any measure, stamp a cross (+) in the voting square after the word "Yes'' or after the word "No." All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, retum it to the inspector of election and obtain another. GREEK MEASURE SUBMITTED TO VOTE OF VOTERS PROPOSITION A — CONTRACT AMENDMENT: Shall the City Council be authorized tc amend the Agreement of Purchase be- tween the City of Carlsbad and the Carlsbad Mutual Water Com- pany (Dated August 30, 1957 and approved by the voters of the City December 17, 1957 and on file in the office of the City Clerk) by striking therefrom the provision requiring litigation, to wit: "(c) The power of the City and of the Mutual, respec- tively, to enter into, and carry out the terms of, this agreement has been estab- lished by decree *of a court of competent jurisdic- tion"? Yes No ARGUMENT FOR CITY MEASURE The following argument for the city measure to be submitted at the general municipal election to be held in the City of Carlsbad on April 8, 1958, has been filed with the City Clerk pursuant to Article 4, Chapter 3, Division 4 (Sections 1820 to 1824, inclusive) of the Elections Code of the State of Califor- nia : ARGUMENT IN FAVOR OF THE PROPOSITION TO AMEND THE CONTRACT OF THE CITY TO BUY THE CARLSBAD MUTUAL WATER COMPANY The undersigned members of the City Council of the City of Carlsbad urge all citizens to vote "YES" on the proposition to make unnecessary the test suit, as now required by the contract between the City and the Mutual Water'SCompany. The purpose of requiring the suit was to test the validity of the contract and proceedings preliminary to the City's purchase of the Water Company, in order that the bonds approved last December 17th would be more saleable. Our bond Attorneys now inform us that the suit is not necessary; the bonds can be legally issued and sold immediately without going through with the suit. The advantages of voting "YES" on this proposal, thereby making the suit unnecessary are: (1) The bonds can be sold sooner, thus making possible quicker payments to shareholders; (2) The contract of purchase can be put into effect sooner, thus providing a unified water sys- tem for the City of Carlsbad; and (3) The cost of the suit (estimated at $7,500) will be saved by the City.
