CIAL MUNICIPAL ELEC-
TION TO BE HELD IN
SAID CITY ON TUESDAY,
JULY 28, 1959, FOR THE

HEREBY RESOLVE, DETER-
MINE AND ORDER as follows:
Section 1. That a special elec::ion be held and the same is
hereby called to be held in theHity of Carlsbad, California, on
Tuesday, the 28th day of July,
1959, for the purpose of submit-
ting to the qualified voters of
said city the proposition of is-
suing water,,revenue bonds pur-
suant to the Revenue Bond Lawof 1941 (Chapter 6, Part ,1, Divi-
sion 2, Title 5 of the Govern-
ment Code of the State of Cali-
fornia) in the amount and for
the objects and purposes here<
inafter set forth, including all
expenses _incidental thereto or
connected'therewith.
Section 2. That the purpose
for 'which said bonded indebted
ness is to be incurred and reve-
nue bonds issued therefor is as
follows:The acquisition, construe
tion and financing of exten-
sions, enlargements and im-
provements of the water sy-
stem of the City of Carlsbad,
including works and facilities
for the storage, transmission
and distribution of water, the
reconstruction of parts of said
system, and the acquisition ofland, easements, rights ofway and other property neces-
sary therefor, and including
all engineering, inspection and
legal fees, costs of the issu-
ance ol said revenue bonds,
bond reserve funds, and other
costs and expenses incidental
to or connected with such ac-
quisition, construction and fi- j
nancing. ;
Section 3. That the estimated i
cost of such acquisition, con-'
struction and financing is$300,000. That the principal a-j
mount of the bonds proposed to'
be issued is $300,000. That the
maximum rate of interest to be
paid on said bonds shall not ex-
ceed the maximum rate permit-
ted by law, to wit, six per cent
per annum, payable annually
for the first year and semi-
annually thereafter, the actual
rate or rates of interest on said
bonds to be determined at or
prior to the time of the sale or
sales thereof.
Section 4. That il the pro-
position for the incurring of
bonded indebtedness so submit
ted receives the requisite num-
ber of votes, to wit, the votes
of a majority of all the voters
voting on the proposition, reve-
nue bonds as provided herein in
not exceeding the principal a-
mount stated in such proposi-
tion shall be issued and sold forthe purpose set forth herein.Said bonds are to be revenue
bonds payable exclusively
from the revenues of the enter-
prise'and are not to be secured
by the taxing power of the City
of Carlsbad.
Section 5. That the enterprise
referred to herein is defined to
be the entire water system of
the City of Carlsbad including
all improvements and exten-
sions later constructed -or ac-

Section-6. That the polls for
said election shall be opened atseven o'clock A.M,J.,of the day
of said election and shall re-
main open continuously from
said time'-until sevefl o'clock
P.M., of the same day, when
said polls shall be closed, except
as provided in Section 5734 of
the Elections Code of *the~ State
of California.
Section 7. That on the ballots
to be used at said special selec-
tion, in addition to any other
matter required by law, there
shall be printed substantially

Section 10. That the special
election hereby called shall be

dated with the special municipal
election to be held in said city
on Tuesday, the 28th day of
July, 1959, and such elections
shall be held in all respects as
if there were only one election,
and only one form of ballot shall
