I96....5... namely on the following dates: OKDINANCE NO. 1095 AN OBpiNANCE OF THE CITY OF CARLSBAD. CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICK OF A SPECIAL ELECTION TO BE HELD IN SAID CITY ON JANUARY 18. 1966, FOR THE PURPOSE OF SUB- MITTING TO THE QUALI- FIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED IN- DEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT WHEREAS, at a meeting held prior to the meeting at which this ordinance is adopted the City Council, by a vote of at least two-thirds of the members thereof, adopted a resolution determining that the public interest and neces- sity demand the acquisition and construction of a certain municipal improvement, and making findings relating thereto; NOW, THEREFORE, the City Council of the City of Carlsbad, California, DOES ORDAIN as follows: Section 1. Section 3. That the esti- mated cost of the municipal improvement described in said ballot proposition is the sum of. $295,000.00. The esti- mated cost of said municipal improvement includes the fol- lowing: (a) legal or other lees incidental 1» or connected with the authorization, is- suance and sale of the bonds, and (b) the costs of printing the bonds and other costs and expenses incidental to or con- nected with the authorization, issuaiice and sale ol the bonds. Section 8. That the maxi- mum rate of interest to be paid on said indebtedness shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) por annum, the actual rate or rates of inter- est on said bonds to be deter- mined at or prior to the time of the sale or sales thereof. Said interest shall be payable semiannually except that in- terest for the first year may be made payable at the end of said year. Section 4. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and sliaU remain open continuously from said time until • 7:00- o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of Califor- nia. Section 5. That on the bal- lots to be used at said spe- cial election, in addition to any other matters required by law, there shall be printed substantially the following; MARK CROSS ( + ) ON BAL- LOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED.. WITH PEN AND INK OR PENCIL.) INSTRUCTIONS TO VOTERS To Vote on any measure, stamp a Crqss ( + ) in the vot- ing Square after the word "YES" or after the word "NO." All marks except the cross ( + ) are forbidden. All distinguishing marks or era- sures are forbidden and make the ballot void. If you wrongly stamp, tear or deface his ballot, rieturn it to the inspector of election and obtain another. On absent voter ballots mark a croSs (+) with pen or pen- cil. BOND PROPOSI- TION: Shall the City of Carlsbad incur ' a bonded indebtedness in the principal a- mount of $295,000 for the purpose of the acquistion and construction by said city of a cer- tain municipal im- provement, to wit: the construction of a ibuilding to house the munici- pal library of said city and the ac- quisition of all furniture, furnish- ings, fixtures and equipment neces- sary for said li- brary building? YES NO Secfion 6. That a cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the propo- sition. That if the propo- sition lor the incurring of bonded indebtedness so sub- mitted receives the requisite number of votes, to wit; two- thirds of the votes of the qual- ified electors voting on said proposition, bonds of said city, in not exceeding the principal amount stated in such proposition, may be is- sued and sold for the object and purpose set forth in said proposition. Section 8. That for the pur- pose of holding said election there are hereby establislied five (5) consolidated voting precincts designated as here- inafter stated and eacli con- sisting of the regular election precincts in said city of the numbers hereinafter stated, as said regular election pre- cincts have been establisiied by the Board of Supervisors of San Diego County for the purpose of holding state and county elections and exist on the date this ordinance is adopted. The polling places for the respective voting pre- cints shall be the places hereinafter designated, and the persons hereinafter named, being competent and qualified electors and resi- dents of said city and of their resjjt.^^- are hereby appointed officers of election for their respec- tive voting precincts and they shall hold said election and make return thereof in the manner provided by law.
