I96..8...., namely on the followinq dates: ••••' • ftlBOktfnWMO. 1545 • ' AIttMJOTW Or TflECTTY OF CARLSBAD, CAUgQRtQItORDERING, CALLING, PROVIDING FOR AND GFpIr NOTICE OF A SPECIAL ELECTION TO BE HELD INSAID CITY ON NOVEMBER 5, 1968, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION OF ISSUANCE OF WATER REVENUE BONDS AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE. NOW, THEREFORE, The City Council of the City of Carlsbad, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER: as follows: Section 1. That pursuant to the provisions of the Revenue Bond Law of 1941, Chapter 6, Division 2, Title 5 (commencing at Section 54300 of the Government Code of the State of California} a special election be heldand the same is hereby called to be held in said city on November 5,1968, for the purpose of submitting to the qualified voters of said city the proposition hereinafter set forth of issuing revenue bonds of said city in the principal amount stated in the ballot proposition hereinafter set forth, and for the object and purpose set forth in this resolution and , in said ballot proposition. Section 2. That the estimated cost of the acquisition, con- struction, improvement and financing described in said ballot proposition is the sum of $1,800,000. The principal amount of revenue bonds to be issued is $1,800,000. Section 3. That the maximum rate of interest to be paid on said revenue bonds shall not exceed the maximum rate per- mitted by law, to wit, six per cent (6%) per annum, payable annually or semi-annually, the actual rate or rates of interest on said bonds, to be determined at or prior to the time of the sale or sales thereof. Section 4. That the bonds to be authorized are revenue bonds, payable exclusively from the revenues of the enterprise and are not secured by the taxing power of the city. Section 5. The enterprise herein referred to is the entire water system of the City of Carlsbad, including all improve- ments and extensions later constructed or acquired. Section 6. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until eight o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California. Section 7. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) Principal Clerk INSTRUCTION TO VOTERS To vote on any measure, stamp a cross (+) in the voting square alter the word "YES" or after the word "NO". All marks extent the cross (•+•) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. ! On absent voter ballots mark a cross (f) with pen or pencil. WATER REVENUE BOND PROPOSITION: Shall the City i of Carlsbad issue water revenue bonds in the principal ; sum of $1,800,000 for the acquisition, construction and financing of extensions, enlargements and improve- ments of the water system of said city, including works YES and facilities for the storage, transmission and dis- tribution of water, the reconstruction of parts of said system, and the acquisition of land, easements, rights of way and other property necessary therefor, and in- cluding all engineering, inspection and legal fees, costs of the issuance of said revenue bonds, bond reserve NO _funds, and other costs and expenses incidental to or 'connected with such acquisition, construction and financing? Section 8. That a cross (4) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section ~9. That if the proposition receives the requisite number of votes, to wit, a majority of the votes of the qualified electors voting on said proposition, revenue bonds of said city, in not exceeding the principal amount stated in such proposition, may be issued and sold for the object and purpose set forth in said proposition. Section 10. That the special election hereby called for the date hereinbefore specified shall be and is hereby ordered consolidated with the statewide general election to be held on said date, and within said city the precincts, polling places and officers of election for the special municipal election hereby called shall be the same as those provided for said statewide general election, and said Board of Supervisors is hereby authorized to canvass the returns of said special municipal election, and said elections shall be held in all respects as 31 there were only one election, and only one form of ballot, namely, the ballots used at said statewide general election, shall be used. Said Board of Supervisors shall certify the results of the can- vass of the returns of said special municipal election to the City Council of said city which'shall thereafter declare the results thereof. A proposition submitted by mis resolution shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as pro- vided in Section 10231 of the Elections Code. Section 11. That except as otherwise provided in this resolu- tion, the election called hereby shall be conducted as provided by law for other municipal elections in said city. Section 12. That the City Clerk shall cause this resolution to be published once a week for two (2) succeeding weeks in the CARLSBAD JOURNAL, a newspaper of general circulation in the city published less than six (6) days a week. No other notice of such election need be given. Section 13. This resolution shall take effect upon its adoption. ADOPTED, SIGNED AND APPROVED this 20th day of August. 1968.. /s/D.M.
