TITLE: Ordinance Restricting. the Rate of Construction of Resi-' dential Dwelling Units In the Cityof Carlsbad During a Ten-Year Period Commencing January 1,i!987. »i Notice Is Hereby Given of the in-tention of the persons whose names1 appear hereon of their intention tocirculate the Petition within theCity of Carlsbad for the purpose ofcollecting sufficient signatures toqualify an initiative restricting therate of construction of residential A statement of the reasons of the proposed action as contemplated in the Petition is as follows: The City of Carlsbad is ex- periencing intense residential de-velopment which is adversely affecting the capacity of schools to accommodate students, the capac- ity of city streets and local freeway systems to meet traffic needs, thesemi-rural character of the commu-nity and the quality of life preva-lent in Carlsbad. The People of Carlsbad are verymuch concerned about the City'srapid growth. It is their intentthrough this ordinance to obtain a1 lower rate of residential develop- ment: to permit effective advance planning and establishment of adequate municipal services such 'as schools, streets, parks, water,sewage, police and fire protection, and other customary services; to provide for a desirable amount of open space; to ensure availability of housing fof a broad spectrum of population; and to prevent the de- terioration of the quality of life prevalent in Carlsbad. Therefore, the City shall give priority to the construction of resi* dential dwelling units as described below which have the least adverse impact upon the public facilitiesand services as well as the qualityof life prevalent in Carlsbad as de-scribed above. Commencing January 1, 1987 andcontinuing through the year 1998,the City of Carlsbad shall not allowthe start of construction of morethan 1,000 residential dwellingunits in 1987, 750 residential dwell-ing units in 1988, and 500 resi-dential dwelling units each yearthereafter through 1996, with thefollowing exceptions:1. Projects replacing damaged or destroyed dwellings on a one-for-one basis. 2. Remodeling or additions to ex- isting dwellings which do not result in an increase in the number ofdwelling units.3. Dwelling units of any low-income or senior citizen projectsfunded or subsidized pursuant to the provisions of applicable feder-al or state law. This ordinance shall expire on January 1, 1997. However, the City shall resubmit this ordinance to the voters of Carlsbad in the generalelection of November 1996 to ascer-tain whether they desire this ordi-nance to continue for an additionalfive years to January 1, 2001 at anauthorized level not to exceed 500 residential dwelling units peryear. The City of Carlsbad shall vigor- ously defend any challenge to the validity or constitutionality of this ordinance inasmuch as this ordi- nance represents the desires of a majority of the voters of Carlsbad.If any portion of this ordinance is held or found to be invalid or un-constitutional by a Court of compe-tent jurisdiction, such decision shall not affect the remaining pro-*isi»ns of this ordinance.Dated: January 11, I** A.J.SKOTNICKINELSON W.
