PCF1VED 20 September 2000 Sherri Howard City of Carlsbad Public Works-Engineering 1635 Faraday Avenue Carlsbad, CA 92008-7314 SEP 2 52000 ENGINEERING DEPARTMENT Subject: Least Bell's Vireo Monitoring Summary, Macario Canyon, Carlsbad, California Dear Sherri: As part of the City of Carlsbad agreement with the U.S. Fish and Wildlife Service for construction of Cannon Road Bridge over Macario Canyon in Carlsbad, San Diego County, California, monitoring of least Bell's vireo (Vireo belliipusillus, LBV) was necessary during any construction activity prior to September 15. The September date was set to ensure avoidance of impacts to endangered LBV while on their breeding grounds. In early August the City requested Varanus Biological Services to make recommendations for allowing construction to begin before September 15 because the City wished to completing construction work on the Bridge m a timely manner to avoid-delays and'set-backs resulting from seasonal rains.Värânus uitlymonitor vireos in the canyon as part of the wetland mitigation requirements for the project. Based on Varanus' monitoring reports that Macario LBV had completed their breeding season Varanus made the following recommendations for limits to construction that w&re accepted by the U.S. Fish and Wildlife Service." Noise Monitoring: Conduct noise monitoring in the LBV use areas located south of the Cannon Road Bridge. Biological Monitoring: Monitor impacts of construction activity on LBV using the following protocols: Monitoring commenced one half-hour prior to construction activity each day. Monitoring continued for a period of no more than 4 hours per day for a period of one week at which time it would be determined whether further monitoring was needed. 3. Restricted Access: Construction traffic would remain out of the main road corridor through the canyon (that is, the dirt access road along the bottom of the canyon) until after the vireo were believed to have migrated from the area. Based on these approved protocols early construction began on 28 August in conjunction with daily least Bell's vireo monitoring by Varanus This daily monitoring supplemented the weekly monitoring throughout the LBV breeding season already being conducted by Varanus Results Varanus 'monitored the construction area and the surroundmg vireo habitat during the first week of construction at the bridge-'During this week of August 28 to September 1 we monitored for ENDANGERED SPECIES RESEARCH BIOLOGICAL ASSESSMENT I CONSTRUCTION MONITORING 7950 SILVERTON AVE., SUITE 1161 SAN DIEGO, CA 92126 PH: 858-536-8762 FAX: 858-536-8781 E-MAIL: thevaranids@earthlink.net about 4.5 hours daily, including one half-hour before initiation of construction activities and four hours during actual construction. We attempted to locate vireos as we have done throughout the mitigation project monitoring period, by passive visual and/or aural detection. We monitored construction equipment noise was monitored by the use of a sound level meter (Radio Shack cat.no. 33-2050). Construction activity began at 0700 each morning. The bridge contractor began by removing the submerged telephone poles used as form supports for bridge construction and then removed soils used to stabilize the bridge pillars during their installation. He used an excavator and a bulldozer to complete these tasks. The bulldozer operator also cleared the slopes in the bridge construction area of all vegetation (principally emergent exotic invasive species) and compacted it. Finally, workers sandblasted the concrete pillars of surface blemishes that appear after the concrete hardens. An earthmover was brought in to smooth the soil out for easier maneuvering within the site for all vehicles. All of construction vehicles were used on a daily basis throughout the week of site monitoring. Results Monitoring ceased after the first week of monitoring because least Bell's vireo were not detected in the vicinity of the Bridge for the entire week and the noise levels and construction activity were believed to have no impact on any LBV in the vicinity of the Bridge. Sound levels within the canyon in relation to the vireo habitat were consistently similar all week. Sound level readings taken from the nearby vireo territory adjacent cowbird trap # 1(50 to 150 meters from the bridge) ranged from 50 to 66 decibels. Readings taken from traps 2 and 3 (150 to 300 meters from the bridge) were lower ranging from 50 to 60 decibels. Sound levels measured next to the bridge (within 50 meters of the bridge) ranged from 60 to 76 decibels. We detected no vireos either aurally or visually during the week of monitoring in Macario Canyon. We last detected LBV (a solitary male) during our weekly vireo survey on Friday, August 25. On the weekend of August 26 and 27, a low-pressure system, bringing cloudy conditions and heavy mist moved into the San Diego area. It is possible that the local weather stimulated early LBV departure. We did not detect LBV prior to the initiation of work on Monday morning, August 28. As of the writing of this letter there is no evidence of additional LBV breeding activity this year in Macario Cányon One fledg'e continues to followand feed with an adult male south of the Bridge. Both birds are detectable on adaily basis. The female LBV, though still present in the use area is • generally quiet and secretive., The single' (solitary) male virèo continues to sing in an area that overlaps the use area of the male and fledge however it is more often found feeding south and west of the NMS. . . Request Because of the current breeding status of the LBV in Macario Canyon and the need of the City to 'complete site preparation and planting prior to the advent of the rainy season, we respectfully request that, construction activity, in the vicinity of the Bridge re-coli-imence as soon as possible. Recommendations Because of the endangered status of LBV we strongly. recommend that the City or its 'sub- contractor conduct noise monitoring- and monitoring, in the :LBV Use area 'that is located immediately, south of the Bridge. In accordance with standard mitigation practices, the noise level in the vicinity'of the LBV use area should remain below 60 dB. , • Additionally, we recommend that during the first week of construction activity: a biological monitor knowledgeable in LBV identification and behavior monitor the-impacts' of construction activity, on the adult male and ,fledge that habitually forage in an area south of the Bridge. (Varanus) was asked by the City of Carsibad to perform avian nest monitoring and nest discouragement in approximately 1.0 acres of riparian habitat near the northern extent of Macario Canyon. Monitoring was conducted in advance of brush removal activities associated with construction of bridge abutments for the proposed Cannon Road Bridge. Permission to clear riparian vegetation from the designated area was authorized in accordance with California Department of Fish and Game (CDFG) Streambed Alteration Agreement 5-044-97 and US Fish & Wildlife Service (USFWS) Biological Opinion FW 1-6-97-F-5I, both agreements as amended. Varanus' tasks were to perfbrm the following activities: Conduct nest searches on a daily basis until such time as brush removal activity commenced. Report any incidence of occurrence of least Bell's vireo ( Vireo belliipusillu4, southwestern willow flycatcher (Empidonn traillii extimus) or coastal California gnatcatcher (Polioptila caJifornica californica) to the City, CDFG and USI'WS. Discourage nesting activity. Discouragement was to include: dismantling/removing nest material of any nests (other than nest of Threatened or Endangered species) that were less than or equal to 509/6 completed, make potential nesting cavities inaccessible and place "Bird Scare Tape(g)" in appropriate area of the site. Provide the City, CDFG and USFWS a letter summarizing results of pre-clearing surveys 24 hours prior to commencement of brush clearing activities. Supervise and be on-site during all vegetation clearing activities. All surveys to detect listed species were performed by Ingri S. Quon (PRT-812740). Monitoring of vegetation removal began on 20 March 1998, the first day of vegetation clearing, and continued through 24 March when vegetation clearing and chipping was completed. Commencing 7 March, a minimum of one (1) and up to three (3) biologists walked the site on a daily basis utilizing pre-determined 10-foot wide transects. Each transect was oriented along a roughly east-west axis. All areas of the site were accessible. Establishing these transects enabled close examination of the entire site for nests. Bird observations (both aural and visual), breeding behavior and nesting activity were noted. Avian behavior was also observed from vantage points along both the eastern and western edges of the site, especially from vantage points on adjacent hillsides. When nests were found, they were inspected for age (several nests from the 1997 breeding season were still intact) and degree of completion. Nest discouragement activities were initiated if nests were determined to be less than 50% complete. These activities involved the dismantling and removal of nest materials and the hanging of metallic "bird scare tape" in areas where nesting activity was observed. When nest building was determined to occur in tree cavities, an extendible mirror was used to determine the status of the nest, looking in particular for the presence of eggs or young. When cavities were determined not to harbor eggs or young, nest materials were removed and a combination of rocks and sticks were used to preclude further use. Results Table 1 summarizes the number and species associated with nests along with courtship/ nesting behaviors detected during 7 March - 19 March surveys. Table 2 provides a summary of four-letter codes (a system of shorthand used by birders in the field) to supplement and facilitate interpretation of the information in Table 1. To better understand the potentially breeding species at the Macario Canyon site, Varanus also prepared a table summarizing known breeding dates ("egg dates") for all species detected during monitoring and survey activities. Egg data are presented in Table 3. Of 41 species detected at the site from 7 March through 24 March, 24 are not known to breed during the monitoring time period. Several species known to breed within the monitoring time period are large (e.g. red-tailed hawk, common raven, white-faced ibis) and build conspicuous nests. These would have been detected had they nested in the project area. A majority of the remaining 14 species (western scrub-jay, spotted towhee, California . towhee) have first egg date records from mid- to late March. These dates, however, represent the earliest know dates for nesting/egg laying. The egg date data and observed nest building activity at the Macario site are strongly correlated. We therefore believe our nest search methodology was successfully applied. Timing of the project, particularly in that monitoring and nest discouragement followed several days of severe weather, probably played a major role in facilitating prescribed activities.. Varanus feels that nest monitoring and discouragement in an area of limited acreage can be successful under appropriate conditions. When possible, however, construction activities should be scheduled to. avoid the avian breeding season, a much preferred and recommended methodology.
