Engineers (ACOE) Permit Application No. 97-20130-TCD, City of Carlsbad, California
(1-6-97-F75 1); California Department Fish and Game (CDFG) Section 1601 Streambed
Alteration Agreement No. 5-044-97; CDFG California Incidental Take Permit - Permit
' No. 2081-1998-05-5; and California Coastal Commission (CCC) Coastal Development
Permit No. 6-97-11. According to the project's permit condition,' monthly biological
monitoring reports must be sent to the USFWS, ACOE, CDFG, and CCC
Cannon Road was opened to traffic up to.the Faraday Road intersection in August. On

Activity urder Cannon Road Macario Canjon bridge during October includes slope,
paving, placement of rip rap, removal of working pad under'bridge, removal of
environmental fences, and removal of soil on SDG&E access road Hydroseeding of the
slopes was also completed in October. The area under the bridge and on the access road
was returned to the original wetland grade: All work on Macario Canyon bridge was
completed by November 3, 2000 Planting of the mitigation site for temporary impacts
under the bridge will be completed before the end of the year.
Work on Reach 2 is on hold until further notice

Construction on top of Macario Canyon Bridge was completed. The asphalt paving and
striping were completed and Cannon Road was opened to traffic in Reach 1 to the
• intersection of Faraday. Work under the bridge is on hold until the end of the least Bell's

In Reach 2, finish paving to the first intersection was completed and the signal light on El

Camino Real was turned on. The environmental fence from El Camino Real to the first S
intersection was removed by hand under the supervision of an Ogden biologist. All
remaining work on Reach 2 is on hold until the middle segment is permitted. S • *

(1-6-97-F-Si); California Department Fish and Game (CDFG) Section 1601 Streambed
Alteration Agreement No. 5-044-97; CDFG California Incidental Take Permit - Permit
No. 2081-1998-05-5; and California Coastal Commission (CCC) Coastal Development
Permit No. 6-97-11. According to the project's permit condition, monthly biological
monitoring reports must be sent to the USFWS, ACOE, CDFG, and CCC.
All construction activities in the canyon bottom have been stopped until the least Bell's
vireo completes their nesting season. Work continues on the top of Macario Canyon
Bridge. Pouring of the cement guard rails was completed in May. Noise monitoring
during minor sand blasting activities on the railings on top of the bridge was completed
to ensure that levels remained below 60 dBA Leq. Noise levels remained below 60 dBA
Leq at the edge of the riparian habitat. Cattails along the fringes of the wetland in
Macario Canyon are recolonizing the disturbed areas within the limits of work. The
cattails appear to be very healthy with few if any weeds in these disturbed areas.
In Reach 2, Pacific Bell has begun work to lay their cables along the length of Reach 2.
All Cannon Road construction in Reach 2 is on hold with the exception of landscaping
and weeding along the roadway.

Construction activity during February in Macario Canyon included pouring of the north
bridge span and pre-stressing of the north span. February was a very wet month. The'
silt fences required some maintenance, which was quickly completed by the contractor.
The contractors are also working on putting all of the utilities into the bridge.
In Reach 2, construction on water main east of and adjacent to the El Caminô Real
Bridge and paving of a segment of Reach 2 was completed. In late February, the
sidewalks were poured along the paved segment of Reach 2. The silt fences were

Construction activity began again in Macario Canyon on September 1. Work had been shut
down due to noise restrictions related to least Bell's vireo ( Vireo bellii pusillus), southwestern -
willow flycatcher (Empidonwc traillii extimus), and California gnatcatcher (Polioptila
ca1fornica). USFWS issued a letter to the City on August 31, allowing work to start in Macario
Canyon prior to September 15, the date stated in the Biological Opinion. Work in Macario
Canyon included digging for bridge pier footings, placing shoring, and pile driving. - . '•
Construction in Reach 2 began on September 16, following the end of noise restrictions. Work
in Reach 2 consisted of removing the temporary noise walls and berms, installing underground
utilities, and diverting Agua Hedionda Creek back to its original streambed, which flows under
the new bridge. Ogden biologist Stacey Baczkowski was present on September 24, to observe
the creek diversion and verify that all work was done according to permit and agreement

Bird monitoring concluded on Saturday, September 11. One least Bell's vireo was observed near
the new bridge by El Camino Real on Saturday, September 4. No least Bell's vireo were
detected on the September 11 visit. Ogden's biologist, Rick Bailey, is preparing a summary
report for Reach 2 for the spring and summer of 1999 season. It will be submitted to the City
and agencies under separate cover in the near future.
Construction noise restrictions expired for the year in September and construction noise
monitoring concluded Thursday, September 2. There were no construction noise violations
recorded during the final construction noise monitoring visit. Noise monitoring for next year's
bird breeding season will begin again in March 2000, if needed.
There was one rain storm during September, with about 0.02 inch of rain. No erosion was
observed and all erosion control measures functioned as intended. Ogden will continue to make
periodic biological construction monitoring visits and submit monthly progress reports in

Ogden visited the construction site eleven times during the month of August.
Construction on Cannon Road was shut down in both Reaches 1 and 2 for the entire ,

month of August. The only construction activity was in the Reach .2 right-of-way, 'where
- stockpiled soil associated with construction of Shea Homes adjacent housing project was
•• • removed. Ogden and the acoustical subconsultant, Investigative Science and Engineering,
. monitored the stockpiled soil removal to ensure there were no permit violations. • .

During the month, Ogden also attended a meeting at the CDFG on August 10. In
attendance were Terri Dickerson of CDFG, Terry Deane of ACOE, Hank Gentile of
Simon Wong Engineering, and Mitch Whitson and Jim Gay of Hazard Construction
Company. Julie Vanderweir of USFWS and Sherri Howard of the City of Carlsbad joined
the meeting by phone. We discussed the City's amendment request for Macario Canyon
and why it was beneficial for both the construction schedule and the resources to start
work earlier than the stated September 15 date. An earlier start might allow completion of
the bridge prior to the start of next year's bird breeding season, thus avoiding a delay of
about 6 months. This would permit the temporary impacts mitigation to be implemented
and restored to habitat a full season sooner. There was a general agreement with the
proposed amendment, but no guarantees were made regarding an early start date.
Resolution was reached on the proposed amendment at the end of August.
Least Bell's vireo was still observed occupying the small patch of willows near the El
Camino Real Bridge in Reach 2 at month's end. A clapper rail was sighted near Station
99+00 again this month after not seeing one all summer.
Noise monitoring was done in Reach 2 on days when any construction activity for Shea
Homes took place on the Cannon Road right-of-way. Noise monitoring results showed
that noise levels stayed below the permitted 60 dBA leq limit.

In accordance with the project's permit 'conditions, noise restrictions were in force for
least Bell's vireo ( Vireo bellii pusillus) and southwestern willow flycatcher (Empidonax
traillii extimus). Least Bell's vireos arrived at the site sometime around the middle or
latter part of the April and were first detected in Reach 2 by Ogden's biologist, Rick
Bailey, on April 25. Least Bell's vireos were heard at two location along the right-of-
way at about Stations 99+00 and 108+00. No southwestern willow flycatchers were
detected in the Reach 2 survey area.
Ogden's acoustical consultant, Rick Tavares of Investigative Science and Engineering
(ISE), conducted a noise monitoring field survey to ascertain construction noise levels

within the habitat area due to light grading and ancillary activities in Reach 2. The
acoustical consultant recommended that grading or other operations close to the habitat
boundary utilize equipment with shielded exhaust stacks and that idling of equipment
near habitat should be kept to a minimum.
During the month of April, construction activities associated with the Cannon Road West
Project were primarily concentrated adjacent to El Camino Real at the new bridge site.
Activities and equipment observed at this location were primarily affiliated with the
fabrication of the Cannon Road and El Camino Real bridge supports. Work during April
also included Reach 1 median landscape installation. There was no work performed in
Macario Canyon because of noise restrictions for least Bell's vireo and southwestern
willow flycatcher.
There were approximately 1.65 inches of rain during the month of April, scattered over
six storms. Erosion was minimal and erosion control devices performed as intended,
keeping any sediment within the project work area.

Construction, during January included installing a culvert and nprap dissipater at the El'
Camino Real bridge site to divert the creek so bridge piers can be built, placing surcharge
for the bridge abutment by El Camino Real, placing the second stage surcharge at Macario
Canyon, finishing the excavation that requires paleontological monitoring, attempting to
install a dewatering system in Macario Canyon in Reach 2, and cutting grade and placing
base material in preparation for paving in Reach I. The attempt to install dewatenng wells
in Macario Canyon in preparation for bridge pier construction was unsuccessful and other
options are being attempted because dry clay was encountered approximately five feet
below ground. It appears the Macario Canyon wetland is supported by a-perched water
table at the surface. Steel for pile driving in Macario Canyon arrived at the site towards the
end of the month. . . . • . . -
Work was completed on the slope -associated with the Macario Canyon surcharge fill that
requires paleontological monitoring by ACOE Nationwide 404 Permit Special Condition
No. 24. This slope requires terracing to key it in with the associated surcharge fill. This
work has been done sporadically as other work progresses. The project's paleontologist
found a small lens of fossils on the last day of excavation. The paleontologist collected the

fossils and took them for cleaning, cataloging, and preparation for storage. The
paleontologist will ship the fossils to storage at the San Diego Natural History Museum and
submit her report once her work has been completed.

Construction during November included completing wick drains, installation and asociated
work in the surcharge fill area on the east side of Macario Canyon, from approximately
Station 68+00 to Station 72+50. The contractor began importing soil material for the
surcharge fill from Legoland towards the end of the month. The trucks hauling soil
traveled only on the approved road network. There were no impacts outside the permitted,

and placing temporary fill in the stream bed to permit equipment access. The contractor
divrted the stream and installed a steel culvert to carry water under their crossing. The
sewer bypass is located in an area permitted for permanent wetland impacts and is where
the bridge will be built. This work was done within the provisions of ACOE Nationwide
404 Permit Special Conditions No. 8 and 10 and CDFG 1601 Streambed Alteration
Agreement Conditions No. 15 and 17. There were no impacts outside the permitted work
area.
There was less than one inch of rain during the month of November, scattered over three
different storms. . No erosion has been observed to date from these light rains, and the

agreement No. 5-044-97; CDFG California Iricidental Take Permit - Permit No. 2081-
1998-05-5, and California Coastal Commission (CCC) Coastal Development Permit No. 6-
97-11. According to the project's permit conditions, monthly biological monitoring reports
must be sent to the USFWS, ACOE, CDFG, and CCC.
Construction during December included completing the first phase of the Macario Canyon
surcharge, digging a notch for the pier on the west side of Macario Canyon, clearing
wetlands to begin work on the Macario Canyon bridge, working on the sewer bypass and
starting the surcharge for bridge abutments near El Camino Real, excavating in Reach 2,
and installing underground utilities in Reach 1. -
Ogden observed several permit condition violations on December 10 and the City of
Carlsbad and the contractor took quick corrective action. First, the Macario Canyon
wetland was cleared and work started without notifying the biological monitor to supervise
the work as required by ACOE Nationwide 404 Permit Special Condition No. 6 and CDFG
601 Streambed Alteration Agreement Condition No: 13. The area was cleared according
to the surveyor's staking, and the environmental and silt fences were in.place when .Qgden
discovered that work had begun in this'area on December, 10, , , ..ft••__ ;•.

Agreement Conditions No. 15 and 17. The contractor installed a temporary culvert by the
end of the day, so stream flow was restored after several hours.
In placing temporary fill on December 10 to dam the creek, the contractor placed fill beyond
the project limits of work at about Station 69+50, burying a small section of silt fence and
environmental fence in the process with several yards of soil. This fill was placed in
violation of ACOE Nationwide 404 Permit Special Condition No. 4 and CDFG 1601
Streambed Alteration Agreement Condition No 4. This fill was removed by hand labor by
the end of the day and no vegetation was damaged in the process. The area in question was
under a large willow tree with no understory vegetation present.
Finally, Ogden observed a cement truck from Mar Con cleaning out near the creek at about
Station 122 to 123. This is in violation of ACOE Nationwide 404 Permit Special Condition
No. 21 and CDFG 1601 Streambed Alteration Agreement Conditions No. 29 and 30. The
City of Carlsbad has spoken with the contractor about making arrangements for a formal
clean out area in an appropriate location.
Work continued on the slope associated with the Macario Canyon surcharge fill that
requires paleontological monitoring by ACOE Nationwide 404 Permit Special Condition
No. 24. This slope requires terracing to key it in with the surcharge fill. This work has
been done sporadically as other work progresses. As was the case in November, the
project's paleontologist, Fran Govean of Petra Paleontology, found only trace fossils.
These do not require collecting, just documentation. The paleontologist will submit her
report once her work is completed.

As the biological construction monitor for the City of Carlsbad, Ogden Environmental and
Energy Services Company, Inc. (Ogden) submits this monthly construction, monitoring
report for the Cannon Road West—City Project No. 3184. The project has prmits with
the United States Fish'-and Wildlife Service .(USFV S),.Bioiogical Opinion on Cannon
Road (Reaches land 2), -U.S. ,Army, Corps of Engineers (ACOE) Permit Application No
97-20130-TCD, City of Carlsbad, California (1-6-97-F-SI); California Department of Fish
and Game (CDFG) Section 1601 Streambed Alteration Agreement ,No.. 5-044-97; CDFG
California Incidental Take Permit - Permit No. 2081-1998-05-5, and California Coastal
Commission (CCC) Coastal Development Permit No. 6-97-11. According to the project's
permit conditions, monthly biological monitoring reports must be sent to the USFWS,
ACOE, CDFG, and the CCC. This letter is the first monthly construction monitoring
report, covering the month of September 1998.
Construction work undertaken to date has been concentrated primarily in the surcharge fill
area on the east side of Macario Canyon, from approximately Station 68+00 to Station
72+50. The environmental fence was put in place in this area on the northern and southern
limits of work boundaries. The project surveyors staked the limit of work prior to
vegetation clearing and fence placement. Ogden monitored vegetation clearing and
environmental fence placement in late August. The environmental fence was verified as
complete in this area on Thursday, August 27, 1998. Once that was done, project
construction began. Geotextile fabric was placed on the ground in the surcharge area and
enough fill was placed to create a flat working surface for construction equipment. Since
that time the contractor has been installing geotextile ick, drains..by drilling vertically
through the pad. There have been no impacts outside the permitted work area.4
In September, environmental fence and erosion control fence were 1.also, placed along the
northern side of the alignment for Reach H from approximately Station 97+00 to Station
124+00 at El Camino Real Grading for another development is underway concurrently on
the southern boundary of Reach II, so environmental fence and erosion control measures
are not required on the south side of the alignment in this area. .....
