I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment EXECUTIVE SUMMARY This report presents the findings of a Phase I Environmental Site Assessment (ESA) for the property located at 800 Grand Avenue, Carlsbad, California (Figure 1, Vicinity Map). The subject property is currently developed with three two-story commercial buildings and an asphalt-paved parking lot. Rincon Consultants performed a reconnaissance of the subject property on September 14, 2016. The purpose of the reconnaissance was to observe existing subject property conditions and to obtain information indicating the presence of recognized environmental conditions in connection with the subject property. With the exception of small quantities of paint and typical maintenance supplies observed in the maintenance area to the northwest of Building B, the use, storage or disposal of hazardous materials on the subject property was not observed during the site reconnaissance. The subject property is located in an area that is primarily composed of residential and commercial land uses. Properties in the vicinity of the subject property include single-family homes, multi-family residences, a dentist office, and commercial properties. The current adjacent land uses are described in Table 1 and depicted on Figure 3, Adjacent Land Use Map. Environmental Data Resources, Inc. (EDR) was contracted to provide a database search of public lists of sites that generate, store, treat or dispose of hazardous materials or sites for which a release or incident has occurred. The EDR search was conducted for the subject property and included data from surrounding sites within a specified radius of the property. The subject property and adjacent properties were not listed in any of the databases searched by EDR. Two nearby properties were listed on release databases searched by EDR. However, these properties were located cross gradient of the subject property. Therefore, based on the closed case status, the soils only nature of the release and/ or the location of these release sites cross gradient of the subject property, the properties are not expected to impact the subject property. Historical sources reviewed as part of the Phase I ESA include aerial photographs, topographic maps, and city directories. The photos, maps, and city directories reviewed indicate that the subject property was vacant land from at least 1893 to 1901. By 1939, the subject property was developed with at least one single structure on the northwestern portion of the property. From 1946 to 1967 the subject property was developed with multiple residential structures. Since at least 1979, the subject property has been developed with three commercial structures along the southeastern portion of the subject property and an asphalt-paved parking area on the northwestern portion of the property. In general, the subject property resembles its present-day configuration since at least 1979. City directories indicate that the subject property has been used for commercial purposes since at least 1976, and possibly as early as 1950. City directories also indicate that the subject property was developed with apartments and used for residential purposes since at least 1965. Based on the findings of this Phase I ESA, it is our opinion that no recognized environmental conditions were identified for the subject property. r 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment SIGNIFICANT ASSUMPTIONS, LIMITATIONS, DEVIATIONS, EXCEPTIONS, SPECIAL TERMS, AND CONDITIONS This work is intended to adhere to good commercial, customary, and generally accepted environmental investigation practices for similar investigations conducted at this time and in this geographic area. No guarantee or warranties, expressed or implied are provided. The findings and opinions conveyed in this report are based on findings derived from a site reconnaissance, review of an environmental database report, specified regulatory records and historical sources, and comments made by interviewees. This report is not intended as a comprehensive site characterization and should not be construed as such. Standard data sources relied upon during the completion of Phase I ESAs may vary with regard to accuracy and completeness. Although Rincon believes the data sources are reasonably reliable, Rincon cannot and does not guarantee the authenticity or reliability of the data sources it has used. Additionally, pursuant to our contract, the data sources reviewed included only those that are practically reviewable without the need for extraordinary analysis. Rincon has not found evidence that hazardous materials or petroleum products exist at the subject property at levels likely to warrant mitigation. Rincon does not under any circumstances warrant or guarantee that not finding evidence of hazardous materials or petroleum products means that hazardous materials or petroleum products do not exist on the subject property. Additional research, including surface or subsurface sampling and analysis, can reduce the client's risks, but no techniques commonly employed can eliminate these risks altogether. In addition, pursuant to AS1M E 1527-13 practice, our scope of services did nQt include any inquiries with respect to asbestos containing building materials, biological agents, cultural and historic resources, ecological resources, endangered species, health and safety, indoor air quality unrelated to release of hazardous substances or petroleum products into the environment, industrial hygiene, lead-based paint, lead in drinking water, mold, radon, regulatory compliance, wetlands, or high voltage power lines. USER RELIANCE McKellar McGowan Real Estate Development has requested this assessment and will use the assessment to provide information for the purposes of purchasing or acquiring said property. This Phase I ESA was prepared for use solely and exclusively by McKellar McGowan Real Estate Development. No other use or disclosure is intended or authorized by Rincon. Also, this report is issued with the understanding that it is to be used only in its entirety. It is intended for use only by the client, and no other person or entity may rely upon the report without the express written consent of Rincon. SITE DESCRIPTION Location The subject property is an approximately 1.37-acre property located at 800 Grand Avenue, northwest of the intersection of Grand A venue and Harding Street in Carlsbad, California 4 I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment (Figure 2, Site Map). The property is identified as Assessor's Parcel Numbers (APNs) 203-202-03 and 203-202-18. Subject Property and Vicinity General Characteristics The subject property is currently developed with three commercial buildings with paved parking areas along Grand Avenue and an asphalt-paved parking area on the northwestern portion of the subject property along Home A venue. The subject property is located in an area that is generally used for residential and commercial purposes. Surrounding properties include single-family homes, multi-family residences, a dentist office, and a commercial office center. The current adjacent land uses are described in Table 1 and depicted on Figure 3, Adjacent Land Use Map. a e . Descriptions of Structures, Roads, Other Improvements on the Site During the site reconnaissance, three two-story commercial buildings were observed on the eastern portion of the subject property, along Grand A venue. The buildings are reportedly occupied by 65 total tenants. The remainder of the subject property was developed with an asphalt-paved parking area. Access to the subject property is available via Grand A venue. Electrical and natural gas service is provided by San Diego Gas & Electric. The City of Carlsbad provides water and sewer service. Solid waste disposal is provided by Waste Management. USER PROVIDED INFORMATION As described in AS1M E 1527-13 Section 6, McKellar McGowan Real Estate Development was interviewed for actual knowledge pertaining to the subject property to help identify recognized environmental conditions in connection with the property. Jeff Johnson, Executive Vice President for McKellar McGowan Real Estate Development, completed the User Questionnaire as provided by ASTM Appendix X3, prior to completion of the site reconnaissance. A copy of the completed questionnaire is included as Appendix A. Based on our review of the completed questionnaire, the user is unaware of information regarding the following: • specialized knowledge or experience related to the property or nearby properties • commonly known or reasonably ascertainable information about the property that would help the environmental professional to identify conditions indicative of releases or threatened releases • obvious indicators that point to the presence or likely presence of releases at the property r 5 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment • pending, threatened, or past litigation relevant to hazardous substances or petroleum products, in, on, or from the site • pending, threatened, or past administrative proceedings relevant to hazardous substances or petroleum products in, on, or from the site • notice from any government entity regarding any possible violation of environmental laws or possible liability relating to hazardous substances or petroleum products Based on our review of the completed questionnaire, the user reviewed the following sources of information and is unaware of information regarding the following: • recorded land title records (or judicial records, where appropriate) that identify any environmental liens filed or recorded against the property • recorded land title records (or judicial records, where appropriate) that identify any activity and land use limitations (AULs), such as engineering controls, land use restrictions or institutional controls that are in place at the property and/ or have been filed or recorded against the property under federal, tribal, state or local law • Title Report that identifies information pertaining to environmental cleanup liens or activity and use limitations (AULs) for the subject property Additionally, the user indicated the following information: • The purchase price being paid for the subject property reasonably reflects the fair market value of the property and he is not aware of a reduction in value for the subject property relative to any known environmental issues. • A residential project is planned for the subject property. The following documents regarding the subject property were provided by McKellar McGowan Real Estate Development: • Asbestos Survey, 800 Grand Avenue, Carlsbad, California prepared by JMR Environmental Services, Inc. and dated October 6, 2005 -This report states that asbestos was detected in the following building materials: o Drywall tape and mud (Suites A4, BBC, B13, CU, C14 and Building A Heater Room) o Acoustic ceiling material (Suites A4 and BS) o Floor tile (Suite C12 and Building A Women's Restroom) o Exterior Window Putty (Buildings A and B) o Ceiling Texture (Suite C12) • Lead Paint Investigation, 800 Grand Avenue, Carlsbad, California prepared by JMR Environmental Services, Inc. and dated October 6, 2005 -This report states that lead was detected on the exterior metal flashing and trim of the subject property buildings. In addition, lead glazing was detected on the ceramic wall tiles in the restrooms of units A4 and Bl. • Preliminary Report, 800 Grand Avenue, Carlsbad, CA prepared by First American Title Company and dated May 17, 2016 - A review of this report identified the following easement associated with the subject property: r 6 I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I 'I I I I I 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment o Easement for underground facilities consisting of conduits, manholes, handholes, and junction boxes with above ground structures consisting of pads, transformers and other appurtenance necessary and incidental purposes to SDG&E RECORDS REVIEW PHYSICAL SETTING SOURCES Topography The current USGS topographic map (San Luis Rey, 2012) indicates that the subject property is situated at an elevation of about 65 feet above mean sea level with topography sloping to west southwest. Geology and Hydrogeology Site Geology According to the US Geologic Map (Oceanside Quadrangle, 2007), the subject property is underlain by old paralic deposits, Units 6-7. Regional Groundwater Occurrence and Quality During the preparation of this Phase I ESA, we reviewed the California State Water Resources Control Board's (SWRCBs) online Geotracker database to determine depth to groundwater in the vicinity of the site. According to Case Closure Summary, 920 Carlsbad Village Drive, Carlsbad, California prepared by County of San Diego Department of Environmental Health (DEH) Site Assessment and Mitigation (SAM) and dated April 13, 1998, groundwater was encountered between approximately 10 and 13 feet below ground surface (bgs) and is reported to flow to the southwest. This property is located approximately 400 feet southeast of the subject property. STANDARD ENVIRONMENTAL RECORD SOURCES Environmental Data Resources, Inc. (EDR) was contracted to provide a database search of public lists of sites that generate, store, treat or dispose of hazardous materials or sites for which a release or incident has occurred. The EDR search was conducted for the subject property and included data from surrounding sites within specified radii of the property. A copy of the EDR report, which specifies the ASTM search distance for each public list, is included as Appendix B. As shown on the attached EDR report, federal, state and county lists were reviewed as part of the research effort. Please refer to Appendix B for a complete listing of sites reported by EDR and a description of the databases reviewed. The Map Findings Summary, included in the EDR report, provides a summary of the databases searched, the number of reported facilities within the search radii, and whether the facility is located onsite or adjacent to the subject property. The following information is based on our review of the Map Findings Summary and the information contained in the EDR report. r 7 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment Subject Property The subject property was not listed on any of the regulatory databases reviewed. Offsite Properties Offsite properties listed by EDR fall under two general categories of databases: those reporting unauthorized releases of hazardous substances (e.g., LUST, National Priority List [a.k.a. Superfund sites], and corrective action facilities), and databases of businesses permitted to use hazardous materials or generate hazardous wastes, for which an unauthorized release has not been reported to a regulatory agency. Rincon reviewed the EDR Radius Map and select detailed listings to evaluate their potential to impact the subject property, based on the following factors: • Reported distance of the facility from the subject property • The nature of the database on which the facility is listed, and/ or whether the facility was listed on a database reporting unauthorized releases of hazardous materials, petroleum products, or hazardous wastes • Reported case type (e.g., soil only, failed UST test only) • Reported substance released (e.g., chlorinated solvents, gasoline, metals) • Reported regulatory agency status (e.g., case closed, "no further action") • Location of the facility with respect to the reported groundwater flow direction (discussed in the Geology and Hydrogeology section of this report) Facilities/properties that were interpreted by Rincon to be of potential environmental concern to the subject property, based on one or more of the factors listed above, are summarized in Table 2. In accordance with ASTM, contamination migration pathways in soil, groundwater, and soil vapor were considered in our analysis of offsite properties of potential environmental concern. Orphan Listings EDR reported three orphan or unmapped site listings, which EDR is unable to plot due to insufficient address information. Based on Rincon' s review of the limited address information or site descriptions for the orphan listings, one of the listings, the Carlsbad Bumsite, was identified to be located at Carlsbad Village Drive. Records for the Carlsbad Burnsite were requested from the San Diego County DEH. According to the records, the Carlsbad Bumsite was formerly located near the intersection of Carlsbad Village Drive and Concord Street, which is approximately 1.90 miles east-northeast of the subject property. Therefore, this property is not expected to impact the subject property. ADDITIONAL ENVIRONMENTAL RECORD SOURCES Review of Agency Files As a follow-up to the database search, Rincon reviewed regulatory information for facilities within the specified search radii that were interpreted to have the potential to impact the subject property, based on one or more factors previously discussed (e.g., distance, open case status, up-gradient location, soil vapor migration). The following is a summary of our review of regulatory information obtained from review of online sources (e.g., SWRCB GeoTracker database, DTSC Envirostor database) and/or files requested from the applicable regulatory agency, as described below. Subject Property The subject property was not listed in any of the databases searched by EDR. Adjacent Properties Adjacent properties were not listed in any of the databases searched by EDR. Nearby Release Sites Two nearby properties were listed in databases searched by EDR: • Gasco Service Station #511/Valero/AMPM #511/High Desert Oil Co. Inc located at 920 Carlsbad Village Drive: This property is located approximately 400 feet to the southeast of the subject property and is listed on GeoTracker, as well as the SWEEPS UST, HMMD San Diego, SAN DIEGO CO. SAM, UST, EMI, HIST UST, and LUST databases searched by EDR. The leaking underground storage tank (LUST) database listing is indicative of an unauthorized release at the property. According to the EDR report and GeoTracker, the property experienced a release of gasoline and waste oil to soil and groundwater in March 1994 during tank closure activities. A total of approximately 342 cubic yards of impacted soil were removed from the property and three groundwater monitoring wells were installed. One year of groundwater monitoring reported that human health, human safety, and groundwater quality were not at risk. The case was closed in May 1998. Based on the r 9 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment closed case status, and the reported direction of groundwater flow to the southwest (cross gradient of the subject property), the release from this property is not expected to impact the subject property. • Village 76 Car Waslvf osco Corp #2705723/Unocal Service Station #7 located at 880 Carlsbad Village Drive: This property is located approximately 400 feet to the southeast of the subject property and is listed on GeoTracker, as well as the HMMD San Diego, EMI, LUST, SWEEPS UST, SAN DIEGO CO. SAM, SLIC, HIST CORTESE, and EDR Historical Auto Station databases searched by EDR. The LUST and Spills, Leaks, Investigation and Oeanup (SLIC) database listings are indicative of an unauthorized release at the property. According to the EDR report and Geo Tracker, multiple releases are associated with this property: o Case H12427-001: Both EDR and Geotracker indicate that a release of diesel to soil occurred at this property in October 1985 during tank closure activities. The impacted soil was reportedly excavated and disposed offsite and the case was closed in September 1989. Based on the closed case status and the soils only nature of the release, the former release is not expected to impact the subject property. o Case H12427-002: Both EDR and GeoTracker indicate that a release of gasoline occurred at this property on July 5, 1996; the media impacted was not reported. However, the case was closed on July 20, 1996. Therefore, based on the closed case status and the direction of groundwater flow to the southwest ( cross gradient of the subject property), the former release is not expected to impact the subject property. o Case H12427-003: Both EDR and GeoTracker indicate that a release of diesel and gasoline impacted soil and groundwater at this property in October 2008. Five soil borings were completed and soil and groundwater samples were collected. Concentrations of total petroleum hydrocarbons (lPH) were detected in both soil and groundwater samples. Remediation activities included removal of approximately 535 tons of impacted soil. Five groundwater monitoring wells were subsequently installed and two rounds of groundwater sampling events indicated that no benzene and low concentrations of methyl tertiary butyl ether (MTBE) were detected. Approximately 13 cubic yards of lPH-impacted soil above 100 milligrams per kilogram (mg/kg) were estimated to remain at the property. However, soil and groundwater contamination was reported to not pose a significant threat to human health or the environment. Therefore, based on the closed case status and the reported direction of groundwater flow to the southwest (cross gradient of the subject property), the former release is not expected to impact the subject property. KNOWN OR SUSPECT CONTAMINATED RELEASE SITES WITH POTENTIAL VAPOR MIGRATION The EDR report was reviewed to identify nearby known or suspect contaminated sites that have the potential for contaminated vapor originating from the nearby site to be migrating beneath the subject property. Based on the ASTM E 2600-10, Standard Guide for Vapor Encroachment Screening on Property Involved in Real Estate Transactions, the following minimum search distances were initially used to determine if contaminated soil vapors from a nearby known or suspect contaminated site have the potential to be migrating beneath the subject property: 10 I I I I I I I I I I I I I I I I I I I 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment Review of Historical Topographic Maps Historical topographic maps from EDR' s map collection were obtained and reviewed. Review of City of Carlsbad Building Permit Records Based on the sufficient amount of information obtained from the historical resources above, building permits were not reviewed at the City of Carlsbad. Summary of Historic Uses Subject Property Based on our review of the documents listed, it appears that the subject property was vacant land from at least 1893 to 1901. By 1939, the subject property was developed with at least one single structure on the northwestern portion of the property. From 1946 to 1967 the subject property was developed with multiple residential structures. Since at least 1979, the subject property has been developed with three commercial structures along the southeastern portion of the subject property and an asphalt-paved parking area on the northwestern portion of the property. Gaps in Historical Sources Several gaps of greater than 5 years were identified in the historical records reviewed: from 1901 to 1939, from 1939 to 1946, and from 1953 to 1964. These gaps are considered insignificant because the subject property use appears to be similar prior to and following the gaps. INTERVIEWS Rincon Consultants provided a questionnaire regarding the subject property and surrounding · areas to the owner of the property. I 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment INTERVIEW WITH OWNER/SITE MANAGER Mr. Edmond Shehab, the current property owner, completed the property owner questionnaire. Mr. Shehab indicated the following: • The subject property is currently used for commercial offices. • The northern adjacent property is currently developed with a triplex (residential). • The eastern adjacent property is currently used as a dentist office. • The western adjacent property is currently developed with commercial offices and apartments. • Mr. Shehab has owned the subject property for 35 years. • The onsite buildings were building approximately 70 years ago. • No hazardous waste is generated at the subject property. In addition, Mr. Shehab indicated that there are no industrial drums, evidence of fill dirt, pits, ponds or lagoons, sumps, clarifiers, or solvent degreasers, stained soil, storage tanks, vent pipes, fill pipes, or access ways, stained surfaces, transformers, capacitors, or hydraulic equipment, records indicating the presence of PCBs, or records indicating the presence of pesticides/herbicides on the subject property. Mr. Shehab indicated that he is not aware of any pending, threatened, or past litigation or administrative proceedings relevant to hazardous substances or petroleum products in, on, or from the property. In addition, he is not aware of any notice from any government entity regarding any possible violation of environmental laws or possible liability relating to hazardous substances or petroleum products. INTERVIEWS WITH LOCAL GOVERNMENT OFFICIALS Based on the fact that the subject property and adjacent properties were not listed in any of the databases searched by EDR, no records were requested for these properties. However, one orphan listing, Carlsbad Burnsite, was listed on the Solid Waste Facility /Landfill database. Based on the unknown location of the property and the nature of the listing, records for this property were requested from the County of San Diego DEH. Information available from those records is included in the Review of Agency Files section above. INTERVIEWS WITH OTHERS Rincon did not attempt to interview neighboring property owners or others as part of this research effort. SITE RECONNAISSANCE Rincon Consultants performed a reconnaissance of the subject property on September 14, 2016 . The purpose of the reconnaissance was to observe existing subject property conditions and to obtain information indicating the presence of recognized environmental conditions in connection with the property. 15 800 Grand Avenue, Carlsbad, California Phase I Environmental Site Assessment METHODOLOGY AND LIMITING CONDITIONS The site reconnaissance was conducted by 1) observing the subject property from public thoroughfares, 2) observing the adjacent properties from public thoroughfares, and 3) observing the subject property from and walking paths. Based on the commercial nature of the property, the interiors of two units were observed. CURRENT USE OF THE PROPERTY AND ADJACENT PROPERTIES The subject property is currently developed with three two-story commercial buildings used as offices. In addition, the northwestern portion of the subject property is developed with an asphalt-paved parking area. One maintenance area is located north of Building B, on the eastern portion of the subject property. Adjacent properties include single-family homes, multi-family residences, and commercial offices. PAST USE OF THE PROPERTY AND ADJACENT PROPERTIES Based on our site reconnaissance, former past uses at the subject property and adjacent properties are not readily apparent. However, during the site reconnaissance, Mr. Shehab indicated that the subject property was formerly used for residential purposes. CURRENT OR PAST USES IN THE SURROUNDING AREAS The subject property is surrounded by residential and commercial land uses as detailed in the Site Description section of this report. Past uses of the surrounding area are not readily apparent based on the site reconnaissance. GEOLOGIC, HYDROGEOLOGIC, HYDROLOGIC AND TOPOGRAPHIC CONDITIONS Geologic, Hydrogeologic, Hydrologic and topographic information are as previously stated in the Physical Settings Section of this report. GENERAL DESCRIPTION OF STRUCTURES The subject property is currently developed with three two-story commercial buildings used as offices. This assessment has not revealed evidence of RECs in connection with the subject property. Based on the findings of this Phase I ESA, no additional assessment is recommended. Based on the construction of the onsite structures sometime between 1970 and 1979, and the results of the previous asbestos and LBP surveys conducted at the subject property, both asbestos and LBP are present onsite. Although not considered a REC for the purposes of this Phase I ESA, renovation or demolition of the onsite structures would require asbestos and LBP Surveys, development of and operations and maintenance plan, and abatement. DEVIATIONS Deviations from AS1M E 1527-13 Practice were not encountered during the completion of this Phase I ESA.
