Owns~s Signature: Contractors Signature: Date: Address: "- - TO: PROPERTY OWNERS WITH THE CITY OF CARLSBAD SUBJECT: CITY OF CARLSBAD RIGHT-OF-WAY & FENCING REQUIREMENTS The City of Carlsbad has recently begun to enforce a right-of-way program for all construction within the City limits. The City has built a program based upon the traffic control procedures established by Cal Trans. Since the City is self insured, the compl iance with the right-of-way program has become imperative. This program requires that any work being done at a business or residence within the City of Carlsbad boundaries must acquire a right-of-way permit from the City for a fee of $25.00, post a $200.00 Restoration Security, and post a $1,050.00 right-of-way security deposit. This includes not only work that will require traffic control but also work that will affect pedestrian traffic (ie. hoses running across City sidewalks). The application for the permit should be accompanied with a plan and an explanation as to the obstructions expected. The application is reviewed by the City, a maximum of three weeks is to be expected, and then issued to the submitting party. Since the fines for non compliance are substantial, the party submitting for the permit should only submit for work under their direct control. Any contracted work done seperate of Mission Pools contracted work IS NOT COVERED by Mission's permit. Work being conducted under this permit is required to be called into the City for an inspection on the day the work is performed. This inspection may add to the time of the construction of the pool and should be rigidly adhered to by all parties. The call for inspection is required to be made a minimum of 24 hours prior to the work being done. The City of Carlsbad also requires that your fencing provide a barrier to entry prior to the first City inspection. This means that your fence should be completed immediately after pool excavation. Any deviation to this requirement will be handled on a case by case basis by the City and can cause construction delays. Mis'sion Pools Inc.
