Following several telephone conversations with Robert Flores
with Warnock Hersey regarding reusing the wire glass, he said
the building inspector has the authority of making that
decision. He would be looking at three items: caulking
(metacaulk), mullions and floor sills protected on three sides.
Enclosed please find the certification from Central Glass, a
letter from Maran Wurzell Glass and an interesting article on
this whole issue of labeled glass.
I hope this is adequate documentation for your decision. If you
should have any questions, please call immediately so we can
proceed with this work.

Pursuant to your request a I."epresentative from Warnock Hersey travelled
to and inspected seventeen ( 17) door•s assemblies for conformance to theil~
applicable specifications.
The doors wer'e round to have been manufactureo by Cal--Wood Door of Santa
Rosa, CA and the door frames were found to have been manufactured by
Rediframe/Dunbarton of Dothan. AL. and are currently under a Warnock Hersey
re1nspect1on and listing service program.
The doors and door frames were found to comply with the applicable speci-
fications and wa.:s labelled on the hinge edge with Warnock Hersey 20 minute
certification labels, serial numbers:
Doors: WHI # 9641 thru 9657
1. The door frame/sidelite assemblies must be so modified to includ.e two
(2) horizontal mullions at every side11te to maintain the requil~ements
of their listing.
2. The floor sill must be protected with a rated wall system as listed
on three (3) sides.
3, Metacaulk is required at every glazed opening,
4. Labeled glazing is reqµired at every glazed opening.
5. All above is the same for borrowed lites.
6. All assemblies must be inspected/verHied by wa.r11ock Hersey. until
verification of these requirements, there is no implied certification.

I am writing to request a :conditional Use Permit for our
building at 2777 Loker Avenue West in Carlsbad Oaks Business
Park.
Currently there are several concerns that

weeks ago, it was determined that our elevator was
not going to be installed until 9/27/91. We
immediately contacted Tim Phillips to determine what
course of action should be taken so as not to
jeopardize our final move-in. It was determined
that boarding up the opening was the best and
easie9,:t;, .~1olution, since the elevator installation
would begin 9/27/91, with the doors being installed
by the 30th. Our concern, as well as Tim's, was
occupant safety. We didn't want anyone falling into
the pit.
Yesterday it was determined that this was not
acceptable, which we have responded to by covering
the plywood with 5/8" gypsum board. Today you have
requested that the elevator be removed from the
plans and a separate permit be requested for its
installation beginning Friday, September 27th. It
seems at this late date a change in Planning
Department opinion affecting our occupancy is
unwarranted, especially with this being a temporary
situation which will be resolved by 10/5/91.
b) A second concern is not having panic bars on the two
exit doors. The Fire Inspector is willing to accept
the current doors as they are, with their being
unlocked each day during business hours. One of the
doors in question has been planned for changeover to
an unlocked position from the interior, while locked
from the exterior. We are in the process of

development today, which we are in the process of

A fourth concern is that copies of the building
plans, with the changes made from the original set
reflecting as built condition, be available for you

These last two items were noted today by you, which we will
of course comply with, as safety is of utmost concern to
DonJoy. However, based on Tim's observations, oqly the ,Panic;,

prevent us occupying the building. Relying on this
opinion, we are committed to moving in and occupying the
building this weekend.
Smith & Nephew DonJoy is a Carlsbad company. It was started
14 years ago and has remained in the community as an active
supporter of Carlsbad and many community projects, such as
the Carlsbad Boys and Girls Club and Carlsbad High School.
DonJoy generates over $150,000 of business daily and has
grown steadily over the years, which we expect to continue.
If we are delayed from taking t 7mporary occupancy of the
building and are forced to remain in our current facility
beyond September 30th, even for one day, we face a $50,000
penalty from our cu~rent landlord. We appreciate your
cooperation·and consideration in this matter and look forward
to your favorable determination.

Electrical Code and state laws regulating energy
conservation, noise attenuation and access for the

to determine the total value of all
construction work proposed under this permit.
The value shall include all finish work,
painting, roofing, electrical, plumbing,
heating, air conditioning, elevator, fire
extinguishing systems and any other permanent
equipment. Please provide a signed copy of the
designer's or contractor's construction cost
estimate of all work proposed.
Provide a plot plan showing the distance from
the building to the property lines and the
location of tenant space (or remodel) within

Lateral bracing for suspended ceiling must be
provided. (UBC Table 23-P) Where ceiling is
not supporting interior partitions, ceiling
bracing shall be provided by four No. 12 gauge
wires secured to the main runner within 2
inches of the cross runner intersection and
splayed 90 degrees from each other at an angle
not exceeding 45 degrees from the plane of the
ceiling. A strut (adequate to resist the
vertical component from lateral loads) fastened
to the main runner shall be extended to and
fastened to the structural members of the roof
or floor above. These horizontal restraint
points shall be placed 12 feet o.c. in both
directions with the first point within 6 feet
of each wall. Attachment of restraint wires to
the structure above shall be adequate for the

An automatic sprinkler system shall be
installed in rooms used by the occupants for
the consucption of alcohol and in accessory
uses where the total area of such unseparated
rooms and assembly uses exceeds 5000 square
feet. Section 3802(c).
The tenant space and new and/or existing
facilities serving the remodeled area must be
accessible to and functional for the
physically disabled. See the attached
correction sheet. Title 24, Part 2.
The width of the required level area on the
side into which doors swing shall extend 24
inches past the strike edge for exterior doors
and 18 inches past the strike edge for
interior doors. Section 2-3304, Title 24.
Specify lever-type hardware for passage doors
on floors accessible to the disabled. Section

If both sexes will be employed and the number
of employees exceeds four, provide separate

sexes will be employed and the total number of

Provide an exit analysis plan (may be 8 1/211 x

half the maximum overall diagonal dimension of

sign on or near the exit doors reading THIS
DOOR TO REMAIN UNLOCKED DURING BUSINESS HOURS".
This signage is only allowed at the main exit.
Section 3304(c).
Exit doors should be a minimum size of 3 feet
by 6 feet 8 inches with a minimum door swing of
90 degrees. Maximum leaf width is 4 feet.

Exit doors should swing in the direction of
egress when serving an occupant load of 50 or
more or when serving any hazardous area.

Section 3305(g), Exception 5 is applicable only
for corridors on one floor; the corridors on
the lower level(s) must be rated if these lower
corridors ha\'e openings into them from other
le,·els.
If non-rated corridors are used per Section
3305(g), Exe. 5, provide a reference to the
corridors on the floor plan, noting:
1. Corridors are non-rated per Section
3305(g), Exception 5.
2. Smoke detection system must be listed by
the State Fire Marshall and be a
supervised low Yoltage system.
3. Smoke detectors shall be maximum 30' on
center.
4. Power supply shall be dedicated branch
circuit. Circuit disconnecting means
shall be accessible only to authorized
personnel and shall be clearly marked FIRE
ALARM CIRCUIT CONTROL, with a lock-on
device.
If a tenant space utilizes Section 3305(g),
Exception S, then that tenant space shall be
separated from adjacent spaces by a demising
wall constructed as for a one-hour corridor
wall.
Clearly show where the non-rated corridor
system terminates and a rated corridor system
commences.
One-hour fire-rated corridors shall have door
openings protected by tight-fitting smoke and
draft control assemblies rated 20 minutes,
except openings in interior walls of exterior
exit balconies. Doors shall be maintained
self-closing or be automatic-closing by action
of a smoke detector per Section 4306(b). Doors
shall be gasketed to provide a smoke and draft
seal where the door meets the stop on sides and
top. Section 3305(h).
Show rated . corridors, lobbies, reception or
foyers cross-hatched on the floor plans.
Total area of all openings, except doors, in
any portion of an interior corridor, shall not
exceed 25 percent of the area of the corridor
wall of the room which it is separating from
the corridor. Such openings shall be protected
by fixed, approved 1/4 inch thick wired glass
installed in steel frames. Section 3305(h).

Section 3305(h) will be met. Either provide a

the elevator entry meeting the provision.
If a second door is provided at the elevator
entry, note that it will be readily openable
from the car side without a key, tool or
special knowledge or effort. Section 5106. i-Provide evidence of Health Department approval
(for restaurants or for tenants using X-ray
/equipment).
7f· When nonflammable supply cylinders for medical
gas systems are located inside buildings, they
shall be in a separate room or enclosure
separated from the rest of the building by not
less than one-hour fire-resistive
construction. Doors to the room or enclosure
shall be self-closing smoke-and draft-control
assemblies having a fire-protection rating of
not less than one hour. Rooms shall have at
least one exterior wall in which there are not
less than two vents of not less than 36 square
inches in area. One vent shall be within 6
inches of the floor and one shall be within 6
inches of the ceiling. When an exterior wall
cannot be provided for the room, automatic
sprinklers shall be installed within the room
and the room shall be vented to the exterior
through ducting contained within a one-hour-
rated shaft enclosure. Approved mechanical
ventilation shall provide six air changes per
hour for the room. Section 702(b)4.

The following provisions are contained in Title 24,
Part 2, california Building Code, as adopted and
enforced by the State Fire Marshall. They are
provided here as a courtesy to assist designers in
developing the project documents. All applicable
provisions may not necessarily be included. Please
direct any questions regarding interpretations of
these provisions to the local Fire Department.
S-1. Walls of corridors and exterior exit balconies
in Groups A,E,I,R-1 and C Occupancies having an
occupant load of more than six persons and in
all other occupancies having an occupant load
of 30 or more shall be not less than one-hour
fire-resistive construction. Section 3305(g)l.
S-2. Where exit signs are required by Section
3314(a), approved and listed internally,
externally or self-illuminated low-level exit
signs complying with Section 3314. shall be
required. The bottom of the sign shall be not
less than 6 inches nor more than 8 inches above
the floor level. For exit way doors, the sign
shall be on the door with the closest edge of
the sign with 4 inches of the door frame or
adjacent to the door. Such signs shall be of a
type which is perceptible to the sense of
touch. Section 3314(e).

S-3. Where exit signs are required by Section
3314(a), all exit corridors shall be provided
with continuous low-level exit path marking.
Approved and listed internally or self-
illuminated marking shall be installed at
floor level or no higher than 8 inches above
the floor level. Such marking shall be of a
type which is perceptible to the sense of
touch. Section 3314(f).
S-4. Area separation walls shall not be considered
to create separate buildings for the purpose
of automatic fire-sprinkler system
requirements as set forth in Chapter 38.

EXCEPTION: Buildings separated by continuous
area separation walls of four-hour fire-
resistive construction without openings.
Buildings required to have automatic fire-
sprinkler protection as set forth in Section
13113 of the Health and Safety Code (homes for
children or the aged) are prohibited from
using area separation walls in lieu of
automatic fire-sprinkler protection.
S-5. In educational occupancies, storage and
janitor closets shall be of one-hour fire-
resistive construction with openings protected
by assemblies having at least a three-fourths-
hour fire-resistive rating. Section 802(c).
S-6. Section 1807 should be reviewed for all high-
rise buildings.
S-7. The exception in Section 3318 of the UBC has
been revised so as to allow the omission of
panic hardware at the main exit in churches
(by using signage), only when the occupant
load of the church is less than 300.
S-8. If emergency warning systems are required,
they shall activate a means of warning the
hearing impaired. Flashing visual warnings
shal~ have a frequency of not more than 60
flashes per minute.

Section 230-95 requires that certain services be provided with a ground fault
protection system.· Subsection (c) requires that tests be performed on such
systems, presumably to assure that the equipment performs its intended function.
This code section does not define who is to perform these tests or what
information is to be included in the written report for inspection jurisdictions.
Additionally, the requirement that these tests be performed on the system "when
first installed on site" allows tests to be made at inappropriate times.
The following standards are established to assure that· performance testing of
ground fault systems is accomplished in a uniform and acceptable manner:
1. Performance testing shall be performed by a third party capable of
demonstrating both the knowledge and equipment necessary for such tests.
2. The required tests shall be conducted after all electrical work has been
performed and before the building is occupied.
3. The written record of the test shall include:
a) A copy of the manufacturer's instructions for performance testing
of the equipment.
b) A statement that the service grounding connections are correctly
installed for a ground fault system.
c) A statement that all neutral conductors in the di~tribution system
have been tested and found to be ungrounded. Describe the test
method used.
d) A statement that the ground fault equj,pment functioned prope_rly when
tested. Include the actual settings and trip-times of the tests.

Closets and rooms housing transformers shall have provisions to maintain an
ambient temperature which does not exceed the ambient temperature rating on the
transformer. This may be accomplished by natural or mechanical ventilation, by
mechanical cooling, or by other means.
1. Natural ventilation which complies with the provisions of Section 450-45
shall be acceptable.
2. Mechanical ventilation which provides for air movement of 3 cubic feet per ·
minute/per KVA of transformer rating shall be acceptable.
3. Mechanical cooling which can be demonstrated to maintain an ambient
temperature below that of the transformer rating shall be acceptable.
4. Any other means, including combinations of the above methods, which can
be demonstrated to maintain an ambient temperature below that of the
transformer rating shall be acceptable.

. Section 110-lG(c) now uses the term "equipment" instead of "switchboarps and
panelboards". The intent ~s to include any type of equipment that contains
overcurrent, switching or control devices. The local inspection jurisdictions
have made the following interpretations regarding this section:
l. This section ·applies only to equipment individually listed and marked with
a 1200A or larger rating.
2.· l?ullsections rated 1200A or larger·will be considered to be "equipment".
3. The widths of all individual sections of 1200A or larger rated equipment
installed in the same room or area will be included in the six foot
measurement to determine if two doors aFe required.
4. The clearance required in Table ll0-16(a) Exception No. 2 to the nearest
edge of the door is a radial measurement from the equipment. (See drawing
below.)
5. Electrical equipment room doors shall open out and shall utilize "lever-
operated" hardware. Lever-operated hardware is a type that permits the
door to be opened from inside the room without the use of hands.
Note: The utility c9mpany requires that these doors be at.least 30" wide.

As we discussed this morning on the phone, in calculating the fees for the above referenced plan
check number, please be certain that we are properly credited for fees already paid for the "Shell
-T .I.) which was paid but never pulled (Permit CB-89-1205 -copy attached), as well fees paid
for WAREHOUSE USAGE for the Shell (Permit #89-1204 -copy attached).
Marty, whatever you can do to expedite the calculation of these fees, would be most appreciated,
as we are being penalized $500/day by the tenant for everyday the permit is not pulled after July
8th! I'm sure it won't take that long once you start the calculating process.
