The provisions of UBC, Section 106.4.4 as amended by the Carlsbad Municipal Code state: "EXPIRATION.
Every permit issued by the Building Official under the provisions of this cede phall expire by limitation and

approval of work by the Building Official within each 180 day period upon the initial commencement of work
authorized by such permit.
Before such work can be recommenced, a new permit shall be obtained to do so, and the fee, therefore, shall
be one-half the amount required for a new permit for such work, and provided that no changes have been made
or will be made in the original plans and specifications for such work, and provided further that such
suspension or abandonment has not exceeded one year. In order to renew action on a permit after expiration,
the permittee shall pay a new permit fee.
Any person holding an unexpired permit may apply for an extension of the time within which work may
commence under that permit when the permittee is unable to commence work within the time period required
by this section for good and satisfactory reasons. The Building Official may extend the time for action by the
permittee for a period not exceeding 180 days on written request by the permittee showing that circumstances
beyond the control of the permittee have prevented action from being taken. No permit shall be extended more
than once.

FOREWORD (PLEASE READ):
This plan review is limited to the technical requirements contained in the Uniform Building Code,
Uniform Plumbing Code, Uniform Mechanical Code, National Electrical Code and state laws
regulating energy conservation, noise attenuation and disabled access. This plan review is
based on regulations enforced by the Building Department. You may have other corrections
based on laws and ordinances enforced by the Planning Department, Engineering Department
or other departments.
The following items listed need clarification, modification or change. All items must be satisfied
before the plans will be in conformance with the cited codes and regulations. Per Sec. 106.4.3,
1997 Uniform Building Code, the approval of the plans does not permit the violation of any
state, county or city law.
1. Please make all corrections on the original tracings, as requested in the correction list.
Submit three sets of plans for commercial/industrial projects (two sets of plans for
residential projects). For expeditious processing, corrected sets can be submitted in one of
two ways:
1. Deliver all corrected sets of plans and calculations/reports directly to the City of
Carlsbad Building Department, 2075 Las Palmas Drive, Carlsbad, CA 92009, (760)438-
1161. The City will route the plans to EsGil Corporation and the Carlsbad Planning,
Engineering and Fire Departments.
2. Bring one corrected set of plans and calculations/reports to EsGil Corporation,
9320 Chesapeake Drive, Suite 208, San Diego, CA 92123, (858) 560-1468. Deliver all

7. Provide a statement on the Title Sheet of the plans that this project shall comply with the
1998 edition of the California Building Code (Title 24), which adopts the 1997 UBC, UMC
and UPC and the 1996 NEC.

8. Clearly dimension building setbacks from property lines, street centerlines, and from all
adjacent buildings and structures on the site plan.
BUILDING AREA
9. Provide a floor plan of the proposed and existing. Show all doors and windows and room
uses.
10. The building elevation shows the addition to have a gable roof. The construction plans
show a shed roof. Please clarify what is intended.

11. Note on the plans: "All exits are to be openable from inside without the use of a key or
special knowledge."
12. Exit doors should be a minimum size of 3 feet by 6 feet 8 inches. Maximum leaf width is

minimum actual net thickness of 2!4 inches. Section 1633.2.8.
c) Cross grain tension or bending in wood ledgers is not permitted in Seismic Zones
2, 3 and 4. Section 1633.2.9.

Dear Mr. and Mrs. Grigoras:
We have received and reviewed the letter from Southbay Consulting Engineers, dated
June 14, 2000. Their attachment, labeled "ICBO Evaluation Service, Inc.", Section II.D.
states that "continuous special inspection is required..." for the type of construction you
have used. As you know, the addition to your building was built without any inspections
whatsoever. Further, the City must adhere to the 1998 California Building Code, which
requires inspections of construction that remains exposed until approval. Below are the
applicable parts of the 1998 CBC.
Section 108-Inspections
108.1 General. All construction or work for which a permit is required shall be subject to
inspection by the building official and all such construction or work shall remain
accessible and exposed for inspections purposes until approved by the building official.
In addition, certain types of construction shall have continuous inspection, as specified in
Section 1701.5.
Approval as a result of an inspection shall not be construed to be an approval of a
violation of the provisions of this code or of the other ordinances of the jurisdiction.
Inspections presuming to give authority to violate or cancel the provisions of this code or
of other ordinances of the jurisdiction shall not be valid.
It shall be the duty of the permit applicant to cause the work to remain accessible and
exposed for inspection purposes. Neither the building official nor the jurisdiction shall be
liable for expense entailed in the removal or replacement of any material required to
allow inspection.
108.4 Approval Required. Work shall not be done beyond the point indicated in each
successive inspection without first obtaining the approval of the building official. Any
portions that do not comply shall not be covered or concealed until authorized by the
building official.
108.5 Required Inspections.
108.5.1 General. Reinforcing steel or structural framework of any part of any building or
structure shall not be covered or concealed without first obtaining the approval of the
building official.
108.5.2 Foundation inspection. (For HCD 1) inspection should be made after
excavations for footings is complete and any required reinforcing steel is in place. For
concrete foundations, any required forms shall be in place prior to inspection.
The building code requires that you remove all construction that was not inspected in
the manner described in the code. Please comply with the schedule below.
Correction Required: 1. Vacate all illegally constructed space; and
2. Comply with one of the following (either A or B):
A. Remove all uninspected/unapproved construction in preparation for rebuilding with
inspections by July 31,2000.
B. Remove all illegal structure(s) and abandon the project described above by no later
than July 31, 2000.
Discussion: This is a serious issue, brought to our attention by a citizen's complaint.
We have an obligation to resolve this matter as soon as possible.
Your failure to comply with this notice will result in legal action as appropriate and
necessary to obtain compliance.

Pursuant to Health and Safety Code Section 13235, Fire Clear-
ance Preinspection, fee; upon receipt of a request from a prospec-
tive licensee of a community care facility, as defined in Section
1502, of a residential-care facility for the elderly, as defined in
Section 1569.2, or of a child day-care facility, as defined in Sec-
tion 1596.750, the local fire enforcing agency, as defined in Sec-
tion 13244, or state fire marshal, whichever has primary
jurisdiction, shall conduct a preinspection of the facility prior to
the final fire clearance approval. At the time of the preinspection,
the primary fire enforcing agency shall price consultation and in-
terpretation of the fire safety regulations, and shall notify the pro-
spective licensee of the facility in writing of the specific firesafety
regulations which shall be enforced in order to obtain fire clear-
ance approval. A fee of not more than $50.00 may be charged for
the preinspection of a facility with a capacity to serve 25 or fewer
persons. A fee of not more than $100.00 may be charged for a pre-
inspection of a facility with a capacity to serve 26 or more persons.
The primary fire enforcing agency shall complete the final fire
clearance inspection for a community care facility, residential-
care facility for the elderly, or child day-care facility within
30 days of receipt of the request for the final inspection, or as of the
dale the prospective facility requests the final prelicensure inspec-
tion by the State Department of Social Services, whichever is later.
Pursuant to Health and Safety Code Section 13235, a prein-
spection fee of not more than $50 may be charged for a Group R,
Division 2 facility with a capacity to serve 25 or less clients. A fee
of not more than $100 may be charged for a preinspection of a
facility with a capacity to serve 26 or more clients.
Pursuant to Health and Safety Code Section 13131.5, a reason-
able final inspection fee, not to exceed the actual cost of inspection
services necessary to complete a final inspection may be charged
for Group R, Division 2.1 Occupancies classified as residential
care facilities for the elderly (RCFE).
Pursuant to Health and Safety Code Section 1569.84, neither
the state fire marshal nor any local public entity shall charge any
fee for enforcing fire inspection regulations pursuant to state law
or regulation or local ordinance, with respect to residential-care
facilities for the elderly which service six or fewer persons.
Whenever a local authority having jurisdiction requests that the
state fire marshal perform plan review and/or inspection services
related to a building permit, the applicable fees for such shall be
payable to the Office of the State Fire Marshal.
SECTION 108 — INSPECTIONS
108.1 General. AH construction or work for which a permit is
required shall be subject to inspection by the building official and

for inspection purposes until approved by the building official. In

A survey of the lot may be required by the building official to
verify that the structure is located in accordance with the approved
plans.
108.1.1 [HCD1] Excavation and grading. Subject to other pro-
visions of law, reference Health and Safety Code, Division 13,
Part 1.5, Sections 17953, 17954, 17955, and California Code of
Regulations, Title 25, Division 1, Chapter 1 and Title 24, Part 2,
Appendix Chapter 33, Excavation and Grading.
108.2 Inspection Record Card. Work requiring a permit shall
not be commenced until the permit holder or an agent of the permit
holder shall have posted or otherwise made available an inspec-
tion record card such as to allow the building official to conve-
niently make the required entries thereon regarding inspection of
the work. This card shall be maintained available by the permit
holder until final approval has been granted by the building
official.
108.3 Inspection Requests. It shall be the duty of the person do-
ing the work authorized by a permit to notify the building official
that such work is ready for inspection. The building official may
require that every request for inspection be filed at least one work-
ing day before such inspection is desired. Such request may be in
writing or by telephone at the option of the building official.
It shall be the duty of the person requesting any inspections re-
quired by this code to provide access to and means for inspection
of such work.
108.4 Approval Required. Work shall not be done beyond the
point indicated in each successive inspection without first obtain-
ing the approval of the building official. The building official,
upon notification, shall make the requested inspections and shall
either indicate that portion of the construction is satisfactory as
completed, or shall notify the permit holder or an agent of the per-
mit holder wherein the same fails to comply with this code. Any
portions that do not comply shall be corrected and such portion
shall not be covered or concealed until authorized by the building
official.
There shall be a final inspection and approval of all buildings
and structures when completed and ready for occupancy and use.
108.5 Required Inspections.
108.5.1 General. Reinforcing steel or structural framework of
any part of any building or structure shall not be covered or con-
cealed without first obtaining the approval of the building official.
Protection of joints and penetrations in fire-resistive assemblies
shall not be concealed from view until inspected and approved.

make the inspections set forth in the following sections.
108.5.2 Foundation inspection. [For HCD 1] Inspection should
be made after excavations for footings is complete and any re-
quired reinforcing steel is in place. For concrete foundations, any
required forms shall be in place prior to inspection. All materials
for the foundation shall be on the job site; however, where concrete
is ready mixed in accordance with approved nationally recog-
nized standards, the concrete need not be on the job site. Where the
foundation is to be constructed of approved treated wood, addi-
tional inspections may be required by the building official.
108.5.3 Concrete slab or under-floor inspection. [For HCD I]
Inspection should be made after all in-slab or under-floor building
service equipment, conduit, piping accessories and other ancillary
equipment items are installed, but before any concrete is placed or
floor sheathing installed, including the subfloor.

RE: CB 99 4340 , BUILDING PERMIT FOR STORAGE BUILDING
Dear Mr. Grigoras:
Following the telephone conversation we had this afternoon, I reviewed the application
noted above. You have applied to construct an attached storage structure to the
property at 2802 Carlsbad Boulevard. The structure is of reinforced masonry
construction with a wood framed roof and architectural appurtenances.
During the telephone conversation today, you indicated the plan check comments were
too onerous to continue with the permit process, and you wished to be exempted from a
building permit process on the basis of the exemption for accessory structures in the
City Building Code. The City Building Code exempts from building permits "....detached
residential accessory structures ". The proposed project is an attached addition to a
commercial structure, and as such it is not exempt from permit requirements.
Should you choose to continue with this project, a building permit and subsequent
inspections will be required.
