City Clerk’s Office Ann: Citv Clerk 1200 Carlsbad Village Drive Carlsbad, California 92008 (space above for Recorder’s Use) MAR VISTA (CT94-ll/SDP94-lO(A)/HDP94-09(A)} AFFORDABLE HOUSING AGREEMENT AMENDMENT NO. 1 THIS AMENDED AFFORDABLE HOUSING AGREEMENT (“Agreement”) is entered into thisa 0 day of&r,’ b 1998, by and between the CITY OF CARLSBAD, a municipal corporation (hereinafter referred to as the “City”), and UDC Homes, Inc., a California Corporation, (hereinafter referred to as the “Developer”), is made with reference to the following: RECITALS A. The Developer and City entered into the Mar Vista Affordable Housing Agreement on April 21, 1997. 6. Condition No. 50 of Planning Commission Resolution No. 3875, states that this Affordable Housing Agreement shall be entered into between the City and the Developer as a means of satisfying the Developers’ affordable housing obligation (“Affordable Housing Obligation”), as such is defined under Chapter 21.85 of the Carlsbad Municipal Code. Planning Commission Resolution No. 3875 provides that the Affordable Housing Obligation will be satisfied by applying the requirements set forth in said Agreement to eight (8) affordable housing lots (“Affordable Housing Lots”). The Affordable Housing Lots were identified as Lots 8, 18, 24, 27, 32, 35, 44, and 50 of CARLSBAD TRACT NO 94-l 1. units will be satisfied by applying the requirements set forth in this Agreement. 0fiP NO. 13404) . C. It is the Developer’s intention to amend said agreement to replace Lot 24 as an Affordable Housing Lot and add Lot 23 as an Affordable Housing Lot. Further, Exhibit A, the construction phasing schedule would be modified to reflect said change. \21 NOW, THEREFORE, incorporating the foregoing Recitals and in consideration of the mutual covenants contained herein, the parties agree as follows: 1. The Recitals Are True And Correct. 2. The aforementioned Mar Vista Affordable Housing Agreement, dated April 21, 1997, is hereby amended to delete Lot 24 as an Affordable Housing Lot and add Lot 23 as an Affordable Housing Lot. Further, Exhibit A, the construction phasing schedule is hereby amended to reflect said change and as attached hereto.
