(“MAAC”), and Kaiza, dated September 13, 1995, as amended by that certain First Amendment to Agreement Regarding Participation Payment, dated May 15, 1996, as amended by that Second Amendment to Agreement Regarding Participation Payment, dated March 19, 1997, as amended by that certain Third Amendment to Agreement Regarding Participation Payment, dated August 27, 1997, Kaiza has fully satisfied and fulfilled all obligations and conditions imposed by City relative to Inclusionary Housing in the Poinsettia Shores Master Plan and Kaiza has fulfilled all obligations and conditions under the Affordable Housing Mitigation Agreement, including, without limitation, the Inclusionary Housing Requirements, through the payment by Kaiza to MAAC of Two Million Two Hundred Eighty-Four Thousand Nine Hundred Twenty Dollars ($2,284,920.00).
