AGREEMENT TO PAY FEES FOR FACILITIES AND IMPROVEMENTS
AS REQUIRED BY THE GROWTH MANAGEMENT SYSTEM FROM ESCROW
This agreement is made and entered into the /.2d day
I 1988 by and between the City of Carlsbad,
California, a municipal corporation of the State of California,
hereinafter referred to as "City" and Marina Development, a
corporation, hereinafter referred to as "Developerl'.
WHEREAS, developer has previously executed agreements to
pay fees as reguirea by the Growth Management System recorded
December 30, 1986 and June 9, 1987 bearing San Diego County
Recorder Serial Numbers 86 618927 and 87 320613 respectively on the
real property described as follows:
That certain parcel of land located in the City of Carlsbad, County of San Diego, State of California specifically being a one lot
condominium project that contains 22 dwelling units as created by Map No.
11481 filed in the office of the
County Recorder at file number 86-
127729 on April 2, 1986.
NOW, THEREFORE, the parties agree as follows:
1. Developer shall pay the sum of $1,000 from each of
the first ten escrows and an amount from the eleventh escrow that
will equal the sum of $11,095.68 plus ten percent interest from
December 22, 1987.
2. In addition, Developer shall pay recording and court
costs if any.
3. Payments shall be made to the City of Carlsbad,
attention Office of the City Attorney, 12Oq Elm Avenue, Carlsbad,
