PARTIESi The parties to this Agreement are the City of
Carlsbad, California, a municipal corporation, hereinafter referred
to as CITY; and Ann H, Ehrhardt, hereinafter referred to as
EHRHARDT.
RECITALS: This Agreement is made with reference to the
8 following facts:
9 1. EHRHARDT owns a certain building lot located within the
10 City of Carlsbad, County of San Diego, State of California, which
31 she proposes to split into three separate building lots pursuant
3 4 12 to the provisions of Section 500 of Ordinance No. 9050 of the City
13 of Carlsbad.
14 2. Said three separate building lots are herein referred to
15 as PARCEL A, PARCEL B, and PARCEL C. PARCEL A is particularly
16 described on Exhibit .4 attached hereto and by this reference incor-
1’7 porated herein. PARCEL B is particularly described on Exhibit B
18 attached hereto and by this reference incorporated herein, PARCEL
19 C is particularly described on Exhibit C attached hereto and by this
20 reference incorporated herein.
21 3. Secllon 500 of City of Carlsbad Ordinance No. 9050 requires,
22 among other things, that as a condition of the approval of such a
‘23, lot split, that EHRHARDT be required to construct to City of
24 Carlsbad standards certain improvements.
25 4. PARCEL B and PARCEL C front unto Stratford Lane and re-
26' quire no further improvements on that frontage,
27 5. PARCEL A fronts unto Laguna Drive and the provisions of
11 COVENANTS: Now, Therefore, it is mutually agreed between
2ithe parties hereto as follows:
3 1. EHRHARDT warrants that she is the owner of PARCEL A,
4 PARCEL B, and PARCEL C.
5 2. CITY hereby approves EHRHARDT's said proposed lot split
6 and does hereby temporarily waive the requirements that EHRHARDT
7 install the following listed improvements on that portion of Laguna
8 Drive contiguous to said PARCEL A, as required by the provisions of
g Section 500 of Ordinance No, 9050 of the City of Carlsbad:
10 a, Clearing , grubbing, grading and paving on imported
11 base material of said Laguna Drive to its center line.
12 b. Installation of concrete curbs, gutters and sidewalks
in Laguna Drive adjacent to PARCEL A.

3. EHRHARDT agrees to join in and fully cooperate with any
proposed improvement, improvement district, or other proceeding
l6 hereafter instituted for the purpose of causing the installation of
17 any ar all of said improvements.

4. EHRHARDT agrees to install and pay for any and all of said
improvements upon written notice to do so by CITY. In the event
20 EHRHARDT fails to install and pay for said improvements upon written
21' notice so to do by CITY, CITY may cause said improvements to be
22 installed and EHRHARDT shall pay the cost thereof to CITY.
23 5, EHRHARDT hereby grants to CITY a lien on PARCEL A to
24 secure the performance of each and all of her agreements herein
25 contained.

6. This Agreement shall be binding on and against the succes-
sors and assigns of EHRHARDT, shall run with the land, and shall
28 I create an equitable servitude upon PARCEL A,
