FENCE AGREEHENT
for Por. Lot 4, Frac. Sec. 31, T.ll S., R.4 W., S.B.M.
This agreement is entered into between Lary W. Breitbarth and
Nancy Breitbarth (hereinafter referred to as "Developer") and the City of Carlsbad for the benefit of future subdivision lot owners.
Developer agrees that the portion of Parcel 2 North of the existing fence (as of the date of this agreement), is for the temporary use of Parcel 1 until such time as Parcel 1 is further developed or sold. At that time, said fence shall be removed or
relocated to the boundary of Parcel 1 and Parcel 2.
IN WITNESS WHEREOF, the undersigned has executed this instrument this /"I& day of &+u4 , 1987.
