In consideration of the City’s approval of Building

owner(s) of the property, promise to hold the City of Carlsbad,
or any of its agencies or emloyees, or any other public agency,
harmless from any liability for damage to the structure
encroaching in whole or in part into the City’s easement when the
easement is being used in the performance of any public service
or activity.
City shall not be an insurer or surety for the design or
construction of the structure pursuant to the approved plans, nor
shall any officer or employee thereof be liable or responsible
for any accident, loss or damage happening or occurring during
the construction work or improvements as specified in this
agreement.

The owner agr.ees to remove the encroaching
structure upon written order from the City at no cost to the
City.
It is further agreed that this agreement shall be
binding on all heirs, successors or assigns having an interest in
all or any part of the property described herein.
IN WITNESS WHEREOF, the undersigned has executed this
instrument this 30 day of z/q , 1986 . /
