GEOLOGICAL FAILURE
In consideration of the City's approval of a subdivi
map and grading permit (PE 2.85.591, a grading plan (Plar
262-6A), and/or improvement plans for development to OCCL
property described as Carlsbad Tract No. 85-5, Lots 1 throuc
(inclusive) (APN 223-322-01) and other good and valL
consideration, receipt of which is hereby acknowledged, I

agencies or employees harmless from liability for injuries tc
persons, or damage to or taking of any property including PL
property, directly or indirectly caused by geological or E

damage that may occur on or adjacent to this subdivision du
its construction, operation or maintenance.
Approval of the plans or permits, or inspection of
work done pursuant to those plans or permits by the City SI
not constitute an assumption by the City of any responsil
iky for any damage or taking referenced in this agreement. I
shall not be responsible in any manner whatsoever for the desj
COmpaCtiOn, Construction or maintenance of the slopes, ct
fills or improvements made or done pursuant to the apprc
plans, nor shall any officer or employee thereof be liable
responsible for any accident, loss or damage happening
occurring during the construction work or improvements
specified in this agreement. The entire risk of any 1
resulting from or caused by any geological failure is assumed
and shall be borne by the owner.
It is agreed that the above owner(s) will maintain
slopes, landscaping and related subdrains in a manner to ins,
slope stability to the satisfaction of the City Engineer. Tt
owners agree to repair any damage to public improvements caus
by any geological failure referred to in this agreement to t
satisfaction of the City Engineer. The owner(s) agree to repa
or stabilize any slope which the City Engineer determines II
fail and cause damage to public improvements. It is furth
agreed that this agreement shall be binding on all heir
