NOTICE: THIS
Corporation as trustee, covering that portion of Tract 232 of Thum
Lands in the City of Carlsbad, County of Sari Diego, State Of
California, according to Map thereof No. 1681, filed in the Office
of the County Recorder of San Diego County, December 9, 1915,
described as follows:
Tamarack Avenue and Jefferson Street; thence along the COMMENCING at point of intersection of the centerline of
center line of Tamarack Avenue South 61' 21' West 710.05 feet to the point of beginning; thence South 28'39' East
120.00 feet to the most Northerly corner Of Lot 17 Of

Bali Hai Terrace, according to Map thereof No. 4751,
filed in the Office of the County Recorder of San Diego
County, April 21, 1961; thence South 61'21' West along the Northwesterly line of said Lot 17 a distance of
street known as Hibiscus Circle and shown on said Map of 110.00 feet to the Northeasterly line of that certain
Northeasterly line 120.00 feet to the center line of Bali Hai Terrace: thence North 28'39' West along said
Tamarack Avenue; thence North 61"21' East along said center line to the point of beginning. APN 206-042-23

Easement created in favor of Easement Grantee; and
WHEREAS, it is to the mutual benefit of the parties hereto
that Easement Grantee accept said Easement and Beneficiary is
willing that the grant of Easement shall, when recorded,
constitute a charge upon said land which is unconditionally prior
and superior to the lien or charge of the deed of trust above
mentioned.

NOW, THEREFORE, in consideration of the mutual benefits
accruing to the parties hereto and other valuable consideration,
the receipt and sufficiency of which consideration is hereby
acknowledged, and in order to induce Easement Grantee to accept
said Easement above referred to, it is hereby declared, understood
shall uncon

charge thereof to another interest in the real property therein
described.
BENEFICIARY declares, agrees and acknowledges that:
1. It consents to and approved the grant of Easement
in favor of the Easement Grantee.

2. It intentionally and unconditionally waives,
relinquishes and subordinates the lien or charge of the deed of
trust above mentioned to the Easement in favor of Easement Grantee
above referred to and understands that in reliance upon, and in
consideration of, this waiver, relinquishment and subordination of

3. This Agreement represents an endorsement to the note
secured by the deed of trust above mentioned and that said deed of
trust has by this instrument been subordinated to the charge of
the Easement in favor of Easement Grantee above referred to.
