SUBORDINATION AGREEMENT
FRANK E. THIBODO, a widower, as to an undivided one-half interest in and
to, and RUSSELL L. THIBODO and MARGARET THIBODO, husband and wife, as joint
tenants, as to an undivided one-half interest in and to, holders of the
beneficial interest in a deed of trust dated October 14, 1950 and recorded
November 8, 1950, in Book 3852, page 337, of Official Records of the County of
San Diego, State of California, affecting the hereinafter described real
property situated in said County and State;
HEREBY subordinate their interest and rights in said land under said deed
of trust to the encumbrance of a certain grant of easement of right of way
executed by WALTER LARRY TUTEN and JOSEPHINE H. TUTEN, husband and wife, to
the CARLSBAD MUNICIPAL WATER DISTRICT, a Municipal Water District duly organized
and existing under the Municipal Water District Act of 1911, and dated

described lands and premises.
This agreement is made for the express benefit of said CARLSBAD MUNICIPAL
WATER DISTRICT and is intended to bind the heirs, assigns, and successors in
interest of the parties hereto. Said grant of easement of right of way affects
that real property in the County of San Diego, State of California, described as:
That portion of Lot 3, Block 74, of the Subdivision of the Rancho Los
Vallecitos de San Marcos, in the County of San Diego, State of
California, according to Map thereof No. 581, filed in the office of
the County Recorder of said San Diego County, February 11, 1889,
described as follows:
Commencing at a point on the Northerly boundary line of said Lot, 442
feet East from the Northwest corner thereof;} thence running Westerly
442 feet to the Northwest corner of said Lot; thence Southeasterly
833.7 feet to the Southwest corner thereof; thence Easterly along
the Southerly boundary line of said Lot, 342 feet; thence Northwesterly
to the point of commencement.
EXCEPTING therefrom one-half of all petroleum, coal, oil, naptha,
natural gas and other hydrocarbons and like substances including
asphaltum and brea and one-half all minerals of whatever nature.
