CERTIFICATE OF COMPLIANCE
WITH CONDITIONS
(Section 66499.35 of the Government Code)
The City Engineer has determined that the real property described
below, has been divided or has resulted from a division or
combining of lots in compliance with the Subdivision Map Act and
with the provisions of the Carlsbad Municipal Code pursuant
thereto.

The Lusk Company, a California Corporation
(See Exhibit "A" attached) (Exhibit "B" is attached
for clarity only).
NOTE: The description in Exhibit "A" attached has been provided
by the owner of the property and neither the City of
Carlsbad nor any of its officers or employees assume
responsibility for the accuracy of said description.
This Certificate of Compliance shall have no force and effect:
(a) if the above owners or any subsequent transferee or
assignee acquires any contiguous property other than a lot
or lots shown on a recorded subdivision map, parcel map or
record of survey map filed pursuant to and prior to repeal
(Stats. 1955, Ch. 1593) of Section 11575 of the Business
and Professions Code;
(b) unless the lot covered by this Certificate of Compliance
is graded or re-graded to prevent cross lot drainage
otherwise created by the changes in property line location
accomplished herewith;
(c) unless the Developer submits a copy of a valid Coastal
Development Permit that is in substantial conformance with
this action, for the review and approval of the Planning
Director. A letter from the Coastal Commission stating
that a Coastal Permit is not required by this action shall
fulfill this condition.
(d) unless prior to the issuance of any further development
permit (as defined in Section 21.90.020 of the Carlsbad
Miscellaneous/M-1 .frm Rev. 5/23/90
Municipal Code), the developer shall comply with one of
the options available (as determined by the City of
Carlsbad) for agricultural conversion mitigation for the
City's Mello II Local Coastal Program.
(e) No further development of the site will occur until all
requirements of the Growth Management Plan for Zone 22
have been complied with.
(f) Prior to development of the site the owner must install
all required public improvements including streets, water,
sewer, and drainage to the satisfaction of the City
Engineer.
This Certificate of Compliance shall in no way affect the
requirements of any other County, State or, Federal agency that
regulates development of real property.

Office of the County Recorder in said County, more particulary
described as follows:
Commencing at the Northeast corner of Section 29, Township 12
South, Range 4 West, as shown on Map No. 7476, filed in the Office
of the County Recorder of said County; thence along the East
section line of said Section 29 South 0038'14" West 4474.95 to a
point on the Southerly line of the North one-third of said Lot 4;
thence along said Southerly line North 89"09'43" West 144.42 feet
to the TRUE POINT OF BEGINNING, said point also being on the
