For the Deed Restriction for cross lot drainage described above for Parcel No. 2, Parcel No. 2 shall be the dominant estate, and the estate that is benefited by the Deed Restriction for cross lot drainage, and Parcel No. 3 shall be the servient estate which is burdened by the Deed Restriction for cross lot drainage. 2. All of the portions or areas contained within the Deed Restriction for cross lot drainage as described herein shall be non-exclusive and may be used by the owner of record for the benefit of such respective owner. Exception and clarification to any use or construction proposed in this 45’ setback area shall be reviewed, and if acceptable, approved by the Planning Director and City Engineer. This covenant shall run with the land and be binding upon and inure to the benefit of the future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties. Owner agrees to incorporate this deed restriction by reference in any future deeds to the property. However, a failure to do so does not invalidate this restriction or affect the rights and duties of any party, person or entity as stated herein.
