WHEREAS, the owner of that certain property hereinafter described hz granted to The City of Carlsbad, a municipal corporation, in tI

and right of way for street purposes, described as follows:

is hereinafter known as the BENEFICIARY; and CROCKER CUSTODY CORPOR
is hereinafter known as the TRUSTEE as of the date of this instrumen
under that certain deed of trust executed by BARNEY L. BUTLER and BARBARA A. BUTLER, husband and wife, and CLAIRE GREENE, a widow, all
as joint tenants as to 1B
to secure their note for ($ 25,000.00 )
with interest dated August 26, 1977 and recorded August 31, I

AND WHEREAS, the BENEFICIARY affirms that it is the owner and
