(I) That said premises shall not be used for the purpose of boring for. or pumping, or producing petroleum, or any other oil or oils, ' other mineral; (2) tha; the whole, or any part of said property shall never, at any time, be used for the purpose of manufacturing, buying, or handling intoxicating liquors; (3) that any and all legal water charges or other charges or assessments made by said Oceanside Mutual Company, or its successors or assigns, shall be paid to said water company, or its successors or assigns, promptly when due. and if the wl any part, of said charges or assessments are not so paid when due. that the same shall ip:o facio, become lawful liens upon said premises. ) '" Upon a breach of any of the foregoing conditions, the title to said property hereby conveyed, and the whole thereof, shall revert anc in the first party, its successors or assigns. No forfditure shall occur, however, under any breach aforesaid, unless second part Y shall refuse Iect for ninety (90) days after written notice thereof (by any person or corporation herein given the right to have said breach abated or rem to abate and remedy the breach complained of; nor shall such forfeiture operate against a valid mortgage or deed of trust upon said prop be invoked against a mortgagee or trustee, in good faith thereof; but should title to said property be acquired by foreclosure of any mort deed of trust, or otherwise, the title so acquired shall thereafter be and become subject to all the provisions, conditions and covenants hereol same manner as though it had been acquired by direct grant from second part Y. It is further agreed by the parties hereto that the premises hereby conveyed are a part of a tract, and it is agreed that each of the COI Numbers 2 and 3, hereinabove recited, are intended and are for the benefit of the land and of the remainder of said tract, and of the owners and that a breach of any one of said conditions may be enjoined by any person owning any property or tract or tracts purchased from fir: and served by said Oceanside Mutual Water Company's water system, and adjoining said premises or said tract of which said premises are hut provided, however, it is agreed that Condition No. 1, hereinabove recited, is imposed exclusively for the benefit of the party of the fi and the party of the first part reserves the exclusive right to waive or modify the same, without the consent of any owner of any other or properties in said tract or tracts. Each and all of the said conditions, restrictions and covenants are to continue and be in force until January 1, 1940, end no longer. It is further agreed that each and all of the terms and conditions of this agreement are to be binding upon and inure to the benefit of t executors, administrators, successors and assigns, of the respective parties hereto.
